    I hold high regard for your postings...but in the 765 manual, I could not find any such rule that you just mentioned..Here is an excerpt from Pg 9 of

    Sorry to hear that case is gone to wrong office. The (c)(9)() class of EAD filing instruction is that it must be sent where I485 is being processed.

    During infopass visit, officer must have given some clue.

    If I were you, I would be sending the supporting documents with a covering letter stating the blunder. This type of mistake should not be uncommon to USCIS offices and they should have procedures to fix it.

    this is what i dont understand. they say a visa number is deducted only when they can actually start working on the 485 (i.e when the priority date is current) so would it mean that there are still thousands of applications coming in every month for eb2 with priority dates prior to june 2002 that is causing this retrogression?

    Recently, due to international pressure, Swiss govt. agreed to disclose the names of the account holders only if the respective govts formally asked for it. Indian govt.. is not asking for the details . . . . no marks for guessing why ????

    We need to start a movement to pressurise the govt. to do so !! This is perhaps the only way, and a golden opportunity, to expose the high and mighty and weed out corruption !!

    Is India poor, who says? Ask Swiss banks With personal account deposit bank of $1500 billion in foreign reserve which have been misappropriated, an amount 13 times larger than the country's foreign debt, one needs to rethink if India is a poor country?.

    DISHONEST INDUSTRIA LISTS, scandalous politicians and corrupt IAS, IRS, IPS officers have deposited in foreign banks in their illegal personal accounts a sum of about $ 1500 billion, which have been misappropriated by them. This amount is about 13 times larger than the country's foreign debt. With this amount 45 crore poor people can get Rs 1,00,000 each. This huge amount has been appropriated from the people of India by exploiting and betraying them.

    Once this huge amount of black money & property comes back to India , the entire foreign debt can be repaid in 24 hours. After paying the entire foreign debt, we will have surplus amount, almost 12 times larger than the foreign debt. If this surplus amount is invested in earning interest, the amount of interest will be more than the annual budget of the Central government. So even if all the taxes are abolished, then also the Central government will be able to maintain the country very comfortably. .

    Some 80,000 people trave l to Switzerland every year, of whom 25,000 travel very frequently. 'Obviously, these people won't be tourists. They must be travelling there for some other reason,' believes an official involved in tracking illegal money. And, clearly, he isn't referring to the commerce ministry bureaucrats who've been flitting in and out of Geneva ever since the World Trade Organisation (WTO) negotiations went into a tailspin!

    Just read the following details and note how these dishonest industrialists, scandalous politicians, corrupt officers, cricketers, film actors, illegal sex trade and protected wildlife operators, to name just a few, sucked this country's wealth and prosperity. This may be the picture of deposits in Swiss banks only. What about other international banks?

    Black money in Swiss banks -- Swiss Banking Association report, 2006 details bank deposits in the territory of Switzerland by nationals of following countries :

    Top Five
    1. India ---- $1,456 billion
    2. Russia ---$ 470 billion
    3. UK -------$390 billion
    4. Ukraine - $100 billion
    5. China -----$ 96 billion


    Now do the maths - India with $1456 billion or $1.4 trillion has more money in Swiss banks than rest of the world combined.

    Public loot since 1947: Can we bring back our money? It is one of the biggest loots witnessed by mankind -- the loot of the Aam Aadmi (common man) since 1947, by his
    brethren occupying public office. It has been orchestrated by politicians, bureaucrats and some businessmen. The list is almost all-encompassing. No wonder, everyone in India loots with impunity and without any fear. What is even more depressing in that this ill-gotten wealth of ours has been stashed away abroad into secret bank accounts located in some of the world's best known tax havens. And to that extent the Indian economy has been stripped of its wealth.

    Ordinary Indians may not be exactly aware of how such secret accounts operate and what are the rules and regulations that go on to govern such tax havens. However, one may well be aware of 'Swiss bank accounts,' the shorthand for murky dealings, secrecy and of course pilferage from developing countries into rich developed ones.

    In fact, some finance experts and economists believe taxhavens to be a conspiracy of the western world against the poor countries. By allowing the proliferation of tax havens in the twentieth century, the western world explicitly encourages the movement of scarce capital from the developing countries to the rich.

    In March 2005, the Tax Justice Network (TJN) published a research finding demonstrating that $11.5 trillion of personal wealth was held offshore by rich individuals across the globe. The findings estimated that a large proportion of this wealth was managed from some 70 tax havens. Further,aug menting these studies of TJN, Raymond Baker -- in his widely celebrated book titled 'Capitalism' s Achilles Heel : Dirty Money and How to Renew the Free Market System' -- estimates that at least $5 trillion have been shifted out of poorer countries to the West since the mid-1970.

    It is further estimated by experts that 1 % of the world's population holds more than 57 % of total global wealth, routing it invariably through these tax havens. How much of this is from India is anybody's guess. What is to be noted here is that most of the wealth of Indians parked in these tax havens is illegitimate money acquired through corrupt means.

    Naturally, the secrecy associated with the bank accounts in such places is central to the issue, not their low tax rates as the term 'tax havens' suggests. Remember Bofors and how India could not trace the ultimate beneficiary of those transactions because of the secrecy associated with these bank accounts?

    IS THERE ANY ONE WHO CAN SAVE INDIA?

    I currently have the Canon Powershot S50 which i'm selling.
    Looking into the minolta Dimage A2 and the Olympus C5060.
    Looking to spend about 1300.
    I mainly take indoor shots . and looking to print pics as big as 11 x 17
    Got the epson 1270 printer .
    any suggestion would be appreciated..

    Your choice of a D70 will give you great joy in your indoor photography for the next two years especially with the 18mm-70mm kit lens. You can tune the camera perfectly to give you the image you want. Moreover it is one of the fastest camera at this time for the price you are paying.
    The 50mm f/1.8, 24mm f/2, 28mm f/2 or the 35mm f/1.4 lens will add to your advantage for great indoor pictures without flash.

    As for people who want a SLR-like, the Minolta A2 has better features than the Olympus C-8080 in terms of zoom coverage, number of frames per second, long exposure and weight of the camera.

    A2 has a 28-200mm zoom range as compared to 28-140 of the C-8080. You can go at 2.7 fps x 3 images @ fine mode, but the C-8080 can only cope with 1.6 fps x 5 images.

    A2 has a maximum of 30 sec for long exposure while Olympus has only 15 seconds. The only advantage of the C-8080 is its marco focusing distance which is 5cm. The A2 can only go up to 13cm.

    For those who want a lighter weight SLR-like camera and do not need the speed of the D70, the Minolta A2 can be a better choice. However both cameras have fast speed lenses with the maximum at f/2.8 only.

    With the D70, you can even have the 85mm or the 50mm f/1.4 lenses for indoor photography using ISO 1600. Surprisingly the D70 has extremely low noise level even at ISO 1600, something that you cannot find in the other two SLRs.

    I know this isn't a solution to your problem, but some people may consider sending their kids to Canada to study. Canada's universities are en par with the best US schools and the international student tuition is often less than in-state tuition, although the declining US dollar has made it less the case these days.

    Many Americans I know are considering Canadian universities for their children, even though they can get in-state tuition.

    What is your idea/plan to do with this Data ? My Eb3 140 is pending since May 2007 at NSC. What are they up to - why the dates are NOT moving beyond Mar 2007 ? Who can ask this questions to NSC , we don't have the authority to do that.

    I found 1 point to drive this - there are lots of peoples who got EB3 140 approved after my Receipt Date May 2007. If we can compile that data in spread sheet and share that with our Local Congressman/Senator just to show them how NSC is mis managed that might create some pressure - what do you folks say ?

    I will be more than happy to pay $5000 if USCIS allow me to file for EAD and AP after I-140 approval. This way, I can work where ever i want and travel whenever I want. $5000 is nothing to get this kind of freedom. What do you guys think ?

    I signed the G-28 for 485, EAD & AP. Attorney received the receipt notices for all and he just emailed the case no(s) and A #.

    When I ask him to mail me the receipt notices, he says its not their general practice to send them to clients and they are really not useful when I start getting the FP notice etc...This is really weird!

    Folks - Is it possible to get a copy of the receipt notices by calling USCIS?

    You mean to say CIR will be introduced to the immigration or judiciary senate committee or introduce directly to the senate. If it is introduced directly to the senate floor that will save a lot of time, on the flip side it will become difficult to add or change provisions if it is directly introduced to the senate bypassing the senate judiciary and immigration committee

    I called Senator Ed Kennedy's office and was told that CIR is likely to be introduced in early March something like first week. They of course told me that there are no guarantees, but more a reasonable probability.

    I was very impressed by the guy who sang the national anthem...who was he?? He was too good!!

    And for all of Logiclife's detractors, you should have heard him speak yesterday!:) He is simply 3 good!:) he could have energized you, motivated you and prompted you to do more for our cause, by the way he spoke and what he spoke.

    We're still talking about it at home and how good both of us felt to be a part of this movement. Can't wait to see more pix and videos!:)

    Could someone live in the US on a H4 visa and work remotely for a canadian company, travel back and forth for business, all the while maintaining the H4 in the US? Of course the work in Canada would be based on a temporaray work status in Canada. What legal hassles would this create if any? Any comments. This may be a useful scenario for spouses stuck on H4 due to retrogression (no EAD, finished 6 years on H status). Anyone care to comment?

    same story for me, i just moved to different unit in the same apartment. everything remains the same. Same city, same zip code, same employer.. Somehow i believe address change triggered the RFE. Probably the change in the file pushed my file in FIFO and someone looked into it and gave a RFE. Will have to wait till i get the actual letter.

    We also filed on July 2nd at NSC.. got EAD and AP. buit no sign of FP yet. we were also out of country for last 3- 4 weeks. Is there chance we could have missed it?

    I do not want to spoil the party fun but somewhere in my mind there is a lingering doubt. I read Ron Gotcher's post about August 2008 bulletin.

    He says that Eb2 India will retrogress to 2003 or 2004.

    This is my opinion. TSC 485 processing time is July 17,2007. NSC 485 processing cut off date is July 28th, 2007. I don't know if CSC is still processing 485 EB applications but CSC EB processing cut off date on its website is April 04, 2006. The priority date for June 2007 bulletin was April 1st2004.


    Lot of big law firms filed 485's around August 1st because the date for filing 485's was extended to August 17th. So I think these 485's are still unadjudicated. Once they get adjudicated there would be retrogression. Analysts analyze. However the silver lining would be removal of concurrent processing of I-140 and I-485 which may give some additional EB 2 numbers next year.
