    My wife does not ahve paystubs from Oct 06 to Dec 06 and no W2 for year 2006. SO I would need a absence letter. Any for mat of letter would be appreciated.


    We have paystubs from jan 07 to Jun 07 and plan to leave in July after filing 485 and plan to re enter in August using unexpired H4 visa.

    I know of someone who used unexpired H4 visa in spite of being on H1 before leaving US


    Any issues with above scenario?

    What is the approval date for her H1-B?

    Using unexpired H4 visa for re-entry is no problem. At the time of entry in US, it does matter what status you were on last visit as long as one has not accumulated > 180 days in unlawful presence (i.e. stay beyond I-94 date).

    I have been thru this situation and luckly got the H1 extention on time to get it renewed the day it was suppose to expire.. I am sure this is going to be a problem for a lot of people in comming days due to mountain of applications to be processed by uscis.

    Thanks SGP. Did I read this correctly ? you switched in 9th yr of h1 ? was ur I-485 pending or did u have EAD to change ? I just have I-140 approved. so if I change to a new job now, can the new employer use this old I-140 for extensions ? can new employer ask USCIS to port old priority date ?

    My spouse is in a situation where she has spent more than 6 years time on H4 furthering her education/skills and now she cannot apply for a H1. I had read sometime back on murthy.com that USCIS was considering decoupling of H1/H4 time. That should soften the blow of retrogression to some of us.

    has anyone on this forum attempted to write to USCIS about it? I want to draft a letter - if anyone has done this before , please let me know.

    Thanks you all for the responses and help. We are searching for employers who can help me out in the situation. Most of them are thinking twice bcoz I am pregnant and have to take maternity leave within a 2- 3 weeks.

    Which will be the good option for me in this situation H1 transfer or EAD? I have EAD in hand, but never used. I like to maintain the status of H1-B as long as time permits. My husband is going to get health information next week once he joined in the job.

    THAT IS NOT TRUE. here is the fact

    1) Under HIPAA ACT , pregnancy CANNOT be considered as a pre existing condition by GROUP HEALTH coverage . This means you can also get health insurance by applying while u r pregnant.

    2) you have 30 days to enroll the baby after birth

    Although, in my opinion the important thing you may want to know is "what is the waiting period for your husbands group coverage at his new job, is it 30/60/90 days?

    bottomline: if there is a waiting period for him(which means for you too inorder to enroll in his insurance) then you still have nothing to worry, you have COBRA.

    Either way you are SAFE and should be covered

    Like the other OP mentioned, Obamas adminstration passed a law where in you can tax deduct the cobra expenses too.

    So I dont see any problem whatsoever. So be cool, good luck to you and your family.

    I know some OP's are suggesting legal options, with all good intentions ofcourse, but personally, I would not think about it, atleast for now as you may agree that EOD mom and baby's health are paramount.

    Gave in and sent PP by Fedex yesterday for Schedule A, grp 2 case.My attorney did not advise me to PP nor did a legally brain I turn to for advice. He said its likely that I would get approved even during retrogression.
    But I decided its better to know sooner than later, preferably before spouse started using EAD, and if a miracle happens (who can prevent miracles?) the 485 could also get approved concurrently with the 140.... And because I have 13 days more before retrogression hits. And because I saw people reportiing really qiuck turn around after PP. My employer was willing to pay half as well...

    Well plus I did not want to be stuck in the general EB2 pool (India) which looks like its a black hole. I have an approved labor from 2004 there.(yet to file 140 for that one)..so didn't see a reason to be stuck there with a 2006 PD.

    I still wonder if my reasons were sane and if my hasty action mght prevent my spouse from working -- if the 140 gets denied...Well, we'll take it as it comes..it may mean goodbye to the US or something..

    BTW as far as I know, retrogression doesn't start till November 1st.

    I efiled my AP on 9/5/10 @NSC and it was approved today after requesting expediting on 10/5/10 based on financial loss, I have a business transaction back home for which i need to be present and provided all supporting documentation related to that.

    This is what is think is more effective than contacting senators/Ombudsman for expediting, resend all the I-131 supporting documentation,proof of emergency/loss, 2 photos and include a cover letter with bold colorful fonts requesting expediting to the same address you sent your app earlier (btw, i used the USCIS center courier address and not PO Box address), i believe this way your app goes to the officer quicker and he has all the documents needed to approve your case right away if you qualify for expediting, i have used this process more than once and know it works at least for me....you have tried other methods, why not try this as well!

    Slow and steady is good in contrast to arbitrary, jerky movements, suddenly forward and then suddenly backward into the ice age, which does only harm and no good to anyone. Like they did it in July 07 and then closed down the gates.

    I'm hoping EB2-I marches right into 2005.
    Hopefully, EB3-I will also see forward movements well into 2002. Let's keep all our fingers crossed.

    With all due respect asking Bernanke to increase visa numbers of to do visa recapture is like asking a very successful lawyer to do a by-pass surgery.

    Congressmen (senators included) make the law and President signs it into the law. President is also the head of executive (which includes USCIS), hence he is the boss of USCIS. Its basic civics 101.

    Even if Bernanke is convinced 100% about your points, there is nothing he can do to help us. He doesn't make the laws, and USCIS has no reasons to listen to him (he isn't their boss). So what you suggest, my friend, is that we bark up the wrong tree, instead of approaching the right people - who are the only people who can fix our problems.



    In America, people gets recognized when they offers a solution for a problem faced by the country. Whiners are (who write to Bush or Senators) do not get noticed nor are respected.
