    Hi there

    Yes, when you join work you need to fill a new I9 to officially claim your right to employment using an EAD (if you have entered as an H4). Basically, this is the documentation to prove that you are undertaking authorized employment and giving up your H4 status.

    Now, if the underlying 485 of the primary applicant gets denied, then you can continue working if your H1 is still valid but sadly your wife cannot work and has to stop working immediately until a MTR is filed and USCIS resumes the case processing pending decision of MTR.

    A friend of mine was in this situation. His wife stopped working, their lawyer filed MTR (wife took unpaid leave of absense for 2 months) and after the case status changed to under consideration, she resumed working. Remember, the EAD is only valid as long as the 485 is not in a denied status. If employment is continued after 485 is denied and before MTR is accepted, you can later face problems for having engaged in unlawful employment in case you have an interview.

    Due to the economic downturn there aren't many companies sponsoring GCs for employees. I doubt it would be more than 20 to 30k per year from now. This leaves 100-110k visas available every year for retrogressed countries like india and china

    if there 300-400k pending GC applications in all categories then shouldn't all of us get our GC in next 3-4 years?

    I thought there was a country limit on how many gcs are approved for a country per year. So even if there is a spill over - can a backlogged country like India use it because of the limit ?

    Folks,

    I'm sure you must have debated this already. But, I'd post this anyways:

    Is it possible to take out(or substitute) the need to have a IV handle or register with IV, inorder to participate and meet the law-makers on the Advocacy Day?

    I'm thinking that could bring in more people. People who wants to register will register anyways and who don't want to can also participate. There are other ways to check the validity of the person registering

    I completely disagree..There is this huge debate in IV about EB2 & EB3 IN. Everyone is looking at the dates and predicting that EB2 I will be current sometime in '09. This is perceived as injustice to EB3. What people don't realize is that USCIS is not processing. What good is a forward movement if there are no tangible benefits for folks who have already filed AOS.

    Forward movement in Sep VB magnifies the USCIS inefficiencies. Despite the rhetoric on the board, this is -ve development in my view. Empirical evidence suggests that there are 1000s of cases pending for pre 06 EB2I & C and yet USCIS could not get that back log cleared. They obviously could not process enough to exhaust the available visa numbers and thus the forward movement by DOS.

    This bodes well for CP filers…good for them.


    USCIS is trying to make EB2 all countries Current sometime during FY 2009. Of course "a few" 2004, 2005 cases will still be pending past Oct08 but hopefully not too many.

    If EB1 and EB2 are shown as current soon, then the DOS can transfer the so-called "spillover" into EB3 ROW, then into EB3 IN & CH.

    Based on available numbers, EB3 India / China will see rapid movement in dates April 09 Visa Bulletin onwards.

    What will happen during 2009 in all likely hood is the following,

    Almost all EB1 spillover will go to EB3. (~ 25k)
    Some of EB1 and all of EB2 spillover will go to EB2 IN/CH (~ 10k to 15k)
    In 2009, there will be no more Name Check delays - therefore expect rapid EB3 approvals after April 09.

    By now, we all know of at least one person who lost his/her job recently. Unfortunately, this is a very tough time for all the people around the world, not just here in the US. But, we have to worry about our status here in the US.

    This is the one community which helps people like us, who are still waiting to go GREEN!!!. No body is going to help you or me get a job when we lose one. We have to help ourselves. We have to help each other.

    So, Friends, apart from sharing the bad news of layoffs with the community, please also share any job openings here. Let us try to help the ones here, without a job, to get one. I know it is not a job portal, but this is the one place, where we all immigrants come together. This is the time to help each other.     Please provide an update on the status of regulations regarding the following: AC21, CSPA, T regulations for adjustment of status, EB-5, and religious workers.
    Response: The AC21 rule and the EB-5 Special Class rule are both undergoing revision and should be published in the near future.

    I wonder what the AC21 rule revision is going to be?

    Yes sw33t, it indeed redirected me to some site by popup, it was one of those virus which is embedded within images. I immediately knew what was happening by noticing the performance of my system, but even then it was too late - everything was frozen!! Then began the painful recovery process... Sigh :p

    NOTE: It also hijacked Firefox, every time I use it, it freezes up the entire system and again I cannot re-boot, so for now I uninstalled Firefox and am using Google Chrome. So sw33t, please do something about it if you can :confused:.

    I do not think this is standard. I worked for a consultant company for 7 years and never saw an agreement like that!!

    Yes !!!Also to me, it feels very fishy. The topic of this document is very misleading too..."Time Sheet Agreement" and they have included all the 'bonded labor' clauses in it...Thats why I have posted it here in this forum to get some feedback from experienced people who might have come across these nonsense.

    Thank you very much for the reply. The reason for stressing so much is I already started the study and finish 3 subjects. Now again I need to start with new university.
    Doing masters is not a problem.

    U21 has another alternative where they give degree from University of Malbourne, which got AACSB accreditation this year only. If I will continue the education and complete masters and get a degree from University of Malbourne then U21. Will that work?
    Or I need degree from US based university?

    Let me preface this by stating that I have not yet shot with a D70, however I have heard very good things about it...particularly for it's price. IMHO, the best test of a camera is done in the field. By in "in the field", I mean does it allow you to do what you want it to do. A DSLR has a learning curve if you're coming from a P&S. Once you begin to master a DSLR, theimage quality bill be much better, and you also have much greater ability for creativity. If you want a D70, I'd take the info you've read regarding various issues with a grain of salt. Buy one from a reputable dealer that allows returns if it does'nt meet your expectations.
    After deciding to buy the Nikon D70 I began to read a number of posts to the pReview forum that had D70 owners citing backfocusing problems with their new D70s. All resorted to sending their cameras to the Nikon Service Center for repair. All reported at least some measure of correction but some indicated they could not achieve precise focus within the DOF for each of the Nikon compatible lenses they owned and are useable with the D70.

    I own two Sonys (the F707 and the V1). Both, in my view achieve remarkable clarity, color and brightness right out of the box. AF on both is, again in my view, is extraordinary. So, I would be very disappointed if I were to spend 1500 or more bucks (with some accessories) to arrive at inferior imagery.

    It is possible what I am reading is the view of purists who are able to "see" focus flaws that the more casual, but still demanding, amateur photogs would dismiss?

    Has anyone out there had experience with the backfocusing problem to which I refer?

    I would consult an attorney to understand your residency status..
    usually at the time of filing your tax you do declare your residency status (like you are a resident of X or Y state..(if i am not wrong)..]
    I think its a legal loophole they are exploiting..sad;-(

    I am stuck in EB3 and want to apply for EB2. How does one find companies willing to do EB2? With desi consulting companies you can ask upfront to the recruiter but with american companies can you do the same?

    Can users suggest some companies who are currently doing EB2?
    I think now we know why we are so fukked. Both EB2 and EB3! I bow to you sir.

    I am not sure what your point is. I am contributing monthly and I am not trying to judge anybody here. All I am trying to say is there needs to be alternate ways of reaching people unless all the 8400 registered people frequent the forums here.     Hi. I don't know the answer to your first question but from what's I've read, anyone who is adjusting status needs to do fingerprinting and it's done every year until greencard is approved. For your second question, a person needs to fill out I-9 form (http://www.uscis.gov/files/form/i-9.pdf) through employer to activate EAD. For your third question, you can search the threads for late june filers. You might find the answer in all their replies there. Congratulations for getting your EAD. We're still waiting for ours. :confused:

    We got our EAD in the mail today - We are late June filers (29th June) and got our receipt numbers last week, - I have some q's-

    -Can one get EAD without completing FInger printing? In the finger priniting colum on the EAD it says - not available, Would that matter?
    -How does one activate his/her EAD?
    -Have any other late june filers already got their EAD?

    I wanted to know if any one's online status changed after FP is completed.

    I had an LUD on my record after my lawyer sent the clarification to USCIS. But the status remains the same as ".... Case in suspense". Did any one's status came to Pending or a less ominous one?
