I called USCIS and spoke to Nebraska IO and she said they are sorry some of these notices went out in error. She checked my case and said I am set and no need to panic.

just for comparison sakes...do remember that the distance from churchgate to virar (in bombay) is 35 km. http://en.wikipedia.org/wiki/Mumbai_Suburban_Railway.
That is equivalent of approx 22 miles. I doubt there is anybody is bombay that drives 35 km one way on a daily basis. But in the US living 10-20 miles from work is not bad. People in my office drive about 40 miles one way without blinking an eyelid. Some drive even more. Plus the cars that they have in india have smaller engines, smaller capacity thereby better gas mileage.
So for people who say gas is a non issue, think again.

Hey Everyone,
My brother is a US citizen who has filed an I-130 for me and my family in May, 2008. We've traveled to the US on B1/B2 visas in February, 2009. The thing about it is that in the DS-156 form point "36. Has Anyone Ever Filed an Immigrant Visa Petition on Your Behalf?" we've answered "No". I've had no idea at that time that it was referring to the petition for alien relative. Anyways, we've returned back home in time. Also, I've had 3 visas before (2 tourist and 1 student) and never violated any immigration laws.
Then in December, 2009 we've applied for F-1 visa and got denied. This time it was a DS-160 form that we filled out which replaced the old DS-156 form. It didn't have that question about the petition anymore. I think they've decided to exclude it because a lot of people were confused by it. Anyways, the consulate officer didn't like the fact that I haven't transferred my credits from 2 courses of University that I've completed in my home country. Plus my major differed from my previous education course.
So my question is. Is it ok to apply for F-1 visa while I-130 is pending? I mean we've been issued B1/B2 visas before. Even though we've answered "No" to that question, they saw that I had a brother in the US who is a US citizen. I'm thinking of transferring my credits and using same major course this time or at least similar. This way in the eyes of the consulate officer it will look as I am going to the US to finish my education. The thing is, I am planning to attend community college first in order to finish general courses and then transfer to the university. My major in my home university was physics and this community college doesn't have it. I may go with "general education" course at the community college and explain to the consulate officer my situation.
Is it even legal to apply for F-1 visa while I-130 is pending? I believe so. My another question is. Once I finish education. What's the next step would be? Will it be easy to transfer from F-1 to H1B visa while I-130 is pending? What about my wife and a baby who will be on F-2 status? Please share your thoughts. Thank you!
For F-1 visa, you need to show non-immigration intent; i.e., you do not plan to immigrate to U.S. In your case, the combination that I-130 is pending, you want to apply to a university that does not have your major, etc., sends a very bright red flag.

you might also need a copy of your approved Labour application.
I am not sure if you can get the documents directly from the UCIS becuase the documents belong to your employer and not you.
you can try through Freedom of Information Act(foia.com). but it might take a while to get the documents.
All that is required is only I-140 Approval Notice. Labor Cert is not required.

Your dependents are "in status" as their I485 pending. donot worry about it. You will receive your card within 3-4 days.
Right now my parents in India are trying to seek help from local authority so as to say the ADM office - to get the certificate. I dont know how much this will work.........I will keep everyone posted.

It would be a smart choice to accept those application, but based on USCIS recent behaviors, I really doubt their decision makers have that intelligence to make such a smart choice.

Anyone can throw light into this one. Can we track APs now for NSC.
NSC is receipting late and also their AP documents are mailed very late. Please let us know when we receive our AP document after getting the receipts? for eg. 10 days, 20 days etc..

This new proposed rule will not matter for retrogressed categories / countries.
It will affect the lucky few whose PDs are current and can file concurrently. It certainly looks like they are enforcing (FORCING) premium process I-140s down everyones' throat now. It is a very typical dirty ploy from this administration.

At this time, no one knows how many EB-485 applications have been received by the Service Centers since July 2, 2007. Additionally, there is no way to find out how many more applications they will receive during the next 20 days. Obviously, the number of filings must have slowed down lately as affected by the AILF that they will seek certification from the court to include certain non-filers as members of the class action. Still, the number may turn out to be quite substantial by the end of July. No one knows when the "hold order" will be lifted and how long it will take to process rejection notices and mailings in the future.
Under the USCIS policy, the applicants are not required to submit any "original" evidence for filing of applications and petitions. It will thus be prudent that people may not want to submit original documents "other than medical report" as part of the supporting documentation to the EB-485 applications. Please keep original documents safe against the future need for refiling of the EB-485 applications in the future.

It appears that this rumor probably started from the USCIS HQ order over the Texas Service Center to hold all the July 2007 EB-485 applications abeyanbce and not to return the applications to applicants. Unconfirmed sources indicate that because of the order, the Texas Service Center is not returning the EB-485 applications which have been received since July 2, 2007. However, there is no evidence that the decision is necessarily related to its potential decision to withdraw the rejection decision. At this point, its reasons are completion unknown. Please stay tuned.You sure abt this. I could not find it @immigration-law. Can you post the link here ?

The proposed rule is scheduled to be published in March 2007 with 60-day comment period. It is thus not imminent, but in the later part of next year(Oops!), the immigrant community may see a totally different filing procedure including electronic registration and filing just like current PERM labor certificaiton application procedure. Once the concurrent filing is terminated, the immigrants may experience a terrible pain as related to maintenance of nonimmigrant status pending I-140 petition, eligibility for 245K benefit, plus unavailability of EAD and AP pending I-140 petition, AC-21 180-day portability, etc. etc. Should the I-140 petition processing be dragged, the pain will be extremely unbearable!

Much of Asia and Africa is bogged down due to unstable political condition, rampant corruption, weak institutions and regulated economies, not to say low literacy and paucity of skilled workers.
Correction: paucity of skilled workers owing to emigration to the "more competitive" economies. It is the emigrant source countries that need to be complaining, yet in case of the US we find that most of the complaining is coming from the destination country !!! Sometimes I do wonder if the US got too much of a good thing too easily.

I have sent letter twice. They forward it as it is to USCIS and send a reply back that it has been forwarded to USCIS for action. Then you receive a letter or call from USCIS that your case cannot be considered unless your PD becomes current.

By setting the language, the IV sends a message of welcome to all who share the American Dream. By including individuals across countries of origin, IV recognizes the nature of the Great Melting-pot and shows that we have the ability to be inclusive, tolerant, and work together on a democratic basis.
Let's make efforts to mobilize people across countries of origin and work towards success! KEEP IV STRONG!
