immigrants now pay for 90 percent of the agency's budget. They subsidize even non-paying applicants such as refugees, asylum seekers and U.S. military members.
(Washington Post (http://www.washingtonpost.com/wp-dyn/content/article/2007/05/27/AR2007052701118.html))
The funds provided to jumpstart USCIS’ backlog elimination project have expired and the total number of pending cases has increased. This result does not bode well for USCIS as it must rely on only its own resources to continue the backlog reduction effort. This could be particularly problematic if there is comprehensive immigration reform.
The DHS Inspector General’s assessment cited in last year’s annual report remains true today: “[. . .] reclassifications, as well as the strategy of relying upon temporary employees, may benefit USCIS in the short-term, [B]will not resolve the long-standing processing and IT problems that contributed to the backlog in the first place. Until these problems are addressed, USCIS will not be able to apply its resources to meet mission and customer needs effectively
Pages 11-12
Last June, U.S. immigration officials were presented a plan that supporters said could help slash waiting times for green cards from nearly three years to three months and save 1 million applicants more than a third of the 45 hours they could expect to spend in government lines.
It would also save about $350 million.
The response? No thanks.
Leaders of U.S. Citizenship and Immigration Services rejected key changes because ending huge immigration backlogs nationwide would rob the agency of application and renewal fees that cover 20 percent of its $1.8 billion budget, according to the plan's author, agency ombudsman Prakash .

Few things to add:
1) You need to determine sufficient coverage. If you have a mortgage and children, $500K is the minimum. A 30 year term non-smoker age 35+ should be about $350/year. You usually get a discount if you buy a policy for your wife too. If you try to purchase a whole life for $500K coverage, the premium will be ridiculous...probably $1500 to $2K/year.
2) I always remind myself of the KISS rule (Keep it simple stupid). If you want protection buy term insurance, if you want to save/invest buy stocks, mutual funds, bonds, etc. Don't try to mix them.
3) To protect your familiy, think of the 3 areas: Death, disability and illness. Dying is the easy part...you die, your family gets a lump sum. The worst is that you DON'T die, but have a terminal illness (e.g. cancer), have no job and then incur substantial medical bills. Remember to cover all areas.

Hello Dude,
Bangladesh- EB3.. You are one son of gun lucky dude. :)
Wish you and your family all the best in the Future.
Now, can I expect you to donate your 1st million for us to lobby in here? Man it would be of great help.. please....
---------------------------------------
Indaianabacklog --- Why the he** dont you understand you are born in the damn country with Billion people? But if you are not, then yes its a surprise. But how are you ROW?
And also from my experience --- You got to keep poking the USCIS authorities for them to wake up and take your application to process.
Let me tell you my story:
My company applied for my extension after 1st 3 yrs of H1 last year in Sept. I expected to get extension before Nov and I had planned to go to India in December. Well the dec came and I did not have extension, but I went to India as I was supposed to hoping that the extension would just arrive. Dec over, Jan over, Feb over, I am sitting Idle at home in India. Then I called USCIS- the officer told that since I left the country while extension applied and my h1 has expired, it means I have abondoned my application.. What the f***. Well, later I started following up with my h1 company.
Finally my office Amin staff personally went into USCIS office, explaining my situation and also showing proof that the client is waiting for me to get back and start work, I got h1 extension approved on Jul 24th.. What a relief.
Ran to Chennai for stamping and flew into Bay Area. Next day Med appointments cause i was to file 485 before Aug 17th.
Oh Gosh! I could barely do that and my application reached the NSC on Aug 17th. Now got the receipt numbers.
So Unless you keep poking them You wont hear updates. Just my 2 points experience in the swarm of people here.

Bottomline is they do not want to give us Greencard just use us and fool us. I am sure this 485 being current is big melodramatic thing.

There is no big secret, except little bit of planning and starting something.
I came here in 1997(at 22), but was in school for 2 years, started working in 1999. As soon as I started, I put money in 401k. I married early in 2000(I was only 25 then), my wife already did her M.S by then, she started working in 2000 even before our marriage. I made her put into her 401k(max out most of the time), we also put into esop. Together we have 300k in investment assests in 401k. Then I started a brokerage account and put 1500 every month, that accumualted to 150k now.
I brought house early, as soon as I am out of PT, with in first year of H-1, it didn't appreciate much but I still have an equity of 200k in primary house(I took 15 year mortgage) and I brought another house, that I rent out which as an equity of 50k. I have some cash. I brought couple of plots in india and also constructing an house in my native town in India.
But i want to do something else, I am happy with my life, for last two years, I got into golf, tennis and exercise, trying to be physically fit. I used to worry about GC before, not any more, whatever happens will happen.
Except that I am not progressing ahead in my carreer, I want to do MBA and get into something else. Right now most of my money goes to day care for two of my kids around 24,000.
More than money, you have to develop right habits, be healthy and have positive attitude.
In my case, Secrets of my lifestyle are
1. Getting started early, buying an house at 26. STarting 401k early.
2. Marrying a girl, who is already working.
3. Maxing my 401k and esop plan.

I think what ever step we take has to be organized and inclusive of all groups. It is not like last year EB2 pulled out a smart trick to receive the spill over. I mean they were all suprised & shocked to see dates go forward as were other folks on this forum. So trying to unite Eb3 by kind of blaming Eb2 or Chinese or ROW or for that matter anybody will not be very productive. Remember we are facing immigration opponents who are well organized, united and well funded. They have years of experience in lobbying and using media to their advantage. We are a tiny minority and if we further fracture it besed on nationality or category of filing all we will do is weaken our case further. We should focus our efforts for EB reforms across all categories and I think the best way is to follow the direction of the IV leadership on this isssue.

I think there are about 15K primary applications (add to that dependents) with PD earlier than Dec 2005 with the majority of them PD earlier than April 2005. There was a surge of applicants in March just before PERM started in April 2005.

There is an item on the web site about off shore work. That is a bit like a red flag to a bull for some. Could do more harm. I'm not saying not made a bug contribution, just that off shoring is a topic that would be harmful for us to be promoting even indirectly.

There is one more option for you. H1 and L1 employees can go on long paid/unpaid leaves. If her company can support with document that she was on an unpaid leave for any reason (I do not know the reasons...make something) then there are chances that she will be able to change her status back to H4. All you have to prove that there was a good faith employee employer relationship for that particular duration. Talk to a lawyer, explain the situation..........every passing day is making your situation worse. Good Luck.
It may work for someone who is out of status for couple of months, but if someone has not worked at all or out of status > 6 months, it will be tough.
Another thing if change of status is approved without I-94 and by then if I-485 is filed, then out of status is recorded and will be very difficult to overcome. It is always better if out of status issue is resolved BEFORE filing for I-485. Typically Change of Status can take 3-4 months and we may not have that much time to wait for I-485.
Trip overseas and re-entry can fix the out of status issue in couple of weeks.
Your choice.
Not a legal advice.

One of my friend asked Shiela Murthy and she said that in order to be able to add my spouse , I would have HAD to get married before July 31st (which I couldn't anyway), because, then, only I/we will be eligible to add my spouse.
Also, I sent in the papers for my I-485 last night. Now, hoping to god that there is an RFE on this and some kind of delay.
Thank you,
gc101.
double-check that note from Sheela Murthy (take an appointment with either her, or Rajiv Khanna). You have to get married before your 485 is approved, dont know whats that July 31st date. Good thing you filed your 485 atleast. You can add your spouse only when your PD is current, but you can atleast use AC21 in the meantime (for changing employers etc).
http://www.murthy.com/news/UDmar485.html
To summarize the INS position, as long as the principal applicant gets married prior to the INS' approving the I-485 application, there should be no problem for the dependent/s to either file the Adjustment of Status, if in the U.S., or to "follow to join," based upon a consular interview abroad. Therefore, the principal can file the Adjustment of Status application prior to marriage, but the marriage needs to take place before INS makes its decision on the I-485 application.

Sorry to hear about your experience. I personally have used AP three times within one year. Two trips to India were of 6 weeks and 4 weeks duration and one to Canada for 4 days. I have never faced any problem, having used three different entry points. During my latest entry just a couple of weeks back I wasn't even asked any question at all. In fact my GC was approved while I was out of the country. Just your bad luck to run into this officer, I guess.

Can you give pointers on how / which court to file. ANy website link ,any past precedences on lawsuit for EAD would be really helpful
I am nearing the expiration of current EAD for both myself and my wife. I am pursuing all other options actively and they are work in progress.
USCIS expedite criteria met - no results for past 10 days
workig with congressman
sent to Ombudsman, they responsded that they are researching
took infopass, no help

I will prepare a lawsuit template and post it on immigration.com
As you have an urgent matter, you will need to expedite the process. The rules give government 60 days to respond under normal circumstances. To expedite, you will need to file a motion for preliminary injunction right after you file initial complaint. This way, you will get EAD in two weeks.
