This is true and the only one working actively working for our cause. If this organization is not succeeding to its full potential, its only because high skilled immigrants did not support it to the extent they could. Everyone wants to know what IV acheived - with $175???

No one would like to hurt their political career with voting for us in the Congress. The politicians do only lip service whether for illegal or legal immigrant bills. They have zero interest in seeing them passed in the Congress.

Hello all..
In what circumstances does the USCIS issue a H1B approval without the i194 reciept in the bottom..?
that will be a worse scenario if we have to leave the country and face that stupid Madras embassy(my worst nightmare..) for the H1 stamping...!!
I don't want to fall from the pan into the fire..!!
I think in these cases it will be an Change of Status situation..

My manager surprised me today saying that I was promoted yesterday from a programmer analyst to a systems analyst. I have an approved i-140 and have filed my 485. My priority date for EB3 is current. I also have a 3 year extension of H1B.
There is no change in the job responsibilities.
Question:
1. How soon should I file my AC21 request?
2. What is the impact of this promotion on my H1B?
3. I have waited for 7 years and I may be close to getting my Green Card. How does the AC 21 impact my pending 485?
I declined my promotion. My manager said that it would take a lot of effort to unwind this promotion. He was not pleased with my request.

I am sorry, but this is just plain paranoia that seems to affect a lot of GC holders & aspirants. I have a friend who was worried about changing jobs as it was only 6 months since he got his GC!
You are *not* required to file AC21. Even if you do, in your case, it should present no problems at all, as your role & responsiblities have hardly changed.
It is not a wise approach to deny a promotion when you are not clear about the law. First be clear on the law and then make such important decisions.

I am writing to inform you of how the country based quotas imposed on Employment (http://immigrationvoice.org/forum/showthread.php?p=335690#) Based green cards are unfair and totally illogical. When I immigrated to the US, I believed that this country was a meritocracy where you were judged based on your abilities and qualities. These country based quotas reward people depending on where they or their ancestors were born. This causes people from India and China to wait over a decade to get a green card whereas someone from another country with similar or lesser abilities can obtain permanent residence in a very short time (about an year).
Since these EB category based green cards are awarded for professional skills, imposing a country based quota just does not make any sense. I urge you to work with Congress and change this unfair policy and reinforce that America is truly a society that celebrates meritocracy.
About me:
I have been in the US for over 10 years. I work for company ABC, for which I am happy to say, I recently wrote an algorithm (patent pending) which brought in about 10 million dollars worth of contracts to my company.
I have paid $xyzn federal taxes, $xyz in state taxes, $xyz in medicare taxes & $xyz in SSN taxes over the last 10 years. There are my monetary contributions to this country.

What is supplimentry exam? Is it that you did some extra courses after finishing your requisite courses for Bachelors? or are you refering to clearing your backlog subjects ( subjects from previous semesters that you had not cleared?). Where did you get your degree India or US?
supplementary is clearing the backlog subjects.(from previous semesters). So basically my degree completion is completed in 2002 (as I understood recently even though I was allowed to work and join the job I got in 2000 after my course completion). I got my degree in india. the problem is, the degree certificate they gave had date of dec 2000 in big letters and june 2002 in small letters (in parenthesis next to the dec 2000 date). the attorney took the date in big letters (dec 2000). I didn't know much about progressive experience and was not completely aware of progressive experience of EB2 requirement

Arent you concerned that if its approved on Oct 1, and you didnt get it, then where is it? Did you ask them as to why you havent gotten it in mail even though it has been approved a month ago? Also, did you check with your lawyer if he got anything?
It was approved on 10/1*/2007 not exactly on 10/1/2007. I was concerned and I asked her. What she told me is that once case is approved it generally takes around one week to get that mail out from mailroom and once it is out of mail room then generally it takes 2 weeks to get the mail for you. So calculating that I thought I should get that within a day or two. ANd another thing she told me is that once mail is out from USCIS mailroom then USCIS does not have any control or tracking mechanism so I do not have any choice other than waiting for mail...And yes I have just shooted an email to my lawyer. What do you advise?

what the heck happenned. The text has completely changed since I voted. When I voted it clearly stated the unused visas would be recaptured for family based and employment based immigrants. now it only says for family based immigrants. Have we (employment based) been shafted, is visa recapture for us Eb immigrants or not?

India rejected both Boeing and Lockheed Martin's proposal of fighters . I am not debating the reasons or the merits of this decision if this was right or wrong . I am just discussing the potential repercussions this has had so far and might have .

1) The issue is so serious that Tim Roemer , US Ambassador to India submitted his resignation immediately since he was on the hook for making this deal work .This shows the measure of disappointment they had.
2) India was seeking US assurances in security a Permanent Security council seat , which looks far fetched now .
4) Pentagon , Whitehouse and the DoD very upset that deal fell through . This sentiment will certainly percolate to the USCIS and the State department and might embolden Anti Immigration senators whose measures will get more support in the house and senate.
5) Prosecution of companies entangled in cases like Infosys might find more support and favor with the Govt.
Question is how/if there will be a backlash against India / Indian's get back at us at least in the short term .Increased scrutiny and visa denials , PoE Harassment , GC audits etc.
Will the US take a Tit-for-Tat reaction on this issue is what remains to be seen.

It is not fair to shout at him unless u understand the issue bereft of any emotions.
I think the AZ is the right thing to force illegal immigrants out of AZ since its bringing the economy down to its knees.
Moreover the AZ law is excatly the same as the current Federal law, its just that AZ is implementing it thru a state law, so why shd the feds object to it.
If you folks think that AZ law is wrong then why should other sanctuary states who prevent illegals from been sent back be allowed to pre-empt the fed law , even these states should be challenged.
We legal citizens are required by fed law to carry legal docs at any time(even though u may not like it), AZ is just enforcing the law
IV is all about legal immigration and does not support illegal immigration as I know it, Its a folly to think that if we support the feds they will support legal immigration and give GC's faster......Can anyone be 100% sure that the politicians will not drop the legal provisions from CIR just to get some votes to get the illegal immigrations laws in CIR thru......havent u seen how the healthcare bill was passed

IV team has repeatedly said that antagonizing any other immigration based group (illegal, family based, asylum, even anti immigrants!!) does not help us in our march to get what we want. By talking ill of the other group, we are actually hurting ourselves. Time and time again, it has been proved that being united works better compared to being divided. Why do we want to gain the wrath of any group unnecessarily? Its not like IV is working on undocumented issues........
Anybody can have any opinion he/she chooses to have. But don't share the opinion in a forum where the leaders are requesting/asking not to do so for the good of our advocacy.
