    Regarding point 1):

    Note that DoS has not wasted visa numbers after 2006. For all practical purposes, days of visa number wastage is history. Why do you think the July 2007 fiasco happened ?

    That's exactly why they may want to release fall-across/fall-down numbers in July so they can make sure nothing gets wasted. The only point i am trying to make is there are good possibility that dates may start advancing in July

    Also, please contribute to IV. I just did today, and believe me, you will feel better for doing so...

    This is not just for you and me, but also for those who will come after us. Also, this is not a battle just to sue USCIS/DOS, but a war we need to fight on multiple fronts:
    1) First and foremost, we the immigrant community need to join hands and fight as one cohesive group.
    2) Sue the government agencies for damages/violation of law/precedents due to the revised visa bulletin
    3) Get this matter the attention it deserves in the media
    4) Try and get congress to intervene in this matter, and also introduce and pass legislation that will fix the broken employment based immigration system
    5) Request corporate sponsorship. Since employers spent money on this fiasco as well, they will have a vested interest in pursuing this as well.

    The main thing, however, is funds. IV needs funds to fight for us. Each of us has already spent 100's (many even 1000's) of $ trying to get ready to file our I-485's. So even if 10,000 members contribute just $100 each, it will be $1 mil. I am sure each of us can at least spare that much. It is a small price to pay for liberation from this GC mess for all of us....

    With ~15,000 members already, and hopefully some serious $$$$$$ raised, IV will be a force to be reckoned with. No one will be able to treat us with such utter disdain ever again...

    Keep in mind when you change to your new Job .Your previous labor was approved in specific job code plus your advertisement which your old company used for filing perm application. All those job requirements need to match at least by 50% or so.

    At what stage will my current job description be matched to the Job description in my Labor or I-140?

    My I-140 is approved foralmost a year now and I had enquired with USCIS a few month ago and they told me my Name check has also been cleared and my case is just waiting I-485 adjudication when visa numebrs are available. I thought when my Priority date becomes current, I will get my GC seamlessly unless there is an RFE.

    Also, is there any documentation that states 50% job description match? This is the first time i'm hearing this criteria. I do understand that if I work as Mechanical engineer, I should not chnage my job to a Software engineer...but will getting a Mechanical Engineering job in a totally different industry be a problem?

    Our company is hiring slowly for the past one year and they are planning to hire more aggressively for the next one year. This is just in IT department. Overall the company employees grew from 600-800 in the past one year and they are projecting it to be 1500 in next two years.

    Well, I beleive my company is doing well and I am in a Strong Position as of now and even we are hiring a lot ....

    If 485 gets approved when priority date is not current we need to notify USCIS and they will change our status back to AOS. If we do not report this, it could create problems in future. The above link provides detailed information.

    I believe your priority date is current as of the approval date.

    Help!!

    Is any company filing new PERM applications in this economy? I was told that my current company (a really big one at that) is holding off PERMs indefinitely because we had some layoffs- indefinitely!

    My H1 runs out in Oct 2010, and I heard that I have only till end of Nov 2009 (including what I found out is called recapture time) to file.

    Now, I found out that my company have do newspaper/online ads for positions to demonstate that they tested the labor market etc etc (all stuff that I heard from the attorney), and I got the impression that she has no idea when they are going to do this and start filing again, and I got something like a best of luck look from her. I am freaked out now.

    Any of you out there know if any companies are still filing PERMs? I am on a EB-2 in Software.

    Also, if I join a new company, can I file a PERM immediately? Or is it just best of luck to me?

    Looks like I have to look into a Canada visa / Australian or UK visa or better go back and spend sometime in India. Any thoughts from any of you more enterprising folks out there? I have little knowledge of the process (my fault!) but I am stressed and freaked now.

    You are undergoing what a lot of H1Bs go through.
    They do not care about greencard on H1B thinking that it will come whenver the company applies until it is too late. They enjoy the first 3 years of H1B enjoying America and dollars and do not bother about IV or advocacy or contributing money to IV. I have seen such people even telling others it is a waste of time and making fun of IV. After 3 years they renew H1B thinking that they still have 3 more years. But once 6 years are about to expire they worry that they will have to leave US of A and the land of opportunities. It is at that time they try to start greencard process and check out IV. These same people then start contributing to IV and take this effort seriously.

    You still have time of 1 year and 9 months and that is good enough to get your labor through. Good luck and hope you find help from people here.

    It is true that the community colleges(A) and Arizona board of regents(B) set the guidelines but they have to follow Arizona Statutes which state that people with lawful immigration status are entitled to instate tuition. Therefore if (A) and (B) are not on the same page one could raise questions.

    I am providing below the statutes as well as what the Arizona Board of Regents say. It appears that the Board of Regents do not provide clarity on the issue. I think one could force the issue and demand that they be given instate tuition as provided by the Arizona statutes and Board of Regents Interpretation.

    In fact GC Card Dream should file an appeal to the Board of Regents as provided in their policy. Adding that community colleges allow H-1B's to avail of instate tuition would help get a decision in your favor.

    I don't think the state is involved, but its the institution that makes its own set of rules. All the community colleges in the state of Arizona accepts both H and L status as proof of residency.

    Please help me. There is no LUD on my status online. I had my finger printing done on sept 19. CODE 3. For both my husband and me!! I don't see any updates on the status online. Can someone tell me what I should do? FBI says they sent the prints the same day!!!!

    Am I stuck in Name check already?? How do you know this?????

    I called customer care USCIS, they say they don't have information regarding finger prints and you don't see updates regarding fingerprinting online. Is this true?

    In central NJ, I called over 9 Doctors and only two of them had an appointment before July 1st -2nd week.

    One is Dr. Neil M.S. Estrella in Clark, NJ. Appointment was available for Monday June 18th. But the fees for the exam plus vaccines is $430. The second one is Dr. Marcel Stern in Piscataway, NJ 08854. Appoitnment was available for Thursday June 21st. The fees was more reasonable at $350.

    If you're in Central NJ, Hurry, Hurry Hurry.

    P.S - If some of you get other appoitnments in NJ, post here so that others will know and not waste time calling other doctors.

    I am all for abonding H1B, when did IV promoted H1B program, we have this mess today due to H1B and itz loopholes,

    I don't use word slave very lightly, but we need to accept the fact many of H1Bs are handcuffed with current system, We need system similar to Austrialia, Canada a point based system or very similar to Nurses in US they get GC before even coming to US.

    H1Bs are truly pulling the wages down, I know I did when I came here I have no argument with anti-immigrants with this subject, but giving GCs to these H1Bs will have fair chance to compete in Market

    Corporate leaders such Bill Gates and Senators such as Kennady do know this issue and have deep understanding but they don't give a rat about it,

    No system in the world is 100% full proof. There maybe some problems with H1b problem, but that means system needs to be twicked, not abandoned. People like John Miano are always looking for posts like the one above. So just to win a point you are posting irresponsible comments, the once that could easily be found on any anti-immigrant websites. That’s why you are not just ignorant, you are idiot and foolish. Please post responsibly. It is the least that is expected from a highly skilled person like you.

    If you are not qualified enough and if you don’t add value to your employer, accept it and leave. Why do you think that you are a representative sample of the entire H1b community? There are lots of people on H1 who make their employers competitive and add value to their place of work. They are not driving down wages and your generalization of the entire H1b program to support your idiotic point about “slavery” is WRONG. It seems you have a very low self esteem.

    Delay with green card is not a valid reason enough to throw blame on everything around you, including blaming H1b program. Your attitude is ‘the door shuts right behind me’ and then you find reasons to justify your attitude. C’mon man, get a life.
