You are correct to the 'could' part.
Let me begin my explanation by stating my position on debt default:It is bad, it' NOT worth it and don't ever do it. With the explanation that I will be providing below, I don't want to sound like I'm encouraging debt defaulting, which I'm absolutely NOT. There are severe consequences for your credit, if you default a debt.
So, with that accusation out of my way :), let me explain the logic behind why I think OP is ok. Only thing that is in OP's favor is statutory time-limits, he had dodged the debt bullet for 5 years,afaik, creditors including the collection agencies lose their right to take him to court for a debt older than 5 years from the first date of default. Unless, OP makes some kind of partial payment now, which will bring the debt to current. At this point it will be a mistake for OP to do that. Collection agencies force him to do that mistake with all kinds of scary tactics -- He got to have a thick skin to settle the debt with whatever he can afford once for all.
Secondly, collection agencies buy debt in bulk, like 1000 defaults at a time. Collection agencies go through a rigorous screening processes, including threatening phone calls, attorney-letter-head notifications etc, for each debt, even before they can take it to court. When they could not talk to him or trace him or find any utility bills of him for 5 years, they would just consider him as MIA. Unless this guy is a rich dude with Hummers parked outside his mansion all the time Or has couple of rental properties on his name, they will not risk further investment on this particular debt.
Like always, my 2 cents.
I stand by my suggestion that OP must seek help from a Govt or a not-for-profit Debt Help or the best thing is to seek Attorney's help if you can afford. Don't go to the collection agency or to any of your debtors first.

The SOL for WA on open ended accounts is 6 years, and credit card debt is considered open ended account. The collection agency definitely has the option to take him to court. Now they may not actually do it, but the OP was concerned about the risk of being taken to court and that risk is definitely there.

There is a provision to withdraw the 401K without the 10% penalty. To avoid the 10% penalty, there is a rule called "72(t) - Early IRA distribution". But there are certain rules that need to be followed for this - and I am not aware of how it actually works. The only reason I know this is because I asked this question specifically to the accountant doing my taxes and he said that if I were to retire early, I could avoid the 10% penalty by claiming the 72(t) clause. However, he said that certain "rules" must be followed and you must withdraw certain amount every year - else you will be subject to the 10% early withdrawal penalty.
I didn't follow up on this rule as I was not interested in "early" retirement. I just wanted to know if it was possible to withdraw without early penalty. I would suggest you follow up on this if you want to take all your money to India without paying the early withdrawal penalty or paying much in taxes - either here in the US or in India.

Agreed........but if you will have to go to appeals if your case is legit to be reopened/reconsidered and be approved...........for any other reason if at all its not goona be approved........you cant get any visa for USA.........hence this low probablity case will be for those who are in good standing in terms of immigration else - go back to the home country..........

I can get you more information on this but you might just want to check Ron Gotchers website for detailed information.........there are so many different situations where nuthing would happen or you just get in trouble if 140 is revoked so we cant really generalize this....

This is one critical thing that USCIS must consider.....USCIS must have another way to handle EAD applicants with H1 or L1 and fast-lane for those without. H1 and L1 applicants (except those expiring soon and no more chance to renew) do not need EAD immediately while those without H1 or L1 needs it immediately.

EB3 varies bewteen Apr 01 and Nov 02 depending on the area

I am not sure when the CIR will pass...its not on Nancy Pelosi aganda in forseeable future... and several people already mentioned that if it didnt pass by MAY07 then you are looking at Jan 09 to get immigration stuff to happen...
I think we need to work on an interm EB relief bill ...which is absolutely non contraversial and try to pass it....not worring about piggy backing the CIR...
Issues such as h1 increase or adding more numbers need not be in it...we can include things like EAD after I-140...spouse/childer not considered for EB quota...etc...
Unless we act desissively now...its going to be a long way to 2009..

I am in a similar position and am going to wait till the end of the year for the AP. I am hoping to be able to go for the H1B stamping with the AP. So if there is any problem with the H1 I can atleast re-enter using the AP. Its a nice backup...
I know that if you don't have H1 stamping you need AP to reenter. But if you have AP why do you need H1 stamping if you are working for the same H1 employer after reentery? Is H1 stamping a backup to AP?
