    My PD is Nov 2004.
    I do not have any dreams of my 485 being cleared this month as my I140 is pending at TSC since April 2007. Just last week we got an RFE and the attroney is working on the response.

    I've called several members and I am dispointed of them just saying "no.... I can't..."
    But they all have time to be in the forums everyday asking for help, asking questions about dates, receipts, etc. It just doesn't make any sense that they have the chance to do something about it, they don't have "enough time for it"
    But I am sure, they all complaint about how long is taking and all the money they have to invest on attorneys.

    Both were EB2 from the same company. PD on one was Oct/2006 and the other was Feb/2002.

    Congrats for the GC !!!
    You mentioned that both of your cases are under EB2, correct? Normally people will do interfile (PD Amendment) from one category to another, like EB3 to EB2.
    Can you please share why you ported in the same category? Or because of some other reason?

    Well, everyone wishes the rumour to be true.
    But you know what, to realize the increase in fees for the I-485, they should allow people to file for it. Unless people start filing for I-485's they are not going to make the $2billion in 2 yrs. If retrogression continues, guess the fee increase doesn't make much sense.... Not sure whether I am right or wrong here.

    Does this mean that an MTR filed without the filing fee is automatically considered an appeal?

    I don't think so. For an appeal - those boxes must be checked. Once again - I might be wrong.

    Sometimes they return the forms back saying - please file it with a fee - sometimes they keep it - WE DONT KNOW

    Members from NY/NJ/CT, please join the yahoo group. Murli and others are leading a strong campain. We need more support.



    Always check with your state chapters.
    State chapter leaders are more aware of our work than what we post on the forum for public.
    There is lot of activity going on at this time. Everyone must join their state chapters to actively participate in IV effort.

    no, its called covering our behind, if in future something comes back to bite ;),
    As long as your orig employer does not complain(which i hardly doubt anyone will do) you are fine, worst case scenario if someone does, then its not a big hurdle to cross with an able attorney's help.
    Just to put your mind at ease, i have several friends(not friend-of-a-friend) who had quit at various intervals (1-2-3 months) after getting their GC's and haven't faced a single issue while in process of becoming a citizen.
    In short its better to be safe than sorry so these attorneys suggest staying for atleast 180 days.
    If that is the case, then why is it that all immigration attorneys are asking us to stay with our current employers citing this "Intent" thing? Are you saying that it's all smoke and no fire?

    Similar situation here...applied EAD/AP renewals 1st week of May at NSC for self and spouse. So far only my EAD has been approved, which is pretty much of no use to me since i am on H1B - but employer was paying all costs, so the law firm applied it anyway.

    Spouse needs EAD ASAP before expiry, but nothing yet. I want to modify wht u quoted below:

    "USCIS won't give u what u want" I think they somehow have an idea of how desperate u r for someting and ur processing/wait time is proportional to your desperation. :-)

    E-filed on May 5th, FP on June 6th, no updates since. Concerned as I'm working on EAD and current one expires August 29th.

    Paper filed AP in late June, approved already (as per e-mail) even though I only needed it in mid October!!

    Just like the the old Stones song... "You can't always get what you want"

The background for this change of heart by the Executive branch is the fact that many federal courts have been coming down hard on excessive name checkdelays by the FBI. In fact, not only have some courts ordered expedited name check completions but in some cases courts have suggested that the courts have and would use their authority to adjudicate petitions if the Executive branch could not get itsact together. The attorneys and litigants who have sought federal court relief over these last several years deserve credit forforcing the Executive branch to adopt a more effective policy in this area (when it does happen, hopefully very soon).

    USCIS will not look into your tax records for H1b approval. They might ask you for your previous H1b approval notices and or pay stubs but thats all. However when you go to the embassy for the stamping they might ask for tax returns.

    officially eb2 or 3 application is based on the qualifications required for the job and not on your education status, there are hundreds with masters who are on eb3

    While it is true that EB 3 india will take "forever" for those with priority date after 2005, USCIS has been coming down heavily on recent spate of EB3 to EB2 filings. One thing to ask an employer who claims to file EB2 on your behalf is whether they have applied similar EB2s successfully for candidates at similar position that they are offering you. If they fail to provide a satisfactory answer, they are more than likely luring you with a false promise.

    When her both I140s were approved before the July/07 485 application, why didn't she use PD Porting at the time of applying 485 app in July/07. That is one of the easiest way to port PDs. It would have been straight forward and she may have received the GC by now. I know, lawyers can make one's GC Journey much more harder than it should be.

    Nothing happens to your current "Adjustee" status if you interfile. But, I can understand the apprehension duw to either lack of information or plethora of wrong information present in the open.

    As her EB2 PD is becoming current from Aug/08, she need not do anything now, maybe 4-5 months ago she should have done interfiling when EB2 started to come out of Unavailability. On Aug/1st, she can call USCIS and if they let her, open a Service Request on behalf of her case saying that her PD is current and her RD is July/07. If everything on her app is complete, she may get the approval in August only. Best of luck to you and her. May you guys get it soon too.

    Her RD is July 28, 2007 at Nebraska but her case status shows that it been transferred to TSC. :(

    485 receipt issued only in october 2007.

    TSC processing dates are still stuck at JULY 16, 2007 and there will be thousands & thousands applications filed between July 17 and Aug 17 when the visa gate was re-opened. No end in sight of this GC journey suffering for the unlucky people born in retrogressed countries.
