I am proud of IV!
Yesterday, I felt proud to be part of a crowd that is so dedicated, selfless, hardworking, fearless, educated, discplined, understanding!!
Each one of you were an inspiration. I cannot thank you guys enough for all your effort.
Logic Life's speech was awesome. I wish he can post it here too, for people who missed it. Vandana....you are the rock star we need!

What if I am working as a contractor with a govt agency. The agency offers me a job but salary would be 10K less than my current salary, but with better benefits. However still new salary is more than what is required to pay for similar job at that place i.e. if a company is filling for a new H1B. (the prevailing wage at new location for that job classification at that position/level)
Now in this case, if the salary is 10K less than what is specified in my I-140, will I hear any music from CIS? This is not hypothetical, but real dilemma I am facing.
If both job (old and new) in same area, and new salary is "considerably" less than old salary, then it may be an issue. But it may be overcome, provided if you know the prevailing wage determination (not salary) of old job. Lets say if the PW for a level-3 engineer for your old job 50K at a particular county, and I-140 salary in your old job is 70K, and if you port to new job with new salary as 60K in same county, then it should not be an issue. Again, if USCIS does not buy this, you need to dispute. It needs extensive lawyering with DOL wage survey as a proof.

Thank you for the replies, I think I won't do anything further for the I140. I will try to get my H1B first. I am wondering in my case, will my H1B application be rejected due to the "I140 filed when F1"?

more H1s is not only good for the employers, but also potentially for the economy. More taxes coming in, more pple putting money into the flow by buying things/cars etc. If they look at it more from economy perspective, this cud get approved/passed. Sorta kickstarting the financial situation.

Below is data of PD from last four years for EB2-I - only for Jun, Jul & Aug.
Except July Fiasco , I don't see dates ever moving forward in July VB; but they do move in August VB.
Has anything changed in spillover laws in last 1 year - which will explain this no movement in July but in August?

What could be different this year compared to previous years are
1) DOS seems to make sure no visas are wasted and so may not want to wait for the last 2 months of the fiscal year.
2) More cases are pre-adjudicated which makes it easier for them to initiate the fall-across/fall-down in July than wait for August.
3) DOS has been good at not retrogressing the the visa dates further back in the last few months. They either stay where they are or move forward. But not back. This indicates that they are paying more attention and not randomly opening up visas. This means they want to issue visas by priority dates which would need proper planning (to make sure nothing gets wasted)
All these above factors may influence them to open up in July than August. Again, these are my gut feel.

I too received EVL RFE...however, my lawyer created the letter w/o any reference to AC21...except saying that my duties remains more than X ( > 50 or more)% same as compared to one filed in I-140 application and salary remains above required level.
I had discuss this with HR before joining new position...they had no problem with it.

I think ppl who have masters or above from accredited US university shouldn't have any visa restriction; meaning they shouldn't be counted towards their country quota. No cap for Masters from US University -:)

Your 797 approval notice will have updated I94 which will supercede your previous I94. The new attached referes to your 797 number starting with "RAC" or "WAC" like that.
You need to submit this one too along with any old ones you have when you leave the country.

I guess EB3 will finally cross 2001 barrier in the next bulletin.
For Eb2, it will be like the new EB3. Just too many cases were filed in EB2 after 2005.

What is the use? EB3 had crossed into 2003 last year. Then they moved it back to 2001. Which means that they have a lot of applications pending from 2001, 2002.

I have written a check to USCIS for my H1B application fees.

Why don't we just voluntarily mention the amount that we contributed in our signatures ? Since contributions are voluntary, so should be the option of disclosing information on it. When many contributing members start furnishing their contribtion information voluntarily, it becomes the "fashion" and others will follow suit, as no one wants to look like a free-rider.
As for the veracity of the information, we got to trust each other on that and follow an audit policy- I assume the core members/ administrators have the ability to cross-check the contribution information if someone looks suspicious. Anyone caught furnishing false information can be blacklisted. Such a policy minimises the work of the core team, without being overly intrusive.

This is my first contribution of $100 to IV as a new member. I urge my fellow members who have not yet contributed to do so and strengthen the efforts of the IV to get some relief for legal EB immigrants before congress adjourns. I hope IV will keep up their good work and more members will contribute. It could be any amount, please do so. This is our last chance to have something done. Believe me there wont me talk of immigration reform after the November elections until after 2008 elections.

Are there any restrictions on accepting salary-hike or salary-drop after 180 days. If so, upto what % increase/decrease is okay while changing jobs.

PS:Just before filing my AOS I had promotion offer but HR/attorney said title and salary needs to be same as in LC or else it may jeopardise gc process. The max salaray increase allowed to me was 8%.

SO if USCIS wants to make a new rule of filing I485 for the one whose I 140 is cleared and priority date is not current, It CAN DO That RULE Right?

Like they start premium processing of I-140. They make this rule without any bill in US Senate. correct me if I am wrong

Personally I do think giving this 55,000 annual quota green cards to employment-based Science & Medicine immigrants is better than giving DV-lottery to other lucky people just win the lottery but without any high educational qualification. Also, since international students have stayed in US for long years and they have documents such as social security no. and driver licenses' to run the comprehensive background check. Therefore, it minimizes a lot of the risk to invite the criminals to immigrate.
However, I am curious whether this bill will be beneficial to all US advanced graduates in Science & Medicine or not. I know some new H-1B workers in those advanced degrees may NOT be the EB-type and they need to wait for certain years and then the employers will sponsor them green cards as the EB-category. And if the employers don't sponsor them green cards due to companies' merging different departments or for other accidental reason, they will lose their green cards.
Also, some advanced graduates in Science & Medicine cannot get the H-1B working visa smoothly due to H-1B quota is full and need to leave US and some of them can't get the
H-1B extension and need to leave US. Or some of them got laid off during their employment period due to merge of 2 companies and if they can't find another employer, they need to leave US too.
Therefore, if they can't get into the EB category, this bill cannot help them out!! Personally I do think if to allow all those advanced graduates in Science & Medicine to enroll online by "first come, first served basis" and once the 55,000 quota is filled, then they need to wait for the next year to immigrate. This will be fair and can retain all those US advanced gradudates in Science & Medicine who are graduated in different years with different luck to get the H-1B working visa.

I got a letter saying they can not give me my job back dated 5 days after my approval.
I show up told them I was approved, they say sorry we have not sold anything on those 3 months, we are doing bad, cannot take you back.
They dont have any problems with it and I can wait 10 years to become a citizen if that is what it takes.
I think you are good so dont worry too much. I understand your fears and frustration.
Try to get an appointment with a good immigration attorney to see if you need any more documentation.
