Please use this opportunity to contact Congressmen and White House - it's extremely easy and simple to do so! All you have to do is fill in your address and send a message which will automatically be faxed to each of the targeted Congressmen as well as the White House. Message: "I am writing today to express deep concern about the legal immigration process! Are you aware that there are over a million legal and highly skilled applicants,who have been working in this country legally and paying taxes, but are waiting in line for an Employment based Green Card, some for over 8 years? A majority of these Legal Immigrants have been impacted by horribly slow administrative processing by the Deparment of Labor between 2002-2006 which resulted in the pipeline for Legal Immigration becoming clogged at that time. Now that obstacle has been finally been cleared, the line of Legal Immigrants is coming up against annual limits to Legal Immigration (both overall and country based) followed by the USCIS. This is directly a result of the Deparment of Labor dragging its heels and holding up applications during over the years mentioned above, resulting in several hundreds of thousands of visa numbers going unused during that time. I request you to act now to relieve the pain and suffering of these Legal Immigrants by recapturing those unused Visa Numbers and allowing these Legal Immigrants to progress through the Immigration System.
This reform will strengthen the rights of all workers, value families, hold employers accountable, and move America forward. During the election, President Obama pledged to reform our nation's immigration laws in just this way. I am writing today because I want to see the plan to get this done.
Please let me know what the road map looks like to passing immigration reform. Our families, our communities, and our economy cannot wait any longer for this urgent reform.

That should be the only goal. I am hoping that IV does not need to exist in the future, that everyone legal is getting a fair treatment, but that looks far away right now. Until then people need to fight.
I can understand and accept that US wants to promote certain groups of people for their skills, such as doctors and nurses since there is a shortage of them right now. US educated, since they have helped the US economy and school system and so on. But the core goal should still be fair treatment for all. No retrogression for legal professionals.

yes, no checks cashed yet, checking my account regularly. the notice date is 21st sep, so I am thinking it might take 3-4 business days for the checks to cash, do you guys think my assumption is right?

I know a person who applied TIN number for their parents as they stayed in US for more than 180 days(that is technically possible as some months have 31 days, so if you correctly plan your paretns trip, people on visitor visa will be allowed to stay for 6 month or 183 days) . Also ff you talk to your immigration officer at the port of entry and convince him that an extra three days would be helpful for parents, he might give you 183 days visa.
You need to prove the substantial presence of parents in US.They have a formula to calculate that (total number of days present in current year + 1/2 of number of days in previous year + 1/3 of the a year before previous year) and it that total is greater than 180 days + some other technicalities(which are easy to prove), you can file for TIN number and file taxes showing them as dependents.

Hello All -
I am planning to get my PP renewed at the NY consulate and had a couple of questions and I was hoping someone could shed some light on them.
i) The DC website states that one can *only* apply 6 months before expiration date but the NY website does not? Mine is going to expire in ~8 months. Anyone know if it is 6 mo across all consulates?
ii) They have it in big red font that the photograph should be 3.5 cm * 3.5 cm, the US standard PP size is 50 mm * 50 mm .. any ideas where I can get them done in the right dimension?
iii) If applied in person do they issue the PP the same evening?
Thanks in advance to anyone who can share their experience esp. at the NY consulate

I checked my I-140 status online today and i saw Approval Notice Sent. Thank you everybody for your responses. my case details are EB3 I-140 applied Dec 2006. Received RFE to send copies of bachelors and masters degrees on Nov 15th 2007. Attorney responded to the RFE and case status changed to Received Response and case processing resumed on Nov 30th. Had soft lud's on Dec 2nd and Dec 3rd and Dec 6th. I hope this helps those waitin for approval after responding to RFE.

I have got FP appt notice 7 days back. I am July 2nd filer, filed at NSC, but transferred to CSC and then back to NSC. Also, got AP and EAD approved long time back from CSC.
I had seen a similar thread for NSC->CSC->NSC filers, but can't seem to find it anymore---did anyone whose cases got transferred to CSC receive FP notice?
I am a July 2nd filer, EAD/AP approved from CSC, case transferred back to NSC back in early Sept--still waiting for FP notice for over 4 months now.
PS: I am not desperate for FP notice---and i know it's going to be several years wait--just want to get the FP done and move to an apartment with lesser rent :-)

my LUD for I-485 did not change since 8/28 even after my FP is done.
Today I got email regd EAD that the card production ordered.
called FBI Helpdesk and she told me that over weekend(sat 9/22) then have sent the approved file to USCIS. May be USCIS is lost my file somewhere.

Yes if you look at cnn-ibn you may see such a heading .. but there are thousands of vernacular language media that 90% of its population read everyday and even completely indian English media which is celebrating Diwali just the way they should. Yes foreign investments are there but they are not as big as they are made out to be . If Citibank would like to invest today whom will it invest with - GM or Tata Motors? Money is just something that change hands and flows where there is the greatest potential.India has her strengths and it will beat the odds.

If one changes from EB3 to EB2, then priority date is lost!

I do not think one would not go to India just because he/she is scared to get a stamp in India. The loss of someone dear to you can overcome any such fears one might have (for me atleast thats applicable).
In any case, I did not know (neither did my collegaue) of the emergency quota. Thanks for sharing that with us and thanks to forums like these, every day is a learning experience.

But I do know my colleague did get his appointment through emergency quota and got his stamping and returned back, after attending his father-in-law's death/ funeral. He was not able to schedule the appointment through the online system, but he had to call the consulate directly to get his appointment. He got his appointment in the same week he had called them.

The question i've is:
I heard from my Immigration Lawyer that,from November 01, 2008, any person who works in Information Technology (IT) and who has Advanced Degree from USA like Master's is eligible for EB3 Category only and not EB2 category. Please confirm if the above statement is true or not.

I guess that leaves only two options. Either leave US or file for his/her own Green Card application. Too bad.
First could be F1, or H1 then GC journey.
