If you are working on H1, #2 is not an option. You will be violating immigration laws by accepting payment from unauthorized sources by doing so.
Thanks guys for your reply. This was tremendous knowledge that you guys dumped in.
Let's say if I am on the green card (EAD) , then still I can not evade this tax situation correct ?I mean if they pay me and I pay to the company in India who is really responsible for the service.

Dont think negative !!! THINK always that it will be true.
The LAWSUIT has immense WINNING POTENTIAL.... Instead of losing in court of law and make that a NEWS in major mainstream media GOVT agencies wrap up mistakes in this way. This method works everywhere , so that the noise level remains low.
As the lawsuit progress they may offer Financial compensation ... anything can happen if you can Prove that you have been beaten financially for a wrong announcement... I mean if you can show receipts between June 13th and June 30th and that document is a requisite in 485 application anyone can claim compensation ...
That's how american JUSTICE system works for citizens ........

I have been feeling sad that I have not been able to make it to the rally and after hearing about the energy, the camaraderie and the excitement you all shared I know for sure I missed out on a once in a life time oppurtunity, there will always be that sadness in me, the only comfort I have is that I tried to contribute in ways other than attending the rally.
But I am very glad that this turned out be such a resounding success.

Ramba, what are different levels? example, I found something similar on flc data center website. How can I know which level I am in to?
Area Title: Town, State
OES/SOC Code: 15-1032
OES/SOC Title: Computer Software Engineers, Systems Software
Level 1 Wage: $29.48 hour - $62,111 year
Level 2 Wage: $32.92 hour - $71,347 year
Level 3 Wage: $37.37 hour - $78,603 year
Level 4 Wage: $41.81 hour - $85,838 year
Unless you your approved LC or PW determination by DOL of your old job, it is difficult know what level you are in. Generaly level1 is an entry level position and level 4 is highly exprienced position. Depending upon job descrption/duties, DOL might have allocated suitable level for your job in the LC stage. If your LC was filed before PERM, then it was only two level (level1 and level4). After PERM, they introduced 2 more intermediate level.

Hi deafTunes123,
I went to infopass yes'day, mainly to confirm my priority date. My employer used RIR labor and ported to PERM. Not sure of the PD, so took infopass.
She printed the screenshot and given me.
Find the screenshot attached. Preference E21 is EB2.
E31 is EB3

Thanks.
Guys,
I took an info pass last week to check the status of my case. Specifically to check whether the interfile is success or not. IO at USCIS office mentioned that she cannot check whether my case is in EB2 or EB3. I am surprised to hear that. Gurus any has this kind of experience?
Also, She mentioned that my case is assigned to an Officer on August 13th. Do any one has any info how many days(on average), an Office will take to approve a case. Any info. is helpful to me and all.
Overall the Field Office people were polite.
Thanks,
Thun.

:)Our check was cashed today 08/22
We paid with one check for: two I-485s, and two EADs. In little space on the check where it says for I wrote fees. So, just want to let you know from my experience that, obviously, it does not matter if you paid with one check for all forms and applicants (in our case total was $1,150) or with separate checks for each application.
Our details:
PD Aug., 2005
EB-3 ROW
I-485, EDA reached TSC on Jul. 2nd
Check cashed 08/22
Called Bank of America and got all 4 case numbers from the back of the check.
Checked INS website applications were received on Aug. 21st and currently pending.
Receipts were mailed .
All applications were prepared and sent by lawyer, so I dont know exact time when they reached INS or who signed for it.
Good luck everybody !

MrWaitingGC,
My H1B is valid till April of 2008. When i went for vacation and entered the country in March 2007, the guy at the border patrol did some mistake and put the date on I-94 as 16th sep of 2007 instead of April 2008.
Your status is governed by the I-94 date and not by the visa expiration date.
I tried to get it corrected at the local CBP office but could not do it ... So i am planning to make a trip to Canada before my visa stamp expries to get a new I-94 which is valid till April 2008.
But since i have sent my passport for renewal, i am not sure if I can make the trip bfr my I-94 expires.
And also i am not sure if i can file for extension of my H1B as it is more than 6 months ( it is about 10 months early) before the expiration date on my current H1B.
You can file for H1 extension 6 months BEFORE STATUS EXPIRY date (16 Sep 2007), so you are ok and while extension is pending you can continue to work for the H1 employer upto 240 days. You should get new I-94 with the H1 extension approval notice. You don't need new H1 visa stamp until you travel out of USA.
At this point i am helpless with out my passport. I hope i get it soon.
So what i wanted to find out is, is my status still legal after 16th sep 2007 if i file my 485 ...
Like stated earlier, as long as your employer files for H1 extension before Sep 16th 2007, you are ok.
See above in Blue.

This was published in March 2006 on Murthy. May be some (monkey) from USCIS read it recently ;).
Chandu, here I found the LINK (http://www.murthy.com/news/n_porret.html)
"When explaining the risk of potentially stricter AC21 regulations to I-485 applicants, we are frequently asked, "If I change jobs under AC21 and the regulations are released after that, they won't apply to me, right?" Unfortunately, this is not correct. While it is not possible to predict the content or effective date of any future regulations, they will likely apply at the time of adjudicating the I-485 application, and not just when the job change occurs. In a hypothetical example, if new regulations were to limit the percentage of acceptable salary difference, or prevent multiple portings, the officer adjudicating the I-485 could decide that the job change violates the regulations, even if the change occurred months or years before the new regulations were issued."

I had seen a similar thread for NSC->CSC->NSC filers, but can't seem to find it anymore---did anyone whose cases got transferred to CSC receive FP notice?
I am a July 2nd filer, EAD/AP approved from CSC, case transferred back to NSC back in early Sept--still waiting for FP notice for over 4 months now.
PS: I am not desperate for FP notice---and i know it's going to be several years wait--just want to get the FP done and move to an apartment with lesser rent :-)

Alisa has a good point, is there a list of important items that we can present to lawmakers.
I belong to my state chapter, I am all for meeting whoever to make an impact but it would be great if we can put together good talking points and issues to highlight when we meet these lawmakers.

We got our EAD in the mail today - We are late June filers (29th June) and got our receipt numbers last week, - I have some q's-
-Can one get EAD without completing FInger printing? In the finger priniting colum on the EAD it says - not available, Would that matter?
-How does one activate his/her EAD?
-Have any other late june filers already got their EAD?
Thanks
Sheetal
yes one can get EAD without FP, first EAD will be like that for all
since EAD processing seems faster than RD, FP etc.
Please read other threads before posting a new one.
