I don't know why do we (EB community) support it?

    1. There is no economic sense for DREAM act. You are going to make illegal people legal - without any much restrictions. How about kids of people who are waiting for their GCs (kids born in native country)? Don't you see any unfair treatment handed out to kids of legal immigrants.

    2. Why not give them legal status until age of 18 or 21, then they must prove their worth to economy by going to F1 visa , h1 visa & using available path to immigration?

    3. It is about re-uniting families - There are people struggling in legal immigration queue who want to unite with their families - parents - there is no provision in law or effort of making it possible.

This is all politics & I will never support it.

I'm sorry to hear this...Its happened...
if you really wanna bring your employer to lime light..prepare yourself..first....Remember..its your life here...anyone[including me) can give free suggestion here ....

There is no use working with this kind of Employer anymore...so my advice is switch to another employer[Good One] before you react to this...Make sure you pretend as if you are not aware of this and get the best out of him before you leave...once you r done...then show who is he to the outside world...

I'm sure you be having atleast mail proof...[If not ditch the plan of suing and move on with your next opportunity]....take some time and prepare all the possible proof...hire a good lawyer....File a case against the attorney in the local law chamber where the attorney is practising....they will definely call you to settle the case...make sure you record it as the proof[if you don't have one already ::)].....

Then hit the employer...make sure you ask a collosal sum through your attorney[Never give chances]....and then post his name and details in the Immigration blogs....

You lost one of the major milestone in your life...never give up this time....

    Best of luck

to get the receipts. Lets not bug them and have them work instead on receipting. With over 500K+ applications, it'd be a while to get the reciept..
oops did i mention EAD/AP..ur gonna have to wait a really long time on that one.

I guess Phone answering people job is to answer the phones(not receipting), correct me if I am wrong.

Here's your answer in the bulletin

EMPLOYMENT: Demand for numbers in the Employment Third Other Workers category, as well as the China and India Employment Second preference categories, has been escalating. No movement in those cut-off dates will be possible until the current level of demand subsides.

I hope it doesn't retrogress in future.

I still don't understand why is EB-2 not moving forward especially that EB-1 is current.

we have over 25000 members and it has been 2 weeks but we are still waiting to reach 300 :-(

    I don't get it!!
~300 people came forward to raise $30000 in one week.
Not even 100 people voted that they have sent their letters? Something's not right.

this sounds more like, "Ok so you say the glass is half full, why is that great now?"

It is a feel good factor; you still want to be cynical, go right ahead, no one can take that away from you.

Yeah I get that the money will be transferred from the Social security system here to the Indian Govt system.
My point is it does not do a damn thing for us workers personally. That money will dissapear into a dark hole in the Indian Gov't coffers instead of a dark hole here, further as the rules stand, I have a slim chance of getting the money from here through social security payments when I turn 65 even if I am in India. Try that within the money in Indian gov't hands.
On the other hand, it makes the Indian gov't allign with corporate america, as they all have a vested interest in a Temp. worker program such as H1b absent green cards. Which will be a win win for all concerned except us.
So I repeat my question..................Why is this good again?

My spouse is landing here on Aug 15. That leaves only one day to get medicals done. Any suggestions on how to handle this ? Can she skip skin test and take X-rays directly ?

If you talk to your medical office in advance to see that if they can give report in one day then it could be possible. Also you may consider your wife to get all vaccination in advance from the place where she is staying currently. Can't she prepone her trip by 1-2 days?

This is not the case for me....but during a discussion with my attorney and other friends contacts they said if you do not attach the medicals now you may get RFE at a later stage...which you can resolve it.

I bet any RFE can be articulated with reason by attorney if they are smart enough.

This is something I heard...but do not hold me on that. Please check with your attorney too and make a decesion.

    Longq,

Are these info are based on good guess? If not, can you provide us some link, or attach jpg with highlighting relevent facts.

    From November 2005 Visa Bulletin
HOW IS THE EMPLOYMENT-BASED PER-COUNTRY LIMIT CALCULATED?

Section 201 of the INA sets an annual minimum Family-sponsored preference limit of 226,000, while the worldwide annual level for Employment-based preference immigrants is at least 140,000. Section 202 sets the per-country limit for preference immigrants at 7% of the total annual Family-sponsored and Employment-based preference limits, i.e. a minimum of 25,620.

    * The annual per-country limitation of 7% is a cap, meaning visa issuances to any single country may not exceed this figure. This limitation is not a quota to which any particular country is entitled, however. The per-country limitation serves to avoid monopolization of virtually all the visa numbers by applicants from only a few countries.
    * In recent years, the application of the rules outlined in AC21 has allowed countries such as China mainland born, India, and the Philippines to utilize large amounts of employment numbers which would have otherwise gone unused.
    * During FY due to anticipated heavy demand, the AC21 provisions are not expected to apply, and the amount of Employment numbers available to any single country will be subject to the 7% cap. It is anticipated that the addition of unused FY-2005 Family numbers and the remaining AC21 numbers to the 140,000 annual minimum will result in an FY-2006 annual Employment limit of 152,000. This will mean an Employment per-country limit for FY-2006 of approximately 10,650.
    * To illustrate the effect of the reduced per-county limitation during FY-2006 on the oversubscribed countries, it should be noted that during FY-2005 India used approximately 47,175 Employment numbers.

Just imagine what will happen to the market flooded with EADs. Job market for H1Bs will totally be down. No US companies will hire H1Bs if they get somebody with an EAD. Tonnes of Junior developers and S/W testers will in the market driving the billing rates down even further. It's better to pack up and leave. I have heard from one of the forums here that an estimated 500K people will file this month since all PDs are current. EB-3 mexico + phillipines togther alone will be close to 300K. God help the Job market.

Also minimum wait time will be 500K/140K ~ 4 yrs before they get to process your GC. Add to that the time for namecheck backlog 2+ yrs. So total 6+ yrs before getting GC........

    lotr
