    I applied for H1B extension in October 2006 as my H1B was about to expire in December. After five months of applying, got an RFE in February 2007 . My employer replied to the query in Mid March 2007. My employer was reluctant to do a premium processing when he replied the query, saying that he doesn't want to take any risk. CSC transfered my case to Seattle, WA field office ( the field office is no where near my employers physical location, not even close to where I live) on April 4th. I guessed that its because of new H1 petitions filed in April. Its been more than 3 months and no action taken on my petition. We tried to convert into premium processing, but the field office rejected it saying they don't accept premium processing in their jurisdiction. So nothing else to do but to wait wait wait. Total time passed since my initial petition in October ( 9 months).

    My license has expired in March and the DMV do not renew my license with out a new I-94. Really its been a hell with out DL and still depending on others for necessary needs.

    I am tired of telling the story to every one. Why not one more time here. I want to find out what other steps I can take to expedite the H1 Petition. Is there any way around to get the license renewed. Please share your experiences and suggestions.

    My wife applied for H1B(new) in APRIL and her petition got an RFE asking to show proof that whether she will be in legal status until October 2007 as her I-94 expired in December(as her H4 petition is also pending due to RFE on my H1B). Attached the receipts and everything when she applied. From the documents attached cant they figure out that H4 petition is pending and she is in legal status. Kinda pissed me off.

    I took an info pass appointment and went to the Newark Office today to see if they can help with my case. The IO said, they don't deal with H1B cases and cant help me in anyway. Though she took time to see where it is. She told me that I have to wait wait wait. This is really pissing me off, without a driving license for the last 4 months, passport expiring soon, Wife's H1 petition Query ( as her H4 renewal is in hold due to my H1B RFE). Guys please post some ideas on how to deal with this situation. I even opened a service request about my case. But no progress. what should be my next course of action to move the case.

    About your Wife's H1, you should reply with the details of her pending H4 extension and she is in legal status.

    Thanks Paskal, I fully understand now with the example of the Scarlett Letter. I need to get busy and get another waiver then. Maybe I wasnt very clear on my first post about my stauts. I had had only a first J1 from 2002 to 2005. I wanted to stay so I got a waiver that time, and I tried to get a H1B, but I couldnt get it due to expired documents that I could not get renew from my country so my H1B was denied. Now some years later I decide to come back and the only fast way to come was with another visa J1. So as you explained I need to get my case number and start my process all over again. ONce I get the waiver I will look for a new sponsor and star the H1B process all over again. I cant be very open about this because if my present sponsor realizes that I am doing waiver and everything else I may loose my J1 because I signed a contrat to work for them for 3 years and then go back home. I think it is very unfair, but that is how things work around here.

    I am in a similar situation. My lawyer prepared the following letter which seems much simpler than what you had mentioned. I hope, its helpful. However, my company HR is not willing to even sign on this one. they omitted the word 'permanent' and also, removed the last sentence mentioning that i will continue as full time employee after receiving the green card. I regret joining a big company now. But, we are where we are and have to deal with it.

    I too received EVL RFE...however, my lawyer created the letter w/o any reference to AC21...except saying that my duties remains more than X ( > 50 or more)% same as compared to one filed in I-140 application and salary remains above required level.

    I had discuss this with HR before joining new position...they had no problem with it.

    I am a typical EB worker and have all the insecurities of a person working on EAD/H1 in a distant land. Though gainfully employed seeing job losses all around makes me anxious. There is no back up if i lose my job as being on EAD/H1 does not give me any unemployment benefit, no breathing period though i have dutifully paid SS taxes without a break for last several years. With stock market tanking i dread seeing my 401K statement. Selling my House to move somewhere else might be very difficult, if not impossible.

    Any setback on GC would hit me both financially ( money to spend on MTR, pay pricey lawyers , looks for not so cheap health insurance, and biggest of all loose the steady pay check )
    as well as mentally ( to look for a new job, worry about same/similar classification, move to new place, unable to service my mortgage , put up with not so pleasant working conditions etc ).
    I am away from friends and family so no physiological support when needed.

    But at least they are getting GC in 6 months. I dont mind getting paid low if it means getting GC in 6 months. Anyways half our money goes in getting h1 extensions and paying lawyers so might as well get it over with by getting paid low. It is so disheartening to know how people are abusing the law and getting GC the short cut way while our stuggle starts with getting admission to f1 to doing our masters to trying to get h1 and then GC.
    I have a friend who has done his MS from a top school here and his wife is a dentist but cant work for last 5 years and here is a guy whose education is a BCom and his wife's too and both are working and have got the whole thing the easy way out. Very disheartening.
    people are not abusing the law, the fact is law it self is screwed up, it does not have a rational way of distingushing geneuine pople from abusers.
    hence everybody pays the price. it needs a major overhaul not just increasing numbers of H1B or GC's but lot of enforcement measures are also required to make it effective. I see people have been waiting 8 years with the same employer just for the GC, I think a wait of 4 to 5 years should be good enough to demonstrate that a guy has a permanent job, on the other hand if the wait is to short then people will by just buy the green card by paying to companies , which what we see with labor substitution.

    I am working on contract for financial Inst. in Delaware.
    We are slapped with 15% rate cut for contract extension.
    Not sure if Vendors are playing with economy situation or companies are really reducing rates.

    My PD is 10/04. My I 485 was received on 7/2/07 in TSC. I am the primary applicant and my case was transfered to NSC in 8/07 while the I485 of my spouse remained with TSC. I have no LUD on my case since 11/07 but her case was transfered to NBC for standard interview. She lives in a deifferent state as she is studying and I thought that may be they want to make sure that we are married (as has been with many other cases). I was hoping that may be they will also send my case for interview as is usual for other people but having our cases in 2 different service centers has made it complicated. Will wait and see.

    How do Promotions impact one's existing GC application?

    for example: one filed for the GC as a Software Engineer, 5 years down the road one switches to a different company in the same area/location using EAD (avoiding AC21 for now) and the salary is 30 % higher than that was mentioned on one's LC filing and the job title is sr software engineer (same or similar responsibilities, senior title). How would something like this impact one's GC application?

    I also wonder what would happen to the GC application if one was to get another promotion and become a manager with even a higher salary (some job responsibilities stay the same and some new managerial responsibilites get added).

    I am sure many of us would have faced this since clearly many of us have been waiting for many many years - I would really appreciate your input on this. Thanks!

    Another example, of an excellent quality "formatted letter" . Notice how the politician is ,while being non-involved, looking sympathetic to your issues. Notice the open ending, suggesting non-committed view "will consider your views". This leaves room to navigate the press. Not only this, the brilliance of this letter lies in, easily blaming the other party, for having failed you.

    A bill can be intiated by any member, irrespective of the party. If they are committed to your cause, it only takes a few moments to introduce a bill.





    I got this Reply from Zoe Lofgren, offcourse this reply was in December 2006 when Republicans were controlling the Congress.

    She cannot change to H1 until Oct 1 which is when the new quota of H1's will be available unless she is going to work for an exempt organization/company. In the latter case then she can apply directly now for H1 as long as she is still maintaining H4 status.

    ofcourse she cannot change her status until oct 1st. How ever the sluice gates for the new h1 quota open on Apr 1st and will be gone in days. My question is Does she need her H4 approved to have her prospective employer file the I 129? (or) Can she just provide the notice of action she received for her H4 extension filing to show that she is maintaining status?
