    It is getting clear now why Legal Backlogs are not touched in this present Bill.
    Because Home Land Security Dep budgets depend on them..If backlogs are gone .. Budget is gone ...

    So our backlogged cases will not get relief ..Looks like this will remain unfair reality

    This is so outrageous! :mad:

    What can legals do then to change the situation? :confused:

    DA knows that for them to win the case, they need your wife's statement on their side. And for you to win the case your wife will have to testify under oath. The attorneys are prepared on both sides to argue this case and examine and cross examine the case. Make sure you have a really really good attorney.

    I hope you are telling the truth. If not why she didnt tell the police or you didnt tell police the real reason. Now the onus is on your wife to contact the police and DA and let them know the truth.

    Also we cannot deny that Corporations also reason for putting the h1b restrictions. Why Indian consulting companies applying thousands of H1b in one day? I doubt usage of number h1bs are atleast 50% They were also wasting lot of h1bs just by applying and staying in India waiting for Job opportunity materialise but here many companies could not get persons for many projects. Some solution is needed for this issue for proper utilization of H1bs. Corporations could have suggested some solution for this if they are really responsible.

    According to lot of estimates 100k new jobs are created and if we include retiring people and rotating people real new requirement will be 150k persons including H1b and L1. H1b numbers(115-180K) in the Senate bill are fine according to Industry estimates if industry is just using for new jobs and vacancies of old jobs without replacing current workers. It is too much restrictive in the bill but someone has to suggest alternative solution for the current problems. If they just remove the restrictions when they open new H1b cap will be reached within few days again corporations lobby for more H1bs.

    I'm surprised that everybody in this thread got so scared of the language in a stupid bill and stopped thinking how clever Indians are in finding loopholes. I hate when all the extra-ordinary people think in the same direction. To start with, is it possible that these jokers will pass anything agaist the will of big techs like microsoft, intel, csco, think again? even if they did to make average(stupid) Joe happy, they wil keep loopholes making the law irrelevent. e.g. H1 quota limited but L1 unlimited. businesses more than 50 emps can not have more than 50% H1Bs, what do u think big desi consulting cos are in trouble? they will simply 10 more companies each having 49 people.

    Other direction: when i came to US in '99 from SEEPZ, my US salary(in Rupees) was 12 times my indian salary, now it's just 2 times. Indian salaries are increasing 10-20% every year, and Dollar is going down (down 20% in 6 years, 40% including indian inflation), very soon there will be no advantage in coming over here, and you are worrying about future H1s having trouble getting GC?

    No matter how stupid and selfish politician look/sound they always think about their contries future, and folks these are US politicians. take it easy and take a walk outside, it's nice out there.

    65 pending cases for 2004 here. Even if we multiply by 10 - 650 cases?. Fair deal?

    I have also been wondering how to extrapolate this to total numbers. Its probably a good reprsentation of spread. (ie. 1% is 2003 and earlier, 20% are in 2004). but actual numbers???
    if you choose to multiply 2004 by 10, we should also multiply the total votes (300) and assume that wehave only 3000 pending485 applications... that does not seem right. More like x75 or x100 based on whatever we have been hearing...

    Note that in some cases this is just one person who responded to the poll in a family of 2 or 3. Their PDs are the same (most probably) but the count of cases would need to be adjusted.

    Called USCIS on friday and asked them to expedite since i can lose by job. current ead expires on sept 5 th and filed renewal on june 24th. I see so many cases getting approved with much later dates.
    Any sugestions on what steps to follow?
    my company won't let me work even 1 day after ead expiration

    Another important question is: Will USCIS allow AC21 without an approved EAD?
    When you send all the relevant documents to invoke AC21, there is every possibility for the officer to check whether you have an approved EAD or not. In that case there might be a problem. I may not be correct. But to switch to a new employer, you definitely need a EAD card. I switched employers. My new employer asked for work permit(EAD in this case)

    Note : Please check with your attorney, I'm just one like you and this is my experience

    There are two things in play here.. first of all don't worry about the insurance since you can get covered under Cobra.

    Secondly I think what your employer did was obviously illegal. It looks like you have been made a target for layoff due to your maternity leave coming up. I am quite sure that I have read about this at couple of places that it is unlawful to do so . I will try searching for it and you also go through your company's employee booklet. There are laws for protection in this kind of situation to protect the employee ( the employee can't be terminated while on maternity leave , disability leave etc ). Search for it and maybe you can come up with something.

    You have worked hard for six years .. no reason to stand for the discrimination.

    How did you know that your case was assigned to an officer. I called uscis three times and I was told that they could not say if my case was assigned to an officer or not.
    some time back when I had called I was told it was assigned to
    an officer (PD not current though). What does that mean?

    my pd is march 07. my agency told me they converted my I 140 into premium on june 18.But my case status still hasn changed from 'RECIEVED N PENDING". Is there any delay by the uscis usually in changing the status?
    Can somebody please clarify?

    My RFE response to the I-140 PP was sent on June 7th but I have received anything from USCIS. Status on theor wesite is still old. Its almost 3 weeks after I sent the response to the RFE. I am not sure what is going on w/ USCIS these days. They have taken money to process it in premium but it seems they don't bother to complete case in 15 working days anymore.

    You will also see "Approval notice sent". It means the card is on the way to your mailbox.

    I feel for all of you whose EAD is not yet receive. When my EAD was pending for more than 90 days, I wrote an email to the Ombudsman. I don't know if it helped or not. I just got RFE notice 4 days after sending the email. After replying to the RFE (photos), I got my EAD with no problems.
    When does the "Approval notice sent" status appear, it is about 7 days since I got the production ordered.

    dougjones, it took you 2 yrs to reply for a thread in 2007? You seem many light-years away from all the issues that are faced by EB professionals.

    Listening to EB folks is a win-win situation for both this country and the professionals. May be more win situation for the country than professionals.

    If using civilized, peaceful, democratic way of asking for right things is crying, then yes, I am a cry-baby because it is better to be such a cry-baby than anti-immigrant, nativist abusers on various forums.

    I am also in PA and my DL(driving licence) will expire in last of September month and my H1b extension is still pending at California Center . Can i get DL renewed from PENNDOT on the basis of Receipt Notice of H1b Extension and a letter from employer ?
