    Hi All,

    I am on H1B from 1998, 12th year and counting.

    I applied for my labour 2 times but unfortunately because of different reasons those labor processings could not continue. 3rd time I could use a substitute labor (priority date Oct 2003) which is an EB3 labor certificate in 2005. I applied for I-140 and got approved in 2005.

    I applied for I-485 in July 2007 when USCIS opened the gates. My 485 is pending. I got EAD. I am still continuing my H1B status with my new employer.

    I am not working for the company that processed my GC. Recently I got an RFE like everyone else about my current employment and responded with the support of my current employer.

    I think that the dates for EB3 will not move any further in any near future.
    My question is, can I in any way convert my case from EB3 to EB2. If yes, what would be the process.

    Please advice.

    Unfortunately there is no direct way to convert. You may try to find new job with EB2 requirement or try in your company itself if the they have any job opening different from your current job (requirement). You need to start from the PERM and use the PD. Thats the only way. I am not sure if you can do this as your's is substitude.

    I got mmy EAD for both of us, and AP Approved and received on 09/20.

    EAD is like plate meals. GC is like full meals.:D
    Full meals is not recommended by any doctor, plate meal is the best way to be healthy :)
    So in other words GC will make you lazy and EAD keeps you working hard.

    Friends , I was enquiring about Connecticut , but I am pleased to know about all the states.

    beppenyc , Do you get your license till I-94 date or beyond it in NYC. Also my wife has the international driving permit , will that help?


    Also will it be good idea to collect this info and publish it so that all of us know the rules and regulations of each state , this will help people immensely in situtaions like I am in ?
    There are no hassles for DL renewal in CT. you will be ok.

    Hi:

    I got a email and case status changed on my wife and my I485 to 'Notice mailed to new perman..."

    Is this is a legit approval? My PD was current under the Nov but is not under the Dec. When does Dec become effective?

    Hopefully there are some legislative changes so everyone gets some much deserved relief

    PD: EB2 - July 2003/India
    I140 - approved in TSC - Dec 2006
    485 mailed - July 2 07
    Notice date - Aug 15th
    Got EAD - Aug 23
    FP: Setp 14 07
    Oct - AP
    485 Approval email/case status change - 11/21

    Congrates, you are one lucky one. Dec Visa Belletin is effective Dec 1st only. Nov VB is good till this month end. Have a happy happy thanksgiving with no tension.

    Guys pls stop taking useless info pass appointments. People like me who have not received EAD and may loose the job are not able to get infopass appointments because of all the people taking appt to know the 485 status. Pls understand......

    Most people taking infopass are having serious matter to talk. If you suggest not taking infopass after 92 days and get to know of EAD status is alright, I donot agree. How can it delay your 'urgent/emergency' appointment. AOS issue comes in between btw.

    Thanks in advance for your replies

    Once you have started using EAD your H4 status is invalid. There is no process to notify this to USCIS. So, USCIS would not know when you changed from H4 to EAD. However, if they audit your case, they can easily find out about it....that's a different story.

    I don't understand why you want to enter on H4 status and work on EAD as soon as you enter US...thereby invalidating the H4, since you are not complying with h4 status.

    Help!!

    Is any company filing new PERM applications in this economy? I was told that my current company (a really big one at that) is holding off PERMs indefinitely because we had some layoffs- indefinitely!

    My H1 runs out in Oct 2010, and I heard that I have only till end of Nov 2009 (including what I found out is called recapture time) to file.

    Now, I found out that my company have do newspaper/online ads for positions to demonstate that they tested the labor market etc etc (all stuff that I heard from the attorney), and I got the impression that she has no idea when they are going to do this and start filing again, and I got something like a best of luck look from her. I am freaked out now.

    Any of you out there know if any companies are still filing PERMs? I am on a EB-2 in Software.

    Also, if I join a new company, can I file a PERM immediately? Or is it just best of luck to me?

    Looks like I have to look into a Canada visa / Australian or UK visa or better go back and spend sometime in India. Any thoughts from any of you more enterprising folks out there? I have little knowledge of the process (my fault!) but I am stressed and freaked now.

    You probably need to find another employer. Big companies will pull back the perm when they start layoffs. I had this experience during the dotcom crash. It took my company 3 years before they started doing the GC again.

    Stop questioning EB2 or EB3, they both represent EB community. Yes you maybe right about people thinking about EB2 faster thatn EB3,

    But have you followed the bulletin lately?

    And the ways things are going, do you really think EB 2 will clear fast and then EB3 will gain a faster movement?

    Golden Answer? NO

    Whether you like it or not, we need each other, the impact is always greater when the intensity applied to it is greater.


    You can keep thinking about how hollow you and I are, but the fact is we both need each other. Everyone see's us as EB community, not as EB2 or EB3,

    Most of those Morons don't even understand the difference between H1b and green cards,


    So get yourself to think EB community as a whole, not EB2 or EB3, or who benefits first?

    So, is that a yes on getting USCIS to follow the law? As I said, it is about getting USCIS to follow the law, it is not EB2/EB3 centric. Given that the demand for Eb3/EB2 that is going to see-saw, this should be an action item that will benefit EB on a whole, not a particular sub category.

    Wouldn't the OP and his wife need some kind of visa to live in India until he figures "out a way to bring her on here on student visa or something"? I did not realize India was such an easy transit country especially for people of non-Indian origin.

    If you are working on H1, #2 is not an option. You will be violating immigration laws by accepting payment from unauthorized sources by doing so.

    Let's say if I am on the green card (EAD) , then still I can not evade this tax situation correct ?I mean if they pay me and I pay to the company in India who is really responsible for the service.

    I am in the same situation. i got approval notice on sep 1st but no cards...........

    My 485 Case status is like this

    Your Case Status: Card/ Document Production

    On September 3, 2010 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service at 1-800-375-5283.

    It is almost 45 days??NO FP and nothing happened so far? can anybody in the same situation. please update your status it helps a lot for me.

    Doctors have played a pivotal role in the last few days in getting things done for us.

    Ethnic diversity is desirable but not always easy to achieve and if the organization can achieve its goals with groups without ethnic diversity, what's the harm? After all, we are here to achieve the goals and diversity is not the only way that can be achieved.

    So please be thankful to Doctors of AAPI who have much bigger and powerful organization AAPI - both in terms of money and clout - and have decided to endorse our effort and help us.

    I would kindly request folks to be careful when posting comments as we dont want to neglect or even appear to neglect our supporters.

    By the way, we have tried to get a couple of best selling authors on the competitiveness topics but we could not get them to come on the advisory board. We did get endorsements from two of them though - Richard Florida and David Heenan.

    FIRST OFF: Using slang or whatever will NOT hinder you from getting a job in the design field. I love how people who most likely havent worked more than a week at a REAL design studio think they now how the whole system works.

    I will tell you all right now, IF your work is good and IF you can show your employer (most likely a smaller company if it'll be your first job) that you can get the job done, he's not going to care if you use the words "dawg" or "aight".

    I'll provide two THREE examples of this.


    1. I was the Art Director for a small, South Florida based web company called Citracom. We needed a flash developer who was GOOD and wasn't expensive. So we interviewed some people. One fellow by the name of Trevor (whom was & still is pretty darn good at flash) had the whole slang talk thing. But he got the job. He did it well.

    2. I worked as a Graphic Designer in the marketing department of a fitness company. We worked on some pretty large clients like Kathy Smith and Prevention magazine. There was a guy who was a little younger than me who did all of our tech support as well as graphics. The kid was great. Yet he listended to rap, said "yo" and to top it off his favorite greeting was "What Up?".

    3. And the final example is ME. I got my first web design job when I was in 11th grade. I interned for a company for $8.50 an hour doing HTML and layouts in Photoshop as well as making buttons. I used "slang" and I was young (16 1/2 I believe) and from there I've gone on to work at some pretty decent jobs. In fact this month makes it FIVE years since I started designing for a professional company.


    If you guys ever need any tips on picking up a design job, let me know. I'll be glad to help you out.

    btw.. i just started meditating today.. really works.

    i guess analyzing these incidents is better than calling uscis.. which i am totally itching to do this week (one per week .. within my quota).

    You did not earn red mark...my comments were more on humane side to not worry too much about anything.
    You are right, we need to be cautious, lest things go wrong and feel sorry later. You (IV) all are doing great work. I love this site.

    I fully agree with you we all are frustrated with this mess, but my idea is...For many things as many can go wrong....there will be equal if not more things turning right.



    Off topic...here is a question for you, how does one becomes a member from junior member and so forth.
