I highly doubt they pull up state criminal record at POE.
If its a federal crime, then i can believe that.
You want to bet with me on this.. I am not wrong here. Why would I scare someone..Even if this is Misdemeanor or felony charges irrespective of wheather this is state or federal it is one's record and every officer at POE has an access to this record.

Please note that the Form I140 is no longer valid for porting purpose under section 106� of AC21 if the I140 was revoked due to the fact that you did not meet the minimum requirements for the labor certificate at the time of filing. Due to the fact that beneficiary of the For I140 was found to be �unqualified� at the time of filing you are not eligible for relied under section 106� of AC21.

I hope 180 days had passed after 140 approval. A little more detail on the case will be appreciated. Was it a case of substituted labor?

I will be on EAD for the new job..and the LOA is vacation without pay. My salary is already 30% more than the one mentioned in labor but no promotions..new job has actually lower salary and job description similar.

2 year back my I-140 got rejected due to same reason 3+2 degree. I have 3 years Bsc in Computer science and 2 years Master of Computer Mgmt. They raise the question on 3 year Bachealor dagree. My lawyer send the reply along with degree evaluation and we try to say my 3+2 equal to 4+2 of USA and USCIS didn't buy this argument. after that lawyer told me that no hope in MTR or appeal. So we file again in Eb3.
Now i see based on your reply if have taken this approach in appeal then i might have got approval in appeal.
uscis works in funny ways (as we all know). As I stated in earlier post one case in nebraska i know got rejected and they stated that the appeals decision wasn't precedent. The texas cases received rfe's but got approved based on the decision.
Just yesterday, I received 140 denial from texas where they didn't even discuss the decision and just picked on that bachelors was three year degree.

I am very depressed! my lawyer who is doing my I-485 has advised that if she was to be concerned with her representing me, she would advise against me starting the company. basically, she said, USCIS can read this as an intent to leave the permanent employer for self employment. my business plan was to be in non-IT business. she said that if i am making enough money in the business, it will be hard to prove that i intend to continue in the job while having this business on the side...

DA is accuser, for DV case, it is normal as sometime spouse would change mind and support the defendant finally.
Negative:
1. Neighbor call the police as they hear screaming from our apartment. It demonstrates something happen.
2. I said "annoyed" and "drag" in my statement from police derivational question. And police add one "push to chair", definitely it is illusive, I only said my wife want that computer, then I move her to study room, as chair is there.
3. One neigbour claimed she saw "I kept my hand on my wife mouth" As my wife continue screaming over 10 seconds, I tried to comfort her, but I even not sure my hands touch her mouth or not. If so, it is very lightly, I think you can understand that scenario, that is kind of instinct. And for that statement, the police even question, as the distance is so long and light not good, how that witness can see what's happen.
Positive:
1. My wife said kidding around at very beginning, she does not change her words. She questioned why police will arrest me when informed? We are put in different area when cop enter.
2. No mark, no injury. My wife said so and cop also check and find nothing.
That's all I found in the police report.

1. The real reason for my wife screaming is pee on pants. that's for embarrassment.
2. The whole story is, I used computer, my wife want that for MSN chatting. She tried to disturb me several times, finally I leave the room for her and go to living room. But she did not stop, follow me and jump on me. I knew she is just kidding, my wife sometimes is like a kid. But my finger nail is hit by her at that playaround, sure not intentionally. So I hold her arm, just stop her kidding more. (that's the reason I said annoy, but definitely not mad or anger something), and then walk her to study room. (there I used "drag") In the hall way, even not enter study room, just at the entrance. My wife scream suddenly and very loudly. She is neat freak. Then I release her immediately and ask her what happen, anywhere hit? She just continue screaming. I continued comfort and calm her but no result. After about 10 seconds, I am worried it would impact neighborhood, so someone see my hand on her mouth. Then we heard several very loud shout from neighbours, just like "Stop screaming right now!". Then my wife stopped. After 10 mins, cop come.
That's 100% truth happen on that day.

I just do not get who is the plaintiff (accuser) in your DV case if your wife is on your side? Do you have a copy of the complaint filed in court? You can PM me details, if you want to. To me it looks like there is no ground for any case against you if your wife does not want to push it.

As of right now, YES. It is possible if you are in US. You submit the US birth certificate and that is the proof (Amendment 14) of your citizenship. If you are outside US, the process is slightly difficult that you have to convince the consulate/embassy.
Same is not true on the other side. Once you get US Passport, you have to do some "dramatic" actions to get your Indian passport back even if you are ready to renounce US Passport, because we follow rules (!!!) strictly.

Need your valuable advice on this serious issue. Involved in shoplifting case, got arrested and plead guilty. Served the community service, and paid fine. Got the �Court Disposition Document� which states that I am all clear. My status is I-485 pending and have EAD, AP documents.
1. Is it safe to travel to India and come back on AP?
2. What are the possible chances that visa officer may not let me into the USA?
3. Do I need to carry any letters from my criminal attorney explaining the situation?
4. Any one in similar situation, please update me on this?
5. Please list of documents I need to carry during my travel

To add to this point. This is AFTER the implosion of CIR on the Senate floor. CIR was supposed to be the reason issues around legal highly skilled immigration were deferred.
So, after deferral, implosion of CIR, we yet get a line clumping these two. It is almost like a nicotine addict trying to break the habit. Media can be so close minded.
All I can say is what IV has done to try to separate these two issues, is nothing short of herculean. Now atleast we are seeing some semblance of a separation. I think the Rally in DC was a highly significant moment in this regard. I am also pleasantly surprised to see as much attention given to the immigrant visa issue (ie green cards) as was to the rest of it. Previously highly skilled immigration was thought to be tantamount to H1b visas. The issue of permanent green cards was a footnote.
We have tried very hard to separate ourselves and not be a hostage of other issues. Now there is more awareness on the greencard issue being separate from H1B. There is also more awareness that Immigration problem is not just about Illegals. There are legal immigrants too in this country suffering.
Pls post letters to the editor. Last week we are able to get CNN correct their incorrect reporting of the rally due to effort from everyone on the forum.

How do you think the passage of the DREAM ACT could impact our situation ? If they pass this, they would allay a sizeable portion of illegal immigrants to get amnesty through their children (few millions). I am just wondering whether the illegal alien supporters would lose steam to support CIR after this ? Ironically, they would get a sizeable amnesty, overhelm USCIS with millions of applicants and probably make the passage of a CIR bill more distant. I can't think of something less advantageous to us than this. I hope I am totally wrong.
What do you guys think ?

Most also believe that the system needs to be changed for the better. But just how this should be accomplished is not so easily agreed upon, and so it is a hot-button issue. Many of the hardliners, who took a strong anti-immigration position, lost the recent elections. But there are some who took this stance and won. It also is widely believed that many of the newly elected Democrats expressed anti-immigrant sentiments in their campaigns. Achieving any strong pro-immigration measures may prove to be more daunting than originally was anticipated; certainly more than many hoped it would be. Needless to say, we can expect 2007 to mark the beginning of a time for change and flux in the arena of U.S. immigration law. There is a possibility the DREAM Act could be passed, allowing the children of undocumented immigrants (who complete their high school educations in the United States) to obtain conditional "green card" status if they enroll in college or join the U.S. armed services. Both the Democratic and Republican parties seem inclined to help children. There are individuals, however, who are not willing to give any benefits to children of undocumented immigrants. I just used bank billpay to send in a small contribution.. I will continue my support once the expenditure schedule is viewable by volunteers. The bank deducts the amount right away but I don't think they indicate whether the payee have actually cashed the check by the payment date. So could someone issue a receipt via email or forum private message? I included my forum id on the billpay. Thanks guys.
