    Do you work for a TV manufacturing company or watch lots of shows like a couch potato. I can understand you like to watch some channels but cannot imagine spending hours to make a quote

    You could buy a TV but you will not know when you will get it. It could be shipped the next week, the next month, next year or never.
    The credit card may not be charged, may be charged twice or a valid CC may get rejected.
    Somebody who buys a TV from USCSIS a 2 years after you do, he may get it sooner than you do.
    USCIS has no way of knowing how many TVs have been ordered and how many of them are in stock.
    In case you do not receive your TV in two years, USCIS acknowledges that there is a long wait time for some and does not do anything about it. USCIS thinks acknowledgment of wait time is more than enough that it has done for the customers. Customers did not deserve this but USCIS did a favour to them being a good "Customer Service" company
    There would be an online survey after you buy it which would never get submitted 99% of the times.
    In case it did get submitted, somebody will read one out of 10,000.
    After reading it he will throw it in the trash can.
    If you get a defective TV (which is quite likely), you have a chance to file appeal by paying the same amount of money for the TV again so that your case can be re-opened.
    I wonder how many customers would USCIS have eventually ??? Any guesses ??? :-)

    I think if Indian external affairs ministry understands that highly skilled Indian born citizens have to wait for 16 to 50 years where as even less skilled candidate gets away with green card in 6 months just because he was NOT born in India; they would at least protest in soft words.

    The only reason I want to still enter on H4 is that my H4 is stamped until 2010, hence why not use it and save money and hassle on AP entry. As you have said that working on EAD immediately invalidates the H4 status. This is OK for me, but at least I have avoided the AP procedure stuff. Plus the primary applicant is on H1 and hence we both can enter on H1 and H4 respectively rather than one entering on H1 and the other on AP. Let me know if this clears your doubt and if so, can you think this would work out. Also, if you can, please respond to my other questions

    There is no hassle when one enters on AP. You can continue to be on H1 and enter on H visa, and your wife can work on EAD and enter US using AP.

    For all the questions that you have posted, the simple logic to follow, is once you use EAD, your H4 is invalid. Once you travel abroad and want to re-enter with H4 status, you are basically stating that you are going to comply with the immigration rules pertaining to H4 status. And then after entering you want to use EAD, then it would invalidate H4.

    I suggest you consult a good immigration attorney.

    #1. Schools can have policies. For example, some schools don't allow higher education on H4 Visa.
    #2. As AOS pending based on spouse, one can engage in studies (full time or part time). Also, one can do job full time or part time (if EAD is applied for). As far as immegration (USCIS) is concerned, there should not be any problem
    #3. I am not sure, whether the school in question allows studies while AOS is pending. I think it does not, so they are asking to take Full Time F1.
    Usually people sitting on counter may not know entire detail. You may have to ask senior staff.

    I have been is situations, where INS explained me that Schools can have their own policies and that don't dictate it.

    Did she receive a paystub for the sick pay? I mean, did the employer or the third party insurance deduct federal, state taxes for the sick pay?
    If yes, then she is entitled to receive a corrected W2 from her ex-employer.

    BTW, haven�t heard about receiving sick pay from third party insurance, this is something new.

    My wife worked as a full time employee and resigned after the delivery from Oct'08. She was paid the sick pay through a third party insurance and these wages are missing in the W-2. I tried contacting her employer and also wrote emails saying I would complain to IRS if they fail to provide a corrected W2. Today is 02/14 and we still didn't receive a new W2 for the sick pay or a corrected W2.

    1) What consequences the employer would have to face if they fail to report correct wages on W2?
    2) Does IRS is concerned about missing wages that are 1-2K?
    3) Do you think I should complain to IRS?

    I am planning to lodge an official complaint on Monday 02/16. I suppose it was a deadline date for all employers to provide W2 or a corrected one.

    I am in a similar position and am going to wait till the end of the year for the AP. I am hoping to be able to go for the H1B stamping with the AP. So if there is any problem with the H1 I can atleast re-enter using the AP. Its a nice backup...

    I know that if you don't have H1 stamping you need AP to reenter. But if you have AP why do you need H1 stamping if you are working for the same H1 employer after reentery? Is H1 stamping a backup to AP?

    Lets not deligate things to others. What ever you feel will help IV and the problem of retrogression, just go ahead and do it and post a note here so as to encorage others to come with similar ideas.

    IV team, please consider the following:

    1. IV can post free ads in classifieds like sulekha, indiainfo, craigslist, free ad newspaper, etc.

    2. also IV can contact all indian/asian associations and Asian student association in US to place an free ad in their websites/magazine/email newsletter (some have annual magazine, some has monthly newsletter). tell them how IV helps its members in visa/gc related issues including free legal advise.

    3. IV can place free ad/info on notice boards in indian/pak/chinese restaurants, indian/pak/chinese groceries, temples, conference halls, etc...

    4. increase IV site listing in search engine results. any combination of keywords in gc or visa should bring IV site in top 10 like when searching any US visa (like H1/H4/H1B/F1/J1 etc.), gc related keywords (like I-485, PERM, labor, I-140, immigrant, FingerPrinting, etc). This can be achieved for a little money and this can be done by contacting yahoo/msn and other SEO (Search Engine Optimization) companies. Our members can help us in this regard.

    5. Send newsletter email to all IV members atleast ONCE a month and ask them to contact their friends/coworkers/their company employees to join IV.

    This newsletter will request members to contact indian/asian association in their local area for membership drive.

    Also request them to send feedback to improve IV and to increase publicity and membership.

    6. Create "Free Legal Advise for Employers/Schools Only", where employers/schools can send visa/gc related questions and attend conference call during this session. This is an addition to the current one which we have now (which is for open public).

    also request these employers to place IV information on notice board in all office branches, also ask them to request these employers to give IV information in welcome package. same for colleges we can contact international student counsellor or concerned persons to give IV information in information package to foreign students who join their college.

    7. Create an email like "employerslist@immigrationvoice.org" and mention this in contactus page. Every month newsletter will rquest IV members to send "employers name/address/phone and contact person name/email" to this email so that we can keep the employer information private. Ask them whether IV can use their name to contact them.

    This employer should hire foreign graduates, or who sponsors H1B or GC even J1/Business visa etc... in this way, if we collect their names/contact info, we can contact them and request them to place or send email to their employees about IV. They might refuse but we convince saying that IV is providing "free legal counsel for Visa/GC" for both Employers/Employees where they can opinion about their visa/gc related questions and explain how IV helps in getting rid of GC backlogs and advocates H1 increase etc....

    8. Create "Contact Us" page with a form inaddition to what we have.

    following fields like: from, category, subject, how they heard about us, comments/feedback. This category can be general, questions for free legal advise, feedback, etc.

    how they heard about us: give options like IV member/search engine/college/employer/friend/family/association, other etc., if they choose others, they have to tell what it is, this will help us to concentrate on marketing in the area through which we received more membership.

    9. Not sure how this is done but check. Do email marketing from hotmail/yahoo, etc. most people give for less than 50$ for 1000 emails, get list of emails specific to people who has occupation in IT who are in US and send email to them.

    10. Consider this after trying above options: pay-per-click(PPC)/Adsense (google). for this, we need to spend some money, but some companies are giving 50$ for new customers, after that they will charge us. we can bid very low for PPC.


    Thanks everyone for being patient and supporting us. The work is happening at all ends and it is an uphill task.

    We really need to increase our membership. Higher membership will mean us looking tall when we meet lawmakers. Please all try to help us spread the word of IV to everyone you know that is stuck in retrogression. We represent at least half million people but we currently not even have 6 thousand members. Thus we have to bring lot many people into IV. I would encourage everyone to pls. register on this forum instead of being visitors.

    Pls try to help us increase our membership in your own capacity, in any way you can. This is something everyone on this forum can help us.

    This reminds me of frog mentality to pull someone else down on some pretext or the other.

    What is the definition of "fairness"? Just because my application is waiting to be attended by an adjudicator and others are getting approved doesn't mean that I need to cry out foul. And if we do care for "fairness", whatever "fairness" means to us, then what are we doing, as a group, to seek fairness. I hope you agree that just by posting 3 messages per day on this forum and labeling system "unfair" "broken" etc, system is not expected to start working in a fair way. If you look at the thread to call lawmakers, there are hardly 30-35 people who actually called the lawmakers office. I am not telling you to call or do anything other than helping to make the system "fair".

    My employer has always provided me the receipt numbers. I'm talking about the physical receipt notice which I might need just in case i need to invoke AC21.


    I am sure you(we) can use Freedom of information act to get reciepts. If you know that reciepts were issued and your employer is hiding

    yes finger printing is not required, mine was issued recetly without FP. You can take a chance and send the photos. At the most they will ask for it again.
