    Forget Identity theft. What about you bank statement showing balance, your W2, other value of assets, your children ages with pictures along with your FULL RESIDENTIAL ADDRESS / WORk ADDRESS / PHONE goes to an unknown source.

    Most important information about you which can lead to a crime against you.

    Its a scary situation.

    So yes my concern would be personal / family safety more that barely credit history which can only do financial harm.

    Are H1 is Really in a speciality Occupation?
    When we apply 1st time they are asking all the documents which is fine.
    When we apply Extension they are asking all the details with Paystubs,client letter.
    When we apply Transfer they are asking all the details with Paystubs.

    1. Read this pdf. http://www.uscis.gov/files/article/E1eng.pdf This should answer your questions on H-1B
    2. Documents are needed to demonstrate that offered job is of specialty occupation and the beneficiary meets job qualification. It also has checks for employer who is offering H-1B job.
    3. Pay stubs are needed so as to prove that beneficiary is maintaining valid H-1B status when another H-1B petition is filed.
    4. Client Letter is needed so that Employer (petitioner) can demonstrate that the proffered position qualifies as a specialty occupation, or that the petitioner has complied with the terms and conditions of the LCA.

    H-1B is not for any job. The job must meet requirements for H-1B. Read the pdf mentioned above.

    I am sorry that you feel like sl***, but you do have option of changing the job if you don't like current job and you feel like s****.

    I agree this is not easy, but in past IV CORE was successful when they convinced CIS to come out with revised visa bulletin in July 2007. Other successes include 2 year EAD and 29 months OPT etc. If we all support, this may also be possible. Atleast having an official procedure and forms for AC21 will be really good.

    well, as most replies say, having an official procedure would greatly benefit particularly important due to recent spate of I485 denials in AC21 cases (http://immigrationvoice.org/forum/showthread.php?t=22182). Can we include demand for an official form (preferably with some token fees) for AC21?

    There were about 600,000 AOS applications including the July and August filers. So that number less 60,000...roughly about 540,000 applications still pending with USCIS....

    And 540000 @ 140000 per year is approx. 4 years!

    Going by PD, 2001-2003 may get their GC by Dec 2008

    PD 2003-2005 by March 2010

    PD 2005-2007 by Sep 2011

    Again, my assumption is even distribution which is not a reality. Every year, last quarter would be busy as USCIS would try to use up all the VISA numbers for FY and during that period it could be open for all atleast for 3-4 years; like June 2008 they may make it current for PD 2005 and June 2009 for PD 2007 .... And, come October dates would retrogress.

    Hi Guys please help me

    Yesterday i got my receipt i check the status online the status is saying

    Receipt Number: LINXXXXXXXX
    Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
    Current Status: Fingerprint fee rejected and notice mailed; case in suspense.
    On August 21, 2007, we rejected your fingerprint fee and mailed you instructions for how to submit the necessary payment. This case is now in suspense.
    Please submit your payment with our notice as soon as possible after you receive our notice so we may resume processing of this case.


    But USCIS cashed my checks i didn't know what went worng the total amount i paid is 325+70,170,180.

    Did any guys get same kind of problem?

    Call USCIS on Monday and tell them that they cashed the checks. They should be able to correct the status.

    The name check takes 2 years anyway, making a mockery of fast processing times. Even VSC, which is the slowest, takes less than 2 yrs for 485.

    Wait a minute; I thought the name check is part of the I485 approval (and for those who file I-140 and I-485 concurrently, part of the I-140 approval). It wouldn't make any sense if the I-485 is approved and they are still checking the identity.

    Also, the thread has been quiet due to lack of hope regarding the speed of processing centers (Wata, I am with you on the Nebraska one) and the unreliability of promises for improvements.

    The pattern of RFE's on AP's are from those cases applied at NSC >> CSC issued Receipts/EAD/AP >> 485 back to NSC.

    StuckInRetro - I believe you may be correct. My scenario fits into the case you have mentioned. May be you can add condition stating people who made lot of trips in and out of US. I have made close to 9 - 10 trips...

    my employment is terminated a month ago. I still need to file h1 transfer to the GC sponser. I am single

    I am told that H1 can be transferred only with in 10 days-20 days or so. which means that it is already a month. so in case if I dont get the h1 or if I have an issue in the H1 transfer, is that the end of my being H1.

    If I were to be on H1 again is it going to come under the cap along with those new H1 filers? I still have one and half years to complete 6 years.

    I have a fall back to EAD though based an approved 140 and 180 days past 485.

    But how do I get the spouse then???
    by relocating back to yr country or by having a long distance marriage or marrying a gc holder or h1 etc .. it is a tough choice for you ..

    If you are talking about the discussion. then am referring to the items and not the discussions.Have I missed these items some where that are like the above. Then we are good to go. Can you let me know if the action items already there tries to encompass all thes issues and possible solutions. Ofcourse I know every one is talking and discussing but didn't see a concrete list except a description on the front page saying we are fighting for the cause of GC aspirants and some smaller descriptions.

    Look at tv25's post. He/She alreday used the H1B...tv25 mentioned that she/he worked on H1B for three months. That would have invalidated her h4 visa.

    tv25 shouldn't have entered using H4 visa that got invalidated as soon as the H1B was used.

    This is a serious issue and as all others are saying, tv25 needs to contact an expert immigration lawyer.

    Guys, please do not scare the poster needlessly with half baked knowledge.

    Think of the following,

    1. When she went for stamping , they did not CANCEL her H4 visa stamp. Cancelling a visa stamp is a very very easy thing to do. For example if you still have 30 days left on ur stamp and u went for a visa stamp , they put a big CANCELLED on your old visa stamp.

    2. So what does this necessarily mean ? This means her entry to the US is dependent on the immigration officer at the POE.

    3. Her H1 was denied due to mis representation of facts, which means her COS is essentially denied, even though she was allowed to work since her COS went through while in the US.

    4. Don't you think the officer can see her COS in his system when she entered on H4 ? Basically he let her in on good faith that she will not be using her H1 anymore.

    Her status is now H4, if she needs to work, she will not have to use EAD or apply for another H1 COS. And here's one more thing, she will now not be subject to the quota since she is going back to H1 within the same year.

    My wife's H1 stamp was denied in Vancouver canada and she had her H4 stamp still valid. So we asked the IO specifically if we can use to enter it back to the US and he said specifically " it is up the officer at the POE". After we came back to US within a couple of week we applied for another H1 with same company and it got approved.

    There were few employers too who attended the rally because they believed in the cause.

    I spoke to a French guy, forgot his IV handle, he got his EAD recently, he flew all the way from Miami, he googled up immigration and found IV 2 weeks back, looked at the rally stuff and came and attended the rally.

    Hats of to all these people who have respected IV with passion.

    Thousands of visa applications and other sensitive documents, including paperwork submitted by top executives and political figures, sat for more than a month in the open yard of a San Francisco recycling center after they were dumped there by the city's Indian Consulate.

    The documents, which security experts say represented a potential treasure trove for identity thieves or terrorists, finally were hauled away Wednesday after The Chronicle inspected the site and questioned officials at the consulate and the recycling facility.

    Among the papers were visa applications submitted by Byron Pollitt, chief financial officer of San Francisco's Gap Inc., and Anne Gust, wife of California Attorney General Jerry Brown.

    "It's shocking and totally unacceptable," Brown said when asked about the incident.

    Information on the documents includes applicants' names, addresses, phone numbers, birth dates, professions, employers, passport numbers and photos. Accompanying letters detail people's travel plans and reasons for visiting India.

    "As we see it, the documents are not confidential," said B.S. Prakash, the consul general. "We would see something as confidential if it has a Social Security number or a credit card number, not a passport number."

    But security experts say it wouldn't be hard to obtain someone's Social Security number using the information available in the consular documents. They also point out that some of the Sept. 11 hijackers used false passports, which wouldn't be hard to obtain using data and photos from the documents.

    "This is absolutely sensitive information," said Charles Cresson Wood, a Sausalito information-security consultant. "It needs to be safeguarded."

    Pratik Sircar, deputy consul general for the Indian Consulate, said the office on Arguello Boulevard processes visa applications and other paperwork for 14 Western states.

    "We have a shortage of space," he said. "We keep this material for a year, and then we have to destroy it."

    However, the consulate didn't destroy the documents. Instead, it hired a hauling company in December to cart the boxes to the Haight Ashbury Neighborhood Council recycling center near Golden Gate Park on Frederick Street.

    The open-air facility is accessible to the public seven days a week. Anyone can walk through the gate and poke around.

    "We thought it was their job to shred the material as soon as they got it," Sircar said.

    Andy Pugni, general manager of the recycling center, responded that he doesn't know where the consulate got this idea.

    "We take in paper, put it in large containers and ship it off for recycling," he said. "That's all we do. We don't shred."

    Pugni added: "We assume anyone who brings stuff over here will be smart enough to destroy any sensitive materials. I wouldn't bring any of my own materials here."

    Alerted by The Chronicle to the presence of confidential documents in a corner of the recycling yard -- many of the white boxes were clearly marked "visa applications" -- Pugni had a truck brought in to haul the papers to an East Bay company that will boil them down and recycle them as blank pages.

    All that remained in the yard Thursday were remnants of the boxes.

    But a sampling of documents obtained by The Chronicle indicate that the boxes contained confidential paperwork for virtually everyone in California and other Western states who applied for visas to travel to India between 2002 and 2005.

    They also contained thousands of documents submitted by Indian citizens and people of Indian background residing in the region.

    "It's hard to believe that this is how confidential information is treated," said San Francisco resident Farah Champsi, who was born in Mumbai, formerly known as Bombay, and requested copies of her birth certificate in 2005.

    Her application ended up at the recycling center. "This is terrible," Champsi said.

    Visa applications were submitted by current and former executives of many of the region's leading employers, including AT&T Wireless Inc., Oracle Corp., Intel Corp., Microsoft Corp., Qualcomm Inc. and Williams-Sonoma Inc.

    The documents illustrate the extent to which major U.S. companies have established operations in India or rely on India for key services.

    A letter from Gap's then-CEO Paul Pressler accompanying the visa application for Pollitt says the company's CFO was heading to India for several days in April 2004 "for the purpose of visiting Gap Inc.'s sites and vendor facilities."

    After the application surfaced this week, Pollitt said he found it "both astonishing and alarming to learn that basic safeguards were apparently not in place to ensure the privacy of my personal information.

    "As a past victim of identity theft, I am painfully aware of how important it is to ensure personal information is well protected," he said.

    Another Bay Area exec whose privacy was jeopardized is Rob Haragan, co-founder of NetDevices Inc., a Los Altos company that specializes in network security. Much of NetDevices' research is conducted at a facility in Bangalore.

    Haragan, a former executive at Cisco Systems Inc., applied for a visa to travel to India in 2004. He estimates that he's since been to the country more than a dozen times.

    He said he was surprised to learn that his application spent weeks at a recycling center.

    "The consulate absolutely needs to correct this," Haragan said. "It's a breach of trust."

    Brian Biega oversees storage of internal paperwork at Redwood City software giant Oracle, so he knows a thing or two about the proper handling of confidential documents. He, too, applied for a visa to visit India in 2004, and his application also ended up at the recycling center.

    Biega didn't hesitate when asked how Oracle's famously truculent CEO Larry Ellison would react if boxes of sensitive information were left at a recycling center. "I'm sure I'd lose my job," he replied.

    At the Indian Consulate, Consul General Prakash said there may be a cultural dimension to the level of outrage related to the incident among Western visa applicants.

    "In India, I would not be alarmed," he said. "We have grown up giving such information in many, many places. We would not be so worried if someone had our passport number."

    Deputy Consul General Sircar said that in other countries, Indian officials are able to go to the roofs of their offices and burn documents they're no longer able to store.

    "In America, you cannot do that," he said.

    Sircar said the consulate would find some other way to deal with its excess paperwork in the future.

    Pugni at the recycling center said that shortly after he had the documents carted away, a representative of the consulate arrived at the facility.

    "He apologized for everything," Pugni said. "Then he said he was on his way to Best Buy to pick up a shredder."

    I have seen a similar thing with our other campaign - "File 485 before PD is current". There are some forums spreading negative information about IV and this might be the reason.
    Of course theoretically it is possible to have them participate in these without creating an ID (which is free). We have to verify in some way to avoid antis, maybe ID or bill or some other way.
    We don't want to go to USCIS with 100s of members from numbersUSA or fishing site users.

    That is the ONLY bloody way you can assure yourself of a CLEAN organisation..i do not know what it will take for IV 'CORE" to understand this.

    Okay. I was able to talk to my attorney just a few minutes ago. He said, to do interfiling , you do not need to have PD current based on new I-140 as this is just a case update with new 140 information. He said that in any case, your 485 will be picked based on PD. I found him very very confident when he was telling me all this info to me.

    Question - the PD is never mentioned on the 485, it comes from the the underlying I140. So this leads me to understand that they'll interfile the I140 with the pending I485 even if our PD isn't current. Hmm...this conflicts with the info posted on www.immigration-law.com.
