    Based on what you believe that "BC has a much higher standard of living than Boston?". I hope that is not one of those silly annual surveys in which they interview low income and beggars on the streets and rate mainly based on health care and welfare for them.

    Regarding raising kids, if you believe that doing that around prostitutes, lesbians and drugs is a good thing, so go ahead and live in BC.

    I would say Canada because British Columbia has a much higher standard of living than Boston. Canada is generally a much better place for raising kids and the stress levels are lower because of freebies like health care etc. BC also has a much better weather compared to Boston.
    The other reason is that you could always come to the USA from Canada later but if you lose the Canadian PR now and don't manage to get a green card in the US, you lose everything.

    Yes, you'll have to get it registered.

    It is not big deal. Just ask your parents to get in touch with a document writer (guys who'll be sitting in front of Registrar offices) and they'll do it for you. Your mom and dad may need to go and sign the docs in front of the registrar.

    both mom and dad or one of them is OK?
    Does the registrat allow such affidavits to be signed in his/her presence. What role do they have? Do they attest that the affidavit was prepared in his/her presence?
    An notarized affidavit on Rs 100/- deed paper (or whatever you call that) is not OK?

    Here is what I found from Murthy Forum --

    According to the AILA-NSC Liaison minutes of 04/12/2007, the following standards generally applies in determining EB-2 requirement:
    (1) U.S. master�s degree � as long as it is in the field required no additional documents would be required
    (2) 4 yr bachelor�s degree + 2 yr master�s degree (India) � with degrees in the same or related fields this will generally be considered the equivalent to a U.S. master�s degree with no additional documents required
    (3) 3 yr bachelor�s degree + 3 yr master�s degree (India) � with degrees in the same or related fields this will generally be equivalent to a U.S. master�s degree with no additional documents required
    (4) 3 yr bachelor�s degree + 1 yr postgraduate diploma + 2 yr master�s degree (India) with degrees in the same or similar field : generally be considered the equivalent of a bachelor�s degree plus one additional year of education so the beneficiary would also need to have 5 yrs progressive experience. If the postgraduate diploma is determined to be progressive postgraduate education that is a continuation of the 3 yr bachelor�s degree it is possible that this would be considered the equivalent to a U.S. Master�s degree and there would be no need to establish 5 yrs progressive experience.
    (5) 3 yr bachelor�s degree + 2 yr master�s degree (India) � Generally this would be the equivalent of a bachelor�s degree + 1 year and would require 5 yrs progressive experience to qualify under the 2nd preference category: However, foreign credential evaluation using the following additional evidence could make it to EB-2, Master's degree equivalent:
    Examples of comparable U.S. master�s degree programs requiring only one year to complete (indicating that a total of 5 years of undergraduate and graduate level education is sufficient); or
    Credential evaluations that provide a detailed comparison of credit hours completed by the beneficiary for the 3 year bachelor�s degree program with credit hours required by comparable U.S. bachelor�s degree programs.

    (6) 3 yr bachelor�s degree + 2 yr master�s degree (India) + 5 yrs progressive, post-master�s degree experience � Generally the educational degrees would be determined to be the equivalent of a U.S. bachelor�s + 1 year and the beneficiary would meet the statutory requirement
    (7) 3 yr bachelor�s degree + 2 yr master�s degree + 1 yr postgraduate diploma (India) � Generally this would be the equivalent of a bachelor�s degree + 1 year and would require 5 yrs progressive experience to qualify under the 2nd preference category. If the postgraduate diploma is determined to be progressive postgraduate education that is a continuation of the 3 yr bachelor�s degree or the 2yr master�s degree it is possible that this would be considered the
    equivalent to a U.S. Master�s degree and there would be no need to establish 5 yrs progressive experience
    (8) If a master�s degree is required and the beneficiary does not have a U.S. master�s degree in the specified field of study the petitioner should be prepared to submit sufficient documentation to establish that the education that the beneficiary possesses is the equivalent to a U.S. master�s degree in the required field.

    I-485 receipt notice received Aug 15
    EAD approved Aug 17

    YOU APPLIED ON JUNE 29TH AND GOT EAD ON AUGUST 17?. WOW!:eek:
    SO WHO FILED IN JULY, CAN WE EXPECT EAD IN SEPT?.

    Your post is contradictory. At beginning you said

    So how are you going to pay off your house if you've no money? Do you mean you are going to sell it and pay off mortgage? But in current market your house value would be less than what you owe, so you may end up owing more to mortgage company than what you'll get after selling house.
    My boss recently changed and the work environment is not good anymore (never imagined this would happen), I am in a constant pressure and no job security. It's a shocker in a fulltime state job.

    We bought a house last year needless to say that the prices have fallen. We are now in a dazed state as we just realised we don't have any savings, whatever we had, we made bad choices - house, 2 cars (They looked good at that time though) and put about 10% on the house.

    We were planning on to invest all our savings in the house as we recently paid off our two cars and no other debts. But after reading some posts here on the housing and investment market. I am not sure if I want to put everything in the house, having my job at risk and no GC yet.

    Being a novice in fianancial matters, need advice.
    Appreciate your thoughts on this.

    try calling now..most dr's that were packed earlier this month are now wide open due to everyone cancelling. but do it fast with the new developments things might get tight again. for eg- I have an appt lined up for Wed morning just incase things come through tomorrow :-)

    Thanks for the clarification.

    Just wanted to emphasize that getting a valid H-1/H-4 stamp on the passport is good enough for re-entry. AP is not a requirement.

    From your post, I believe you agree with me.

    this post was for specific question as to whether his spouse and child can use AP while returning from his home country. They have a valid H4 or some status now which was going to expire and he wanted them to use AP( and not get a renewal) while entering back. My post address that issue. So hope the confusion is cleared

    Finally I gave a thought to all this GC business and I am planning to start my Canadian PR too, here are my questions :

    1. Does anybody know of any good immigration cunsulting company for Canadian PR processing ?

    2. How much would be the total cost to get it done throught the consulting services ?

    3. Are there any hidden costs which these companies tell you at the end and try to rip you ?

    Will you be okay in the cold canadian weather?
    You do not need a lawyer. You can do it yourself. This is what I have gathered from various forums. It is much easy than the US process.
    BTW I have not applied yet!! I sincerely hope we all 7500+ IV members can get a bill passed soon enough.

    Thanks for your reply "WeShallOvercome", The question which you answered is on top of my head from so many days, I asked some many people and they are not sure, Thanks your help

    One more question is right now my wife is on H4, My I140 and 485 are in pending, if my wife got EAD she can use it right?
    2) If my I140 denied and her EAD become Void, Is she permitted to stay in USA or She needs to go out of country and enter with h4 status?

    Yes, You can use EAD and start working on it before I-140 approval BUT you can not change employer using AC21 without an approved I-140 even if your I-485 is pending for more than 180 days.

    Let me clarify some doubts people have on this thread...

    It's your choice whether to use EAD or H1 to work,
    You can change employer on EAD as well as H1(EAD is just easier, no application fee involved), provided your 485 is pending for 180 days and 140 is approved.

    EAD does not give you the freedom to change employer if the other 2 conditions are not met(140 approval and 485 pending for 180 days). Once these 2 conditions are met, you can change even on H1....

    I am also in similar suituation. My lawyer told me that my H1B status is maintained for 240 days after my visa expires. But you would need a H1B approval and visa stamping to enter country again.

    This thread is started to just gather the list of people who have approved Labor as on 31st Jul,2007 and could not file I-485 for various reasons like out of country,Not married, Employer did not file or Lawyer delayed etc.

    Does anyone have any insight on this thing called "Last Action Rule"?

    Scenario:
    1) Visa stamp till Feb 28,2007.
    2) Extension of 3 year H1B based on approved I140 starting March 1,2007.
    3) International travel, returning to the US on Feb 3.

    Now at the port of entry, the officer takes an action of saying your I-94 is valid till Feb 27. Basically this invalidates your previous H approval that starts from March 1. Some "Last Action Rule".

    Basically the idea is that the person has to get a new H1B stamp when in India for the extension.

    No harm in calling USCIS. Why do u need to ask that in this forum?
    It is their customer service no.. go ahead..call them. they will tell you if they can give any additional info or not

    The school is wrong on 2 accounts:

    1. The only exception to the full-time student rule on F1 is your LAST semester of graduation. If your wife is in her LAST semester, and she has fewer credits remaining for graduation, and enrolls in less than full-time credits she CANNOT be out of status. I myself was in that boat in my last sem. Not sure if things changed in the past 2 yrs.

    2. If she has an EAD, then your lawyer is right. She is not required to be on F1.

    I totally agree with what was said by she18. If your are in the last sem and don't have enough credits to be a full time student, they need to update the same in SEVIS and continue the studies.
