Just wanted to see how many duplicate application USCIS will get this week.
- My lawyer wants to refile (with no addional lawyer fees). Does it make any sense to re-file?
- Is there a vote somewhere that shows how many july 2 files received receipt notices?

i know a friend whose wife was in the same boat..
get an attorney and explain ...ur case..
what my friend was told...if you have given proper notice to quit...your employer has no legal standpoint to harras you.
dont worry abt that desi employer..that bum is in bigger soup than you are...the law that requires all employers to provide W2 before jan 31..no matter what..check with IRS if you want....he is toast! .;-)
take it easy.. you will be all right!

Is there any update on three bills in house. I have checked the hearing schedule for all committees and there seems to be no hearing scheduled for any of the bills. House in session till September 7 and after that District work period and convention shows, which leaves us with just 4 weeks from now and after that It reconvens from September 9 with target adjournment date of 26th september and i m pretty sure no congressional rep will like to cast vote on any bills before going into election....
Prospects seems bleak now... Is there anything we can do...any last attempt that is required? If so...Let us all know...

i think CP filers have a valid point to argue for relief. clearly there is an injury to CP filers as the dates were moved forward creating the impression that they will continue to do so or at least hold steady. legal opinion was also in favor of CP based on individual circumstances in many cases. many of these filers already underwent a lengthy BEC process, which newer Perm/I-485 filers never went through. the government flip flop is the cause of this additional injury.
instead of asking for specific fixes to be put in, CP filers should articulate this problem clearly and get legal opinion as to possible relief measures.
great point mr internet then I think CP filiers should other way to make their efforts and should not participate in letter campaign since there are lot of people who are waiting in CP queue.....anyway are you British...it seems to me from your reply:rolleyes:

Your wife cannot apply for I-485 when she is in India. One of the pre-condition is you have to be in US to apply for a I-485. She can only do consular processing.
However if you can get visitor visa and after entering america, if you apply for a I-485, most probably USCIS will approve your case. Therefore, In my opinion the challenge is getting B1/B2 visa when her husband is waiting for a adjustment of status.

But I still find it strange that if someone has a pending I-485 through consular processing route, then he/she can't get a visitor visa no matter what? What if it is a medical crisis? Family reunion issues? This sure sucks. I will check with some lawyer on this.

After reading all this, my story is even funnirer. I went to India to get engaged (arranged) when the dates became current...and not they rolled back to 1000BC.... Now I am engaged, and hearing all these wife stores feel quite screwed...lol..

The recent AILA prediction on the cutoff dates for EB3 for the month of october, how accurate can they be considering the following.
1. Dates until May 08 2001 were current for a long time until 2007 June. So most of the guys with that priority dates have already applied for AOS. Most of them might already gotten their GC. There may be a very few stuck in the process but that number should be very less.
2. For the month of June 2007 they moved the dates ahead by more than 2 years with whatever information they have.
3. Now by October 2007 there might be a few more cases, with PD before 2001 May 08, might get added but this number should be very less(I think).
Considering these factors how can there be a huge demand for visa nos with PDs before May 08 2001?

I think we need an IV movement to fix the Indian Consulates - They are absolutely pathetic - Lets get our house in order before we try to fix the USCIS !!! Sorry to hear about your situation. You should've taken unpaid leave for two weeks instead of a lay off. Now you definitely should not file AC21 and hope that the USCIS will not issue RFE (rarely happens). It doesn't matter how you quit, if the USCIS finds about it, it will probably deny I-485.
Regarding Shusterman's Q&A. I am not sure where is he coming from. The law does not provide for lay-off exception.
Recently I heard that if you are laid off from the company, then the 180 days period won't come into picutre and you can very well move to another company, provided your I-140 is approved and not revoked. I think they have made some modifications recently to the law on this type of cases. Talk to your Lawer to find out these changes.

your only option is to find out by calling all numbers in chicago and pittsburgs.
People have flown in from various locations into chicago and got medicals in 2 hours.
also, ask your wife to get the immunization record of mmr and tetanus.
that will make your life easier.
x-ray is mandatory.

instead of attacking some one who applied for LS, i suggest it is advisable to direct the anger towards DOL or USCIS.. whoever is responsible.
LC substitution is legal and probably that's why many ppl did it. why shud we blame them. we shud blame the law. and good that its been eliminated now..
i don't think we need to segregate those who applied using LS. May be most of us could have used it if we had not applied labour directly and knew that some LS is available for no price with old PD...

This is the simplest Action Item ever, no travel, no holding placards, no visits to lawmakers, no real world activity. All that's needed is pen, paper, envelope and a stamp.I can't imagine anyone here who cannot afford any of these items.
Most members here will benefit here by 3 year EAD/APs, job flexibility and promotions. Members who missed the July VB boat, and new applicants, will get to apply 485 and get into the line. There was a hue and cry sometime back about restarting I-40 PP. Even that group stands to benefit as their demands are included too.
Hence the current low-level of participation is surprising. If we cannot collectively write even a letter for our cause, we might as well pack up or stop waiting/discussing VBs. They will be bleak for at least 4-5 years more. Come on folks, we can do better than this. We will write those letters and we'll succeed.
