    I am here to talk about LEGAL immigration. In all the noise about illegal immigration and their path to legalization a very important subject is lost and that is LEGAL immigration, and delays and problems they are facing.
    I came to US in 2000 with a perfect business plan and dream to start a company and spread prosperity, but the path I had to take was H1B visa. After coming here my last 9 years have been spent on getting Green Card ( I have recently filed for my 10th year H1B Extension), and my GC application with a priority date of 2003 March is still waiting in Backlog.
    While there is some opposition for illegal immigration more than 90% of people I meet support the improvement in process for LEGAL immigrants. I hope in this CIR while looking at illegal immigration you pay special attention to LEGAL immigration.

    Together we can build a happy and prosperous America for future generations.

    yes, no checks cashed yet, checking my account regularly. the notice date is 21st sep, so I am thinking it might take 3-4 business days for the checks to cash, do you guys think my assumption is right?
    Anybody in the same situation?

    So you got the receipts without the checks getting enchased? Ddid any one who were sent to CSC did not get their checks enchased but recieved receipts?

    How can it be RIR? your PD is March 2007 and there was no RIR application available. At that time it could be applied only in perm.

    called uscis they say its for faster processing and should get letter in mail.
    did anybody else get a mail like this.

    I think lets not get diverted. We have to display prudence in our action

    We have 2 question infront of us.

    Q1) What we want?
    A: We all know that..

    Q2) How we can achive this.
    A:By convicing lawmaker.

    Lets get this things clear

    US prsident DO NOT make any law he pass the law or vetos the law.
    Economic report 2006 says that US Presidents understand our plight. So if the law passes in HR and Senate I dont see any reason why this will not be signed into law.
    Involving Indian authority will may jepordise our cause.
    Why?
    Permanant Residentship is Privilage NOT Right
    America is a soverign nation and many in Congress or Senate specially the Republicans may not like the influence of foreign Government in law making descision. Senators or HR who may sympathise our cause may turn away after India try to put her influence.

    We are playing very DANGEROUS game here.
    Involve India only if your rights are violated not if your privilage is stuck. I hate to use these words but looks like we are acting as kids rather than adults.

    We are not dealing with any trivial issue we are dealing with Government of a country where we are known as "Aliens".

    Folks:

    I am one of the frustrated ones under EB-3 (India) with a PD of Jul 2003. My case is as follows:

    I had 3.5 years of experience + MBA from India when I joined the current Job in 2001.

    I applied for my GC in 2003 and the lawyer said since my MBA was not relevant for the current job (software engineer) and since my experience before the current job was less than 5 years, I should apply EB-3.


    Currently, I have 11 years of experience (out of which 7.5 is with the current employer from whom I have applied for GC) and I have moved to Business Development that uses my MBA quals.

    Can I change to EB-2? What do I need to do? What are the risks?

    Any/all pointers will be appreciated

    (I am not expert) but I believe , you have to refile (New application) under EB2 catagory and port the EB3 date to EB2.

    "Revitalizing the Golden State" looks great for reading but....

    - Does legalized illegals really pay taxes?
    - what is the possibility that they don't depend on Gov from the day they get their Citizenship?
    - Illegals are here from more than 10 years....do the average age is around 40'.... they may work for 10 more years and then depend on Gov.

    It is a know truth the advantage of giving GC to Legal EB's then Illegals but as you said we need clear message posted....

    Thanks for your reply. My main question is, if I do the H1B transfer (to a company other than the one that filed my labor, 140, 485), who has to submit the application for my spouse's 485 (when the priority date becomes current), my new employer or the old one that originally filed my 485?

    I don't believe it...did you guys even read the original thread? He is asking about being laid off while on EAD while you went on a tangent about H1B status, buying furniture and rental lease!

    Also, poorslumdog, who told you that you that "once you are in EAD and got laid off...you lose your status"?

    The only person that makes sense on this thread is ramaonline. Javadeveloper, since you've filed your AOS, you'll be in legal status with or without a job. You don't even need to have a job now...GC is for a future job offer. EAD has nothing to do with it. Has it been 180 days since you filed your I-485? If so, your I-140 is safe since your employer loses "control" over it. Because your I-140 is not approved, using AC21 to port is quite risky but this may be your only path.

    One last thing, I hope things work out and your employer re-hires you BUT you really have to assume that they won't and plan for you worse. Remember no one cares about your GC more than you...

    Updated the list in the previous page Guys, if you want to take a look for those who care.

    But here is something very interesting I just noticed from the list. A bunch of the approvals for July 2007 filers occurred during Jan-Feb 2008, but after that NOTHING!! I can only speculate that under some directive, they were ordered not to touch our cases after that timeframe. I *think* it was because they wanted to use up the EB2 visas, so they only worked on that moving forward, that's why ~ 80% of July-Aug EB2 140's have been processed so far.

    But again I reiterate, many of us will see the silver lining & feel the sunshine this year, sometime in October, by the rays & grace of God. I must say, I have never felt this way before.

    BTW There are also so many EAD/AP pending from 07/2007 as well, wonder why we are hearing grief over that?

    People do not agree and have different ideas - sometimes to the point of personal hurt! - this is natural. They have different interests and even when they have shared goals, sometimes their paths to those shared goals may diverge - this is natural, too. Yes, differences, discussion and divergence can lead to a final separation and then two or mroe new groups are born - and it can happen naturally and it does not have to be rushed or forced through censorship and persecution. But sometimes debates and differences actually help the whole group to stay together and find a better path or a better solution - in the heat of the discussion and in the fight of the dualling arguments a new idea, approach or solution is born. I do think that a lot of the most contentious discussions on this forum are actually the most important and interesting ones because those are the oens that will cut to the heart of the problem and reveal the real depths of the issues. Suppression of diverging opinions is the hallmark of dictatorships.

    I agree with you and its good in many situations, but i think unfortunately this does not apply here... if we are not united and don't march together towards our ultimate goal... it will only make us look disorganized and we will come across as a bunch of self centered highly educated fools who don't care about the big picture.

    For those who dont agree with what IV is doing, no one's forcing them to follow what IV does and certainly no ones forcing them to be here, but if you are here then you should at least trust the organization in what they do.

    If you have ideas talk to the core and discuss with them in person or call them... i m sure they will be glad to take it up if the idea benefits everyone and not just me or you... breaking off driving folks in different direction is not the solution, it will snow ball into a big problem.

    i dont think the congressional call will help us. all they will do - the congressman's office is just talk to them on our behalf and give us the information. that is what i gathered from them. but there is no harm in trying it out as long as we dont have a problem attributing our luck to the congressman's efficiency (god only knows if their calling might have helped or on second thoughts may be even god doesnt know - come on it is uscis - they always amaze any one and everyone)

    I totally agree. Good joke indeed.

    Agreed that they are humans. Disagree that they are doing their best. I have worked in a government agency part-time on OPT here in the US, and let's just say, more than half the time is spent away from desk, and outside buildings for smoke/coffee breaks. IT Projects that should not take more than a month or two to finish, linger on for years.

    Ok, in defense of Nikon, how are Canon's lenses "far superior"? Yes, they have IS (VR) in long teles, and their wide T/S lens has a bit more flexibility. But say Janey wants to do some extreme macro photography? Yeah, Canon has the MP-E 65mm that goes from 1x to 5x, but it's expensive, and for the same cost (or less) one might be able to get a PB-6, enlarger lens, movie camera lens, 50mm lens, and various accessories to link them all together, and in the end have a much more flexible macro system.


    Please read......."IMHO".................my opinion, not anyone's else's and are not we all entitled to opinions? Certain I am sure there are several scenarios that might favor one mfgr over the other........."what if" situations abound.

    RFE for I-140

    I had applied for I-140 Dec last year(2006) EB3 and was checking for update and found that an RFE has been sent on Dec 12. To whom is RFE sent....My company had done all the paperwork...is it to our company lawyer or me....Please advise

    I never demanded permanent residence in the US as my right. But I have the right to have my LCA adjudicated in a reasonable time (months, not years) by the US administration. Months, not years! I am here legally, I work hard for this country, pay honestly my taxes and I am entitled to get a quick reply to my application. If it is rejected, OK! Fair enough, I will look for other opportunities.


    A company invites you for an interview. You meet them over the course of a few hours and expect an offer. But they don't get back to you. So do you keep waiting forever for that phone call? Or do you assume that you didn't get the job and move on?

    We HAVE a choice of going back to our home country: if some of us (me included) choose not to take it, it's because we think the GC will more than compensate for the opportunities we are losing currently.

    Don't get me wrong: the US government should fix the broken immigration system. American citizens would never tolerate the tardy service we suffer at the hands of the DOL/USCIS. But in not "voting with our feet" we are part of the problem. Just imagine, if a substantial fraction of H1 visa holders left the US tomorrow (and quoted the backlogs as the cause) wouldn't that get more attention than all our efforts so far?

    I think immigration voice should ensure that concurrent filing of I-140 and I-485 is removed.

    And why exactly should ImmigrationVoice do that?? Concurrent filing is HIGHLY beneficial to most people here!
