I am glad that some EB2 guys can empathise with us....EB3(I) is completely hopeless....but I doubt if IV will take this up...even a small admin fix like applying the spillover to EB3 this year...that will take away some stress on the EB3(I) pipeline....

That apart Prudential has a term life policy where you get back the complete premium paid under this policy at the end of the term�. say for a 30 year term you paid a total premium of 30K in 30 years,, at the end of 30 years if you are still alive you will get back the 30K..

In that case whole life is better where the cash value generated would pay much more after 30 years based on a low 5.5 - 6% estimated annual return. But of course it is for folks who will stay in US at least 15 years+ because after 15 yeras the Cash Value could itself pay for the permium and you do not have to pay any more premuims unless you wish to boost the Cash Value further.

Iam also in Same bote , three years Degree with 2 years PG diploma with 14 years of industry experiance , Planning to do MBA , which i am looking for cheapest and fast.
can any one see this Western Governors University (wgu.edu) got a MBA in IT. looks per sem... they are charging flat $3000.00. Is this ok to get MS from here (Distance Education) , or not suggestable with this University. All am looking for just to move EB2.

hi,
i say great post! i actually was very happy in aug/sep this year and counted chicken much earlier than the eggs hatched... my eggs have not hatched... anyway, i set up an s-corp and got going... i did on my own name and with just me in it... the purpose of my s-corp was to do some non-IT work i.e. not consulting... though my day job is IT. my immigration lawyer warned me against being self employed for the GC sponsoring job... basically, if the USCIS ever becomes interested in your small business, they can ask any questions... including whether there is enough work to justify a full time employment and the burden of proof will be upon you... so if you plan to use AC21 to switch to your own company, i'd say think about it a little hard...
as for legal formalities with the state... that was a breeze... i incorporated with the state of illinois... filled out the form (2 pages). put it in the envelope with the check and sent it out... there are some other formalities too... i read the book "inc yourself" which had a bunch of easy instructions and things to watch out for... that was one amongst many books i read... did not consult any lawyer other than my immi lawyer... i use quickbooks for record keeping and have a free business checking account with national city... (i am in the midwest)... dont have cpa or lawyer yet... primarily, i want to learn the law and accounting myself before i outsource to lawyers/cpas...

It's just bad luck to get that kind of CBP officer. It's upto you to ignore this or escalate it. In my opinion behaviour of CBP officer was wrong.

Infopass and Expedite on ph did not work. My congressman office helped me to expedite AP . Mine and my wife's AP got approved even though we requested expeidited only for my wife's AP.

My EAD receive date is 27th July and notice date is 31st Aug. I made two infopass appointments till now but got different excuses both the times for EAD not being approved. During my first appointment, local office told me that since USCIS is counting 90 days from the notice date, i should come after Nov. 30th. I went there again on Dec 3rd. That day local office told me that NSC is currently processing july 3rd cases and you do not fall outside processing period window. So you need to wait.
I called USCIS customer service center several times. But everytime i get some different reason for not opening up a SR. I guess now i will wait until NSC start processing july 27th EAD cases. I am sure once that will happen, USCIS officers will give me some other excuse rather than looking into the case.

It is a personal choice plus the level of risk you take, I bought my house before my GC was approved and here I am now. Setting aside GC concern, the only problem you might face is securing a loan with good rate, all lowest rate that you notice in internet banner or Bank flyer is not applicable to you, simple reason H1b Visa is considered as temporary Visa, once your loan application is taken by a banker, one of the question in loan app. pertain to Citizenship, if you're US citizen or GC holder then chances of getting loan with lower rate is higher(though many factors contribute to lower rate and loan approval), but if a person on H1B visa approach for a home loan, then Under writers perceive you as high risk borrower, some bank may deny loan if you claim as H1B visa holder, but some banks will approve loan but on higher rate.
In my case I was on EAD when my loan was approved, it was a hell lot of problem in convincing UW to approve loan, I approached my lawyer to get a letter stating that a person on EAD is one step closer to GC to get final approval, still I ended up taking 0.25 % more rate.

I agree, you will be competing with all the illegals. But.....
1. How likely are they to file their apps on the first allowable day that USCIS will accept the applications? Not very. Most of us know what's going on and will be ready to send in our apps first. Ofcourse if some EB based guy is pottering around instead of moving fast, thats his problem.
2. How many illegals can afford the high priced attorneys? Most of these poor guys dont know to speak, read or write english, forget about filing out USCIS forms.
3. How many illegals maintain perfect records of their time and can recreate a paper trail of the time they spent in the US. I certainly can and most legal wannabe immigrants can definitely prove the time they have been here (paystubs, utility bills, credit card statements, bank statements, etc.)
The point I am making is - this is the best option I have seen in a long time. Even the stupid point based system had its drawbacks. This is unconditional. It will get vast support from the hispanic community also. The UK has the same thing. Be on a work permit for 5 years and then you are eligible to apply for Permanent Residency. I believe there is also some clause in the UK system that states that you have to have been in the UK illegally for 10 years as against 5 years for a legal immigrant. I'm sure setting the illegal bar at 10 years and legal bar at 5 would be acceptable for most people.
If we reapply under this section, we will be competing with the massive illegal-to-AOS guys based on our Receipt date for adjudication.

I am watching visa bulletin for 1 years now and found that if it releases early around 8th to 10th of month then no good movement but if releases close to 15th .. like 13th or 14th then some very good movement.
This is one of those weird correlation no one thought of e.g. if economy goes south more men opt for vasectomy and more business for the docs!

this whole thing sucks. USCIS cannot adjudicate even I-131 on time. We have booked our travel tickets after 100 days of Received date of AP renewal application and looks like we have to cancel our tickets and waste $1800. This really blows and its attrocity to the core that USCIS cannot process AP renewals inside 90 days time period and its a shame that they are not answerable to anyone.
Please post your info-pass experience. We are in the same boat. My wife's AP is pending since 6th June 2010.

There is nothing much that Obama can do unless there is bipartisan support in the congress. The House will not take it as Speaker Pelosi has said, if the Senate does not act first. In the Senate, Lindsey Graham is playing politics....... Unless, the legal immigrants and undocumented groups put pressure on a few republicans to get to co-sponsor the bill - it is a dead end.........
