    Hello H1b Guy,

    I am sorry for the situation you are in. The employer should be punished. Let me ask you:

    1. do you have any email correspondance with the employer asking you pay for h1b fee?
    2. if you don't then pose him a question using office email something like "how much is still pending on my h1b fee that i owe you (replace you)". Address this to HR or Payroll or the boss it self. Wait for the reply, and then take copy of it for record purpose.
    3. if '2' does not work then wire tapping is way to go:
    http://www.citmedialaw.org/legal-guide/new-jersey/new-jersey-recording-law. As per the law in New Jersy, one party should be notified and if you are recording you conversation, you are the one party and the other do not have to be notified. Are you using voip in the office? if so use wireshark to record the conversation. If not then there are devices available outside for cheap to do it.

    I am not a lawyer, please do some more research and then find a way. If you really want to trap these type of guys there are tons of legal ways to do it. Hope, this helps. Take care. All the best.

    Honestly though, OP's proposed law would get much more congressional support than EB reform.

    If first you gave amnesty, and then allowed ppl to sponsor their parents on a GC, the illegal immigrant lobby would be very very happy.

    You can still get promoted while on H1B just don't give up hope. If you're not getting promoted even if you're performing well, then there's something fishy going on with your employer.

    My current H1 is expiring soon. My 3 year H1 extension is pending. I had receipt notice but NJ DMV at Wayne refused to accept that. My current License is valid only till the middle of the next month.
    Any body in the same boat? What shall I do?

    that when you apply for a H1 extension, until USCIS comes back with a decision, the current H1 is automatically extended for 240 days. When I was in a similar situation the DMV told me either to bring the original receipt notice or original approval notice. If we take the Original receipt notice then they said would extend the DL by 240 days, if we take the original approval notice it is extended till the H1 expiration date.

    I have lived in Nevada before. I think in that state and many other western states (where guns laws are more liberal) you have to have passport, I-94 and utility bills proving you have lived in NV for 6 months. That's it. You don't need hunting license to get a gun license.

    Here is the biggest irony:

    IN order to own a gun, FBI needs only 2 days to check your background.

    IN order to get 485 approved, FBI takes months or years to do a background check.

    I guess green-card is a more lethal weapon than a handgun.

    Do you really agree with multi-national managers(via L1A). This is the area wherein the interpretation is pretty loose. If you dissect EB1 data you would find that EB1C used bulk of it except for this year due to bad economy and tightening of screws. There should be some very clearly defined guidelines for EB1-C, somebody being an onsite coordinator or managing 5 people should not be eligible. This category should be reserved for those who are managing at least 100 people or control business in several millions. I agree that EB1 should be just for the exceptional.

    Exactly. There seems to be a mis-conception, which to a large extent has been fueled by some unethical companies, that being on L1A and having a gaggle of a few developers at client sites makes one "exceptional" and eligible for EB1.
    If somebody feels they should qualify for EB-2 after X years of experience,well, reason it out with your employer and re-file. I went through this. Restarted the whole process..labor and the whole shebang...to file in EB2 just because I was unable to convince the HR manager at one of my previous employers. That is the reason my PD is Oct 2006 and not July 2003.

    If I read you correctly, and if someone from IV does appear before congress, we should expect BEC mess/failure (PBEC in particular) also being brought to the attention of the lawmakers, not just the retrogression. Correct?

    Yes the service center will send your employer a curtesy copy and attorney the origial approval. Once you get the Feel bill letter and send the cachiers check, they will create a case and send the packet 3. in which you can find the NVC case number.

    Yes, exactly! One has to be cautious about his/her surroundings.

    I would be as cautious in NYC as I would be in Mumbai, since my adopted town now, and my hometown in India are both not NYC or Mumbai! If I venture out into DC, I would be more cautious than I would be if I went out to buy milk in the 'burbs of NOVA where I live!

    I am not sure about this but one thng can certainly happen with Admin Fix.
    Porting of applicant who have stayed long enough in (EB3 to EB2). EB3 15 years experience and still counting and stuck and uncertain porting rules and AC21 doesn't make sense at all.
    Or
    AC21 rules or some other fix giving relief to people stuck in GC unnecessarily.
    USCIs can make these fixes but they dont want to do it. Its simple


    That would have been a blessing for EB3 India and China, if it EB3 + n years of experience could be ported to EB2.

    But if visa capture (which is not braking any laws or rules but is simply making sure visa do not go unused) requires a legislative fix, I would assume your suggestion (porting EB3 to EB2) would be even more difficult to achieve with an Admin fix.

    Hello,

    i am lawful permanent resident. I want to bring my parents here permanently. I got nobody in India to take care of my parents.

    When i was small, my parents took care of me. When i need them, they are their for me.

    Now my parents need me. But i am not their for them. I feel very guilty and sad. I want to bring my parents in US. So i can take care of them.

    How can i bring my parents permanently.
    I know, i can bring them after i get citizenship, that is too long wait.

    i just want to bring them now. So they can have good life with me. Anybody know, how can i bring them in US soon.

    i saw some petition signed by many Indians for this request. Can somebody please go forward with this.
    Current president will understand our request and help us. He is very nice and kind person. He loves family and his mother in law lives with his family. He knows values of grand parents.

    Indians live with family, that makes Indian family stronger and less divorce. And Indian kids are well taken care by grand parents. So they are well behaved and best kids.

    We need this permission. Please work together and get this permission.

    I read this in a website. Is this possible? I want to explore all possible steps.

    The Employment Based Immigration section explains how they will make a task force to prevent illegal workers from being exploited. I don't see anything for legal EB workers other than this 5 year thing which will start counting after this law is passed. :mad:

    My understanding was that once the 485 is filed, you go by RD. It doesn't matter what your PD is...

    Does anyone know what the legislation is?

    I don't think so. Your PD is still relevent. Only those people whose PD is current will get their GCs no matter what the RD is.
