    The 1 year of BCom was not required to enroll in the Diploma. However since my field of expertise is Management we were able to combine the 1st year of BCom with my 3 years of Diploma of XYZ Management. My Labor Cert also states that academic studies equivalent to a US Bachelors.



    It is important that everyone understand that each case is different. In this case was the 1 year of the BCom required for admission into the diploma program? Otherwise in my opinion (and anything can happen with any one adjudicator at USCIS) it souns like you are combining, which is allowed for EB3 when so stated on the Labor Cert.

    What are the disadvantages of NOT filing AC-21 Memo to USCIS after job change?

    Its all gray, but after reading posts on forums the disadvantage is the same: RFEs.

    If your employer withdraws your I-140 180 days past your 485 filing, USCIS will potentially issue an RFE again for employment verification letter. If you had filed a new EVL at the time of doign AC-21, USCIS knows that the I-140 revocation does not mean the end of the road, you have actually ported over to someone and he intends to hire you. Note that even 180 days past your 485 filing, you still need SOME employer to sponsor a same/similar job. (unless you are exceedingly brave and are going to self-port)

    What he/she is doing is legal. Unless this offer involved payment for labor substituion, in which case its illegal. But good luck trying to prove it. Ever heard of wage kickbacks?

    I understand your anger but NO ONE can stop this since its totally legal and if there is a financial transaction, no one will be able to prove it.


    logiclife - on this forum we have heard of members that work for companies who have used ONE approved labor multiple times by invoking AC21 once the beneficiary has completed 6 months. This is equivalent to fraud.

    i think CP filers have a valid point to argue for relief. clearly there is an injury to CP filers as the dates were moved forward creating the impression that they will continue to do so or at least hold steady. legal opinion was also in favor of CP based on individual circumstances in many cases. many of these filers already underwent a lengthy BEC process, which newer Perm/I-485 filers never went through. the government flip flop is the cause of this additional injury.

    instead of asking for specific fixes to be put in, CP filers should articulate this problem clearly and get legal opinion as to possible relief measures.

    Yesterday night at 9:00pm I got email from CRIS that they have issued RFE for me and my spouse.

    The contents in the emails say -

    "Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

    Current Status: Request for Additional Evidence Sent"

    Will have to wait and see what the RFE is about till we get it in postal mail.

    Very curious about what the RFE is about. Have been with the same employer who sponsored the GC for last 5 years. PD in july 2004 , I140-EB2 approved approved in Nov 2006 and 2 July 2007 filer.

    Did any RFE recently please post?

    Dude, I have been sparring with Pappu and Starsun for quite some time now. IV needs to be a "Paying Members Only" organisation.
    Per some statistics regularly floating around here, IV has 40,000 odd members. A membership fee as small as $1/month!! ($12/year), will INSURE a steady flow of funds, that will make a HUGE difference.
    Even if 20,000 of that 40,000 run away due to the $12.00/yr subscription requirement, that still leaves IV with almost a QUARTER million dollars worth of cash at hand, .

    thats a good idea, and at the same time we also need to show our numbers.
    I would say, lets make this a $5 monthly membership org. IV can help you much more than your Immigration attorney can.
    I'm not aware of any one else who directly deals with USCIS and with chambers of govt.
    Yes focus is needed right now, since after 4 years CIR is off the table and its time for piece meal bills which need renewed campaigning
    Many are a bit selfish just concerned with their particular case and want a quick answer, but don't want to help the high skilled community as a whole.

    If you look carefully health insurance payments are deducted in advance from the paycheck. So if say you join the new company in February the old company's paycheck at the end of January should be deducting health insurance for February. Therefore if the new company provides health insurance from March you should still be covered without requiring COBRA.

    Funny you say that. I'm all for a honest debate and in fact mentioned cited this forum's intolerance for disagreement. We fail to realize that the EB quota is not a Indian only domain, that there are other non-Indian EB immigrants with their own viewpoints, and that unfortunately this narrow sightedness will stifle any unified efforts to fight this problem.

    And I'm not beating isantem up. I was on the other hand trying to explain to him why the policy of country based quotas are naive for attracting top talent. Please read my post below.

    I was also looking here and there after rally no one handed me my green card :D

    Ok, I've seen a lot of threads about go to the rally, actions items, I've reading a lot of guys saying dont ask for your receipt status, dont waste your time etc, etc.

    Yes we did the rally we were great with all those signs, and appearing in the Indy TV but...

    Question remains open:

    1. When are they going to increase the GC quota?
    2. When congress id going to do something?

    I've the feeling that that's it we made our point but we are still with no GC, waiting receipts..............

    Hello All,

    Thanks for your thoughts & advise. It helped me in my conversation with my company's attorney. I would first like to clear my educational background. I have 10 + 2( HSC/ 12th Grade) + 1 (1st year of Bachelors of Commerce) + 3 year Diploma in my field. That being said this is what she has advised/recommended.

    She states that she is fairly confident that we can argue successfully the denial. She has said that she will file an MTR/Appeal & at the same time file a new I-140 too. She says she thinks there is a 50% chance that the MTR would be successful, if not she said it will go for appeal & take about a year. The advantage she said of filing a new I-140 at the same time is that she can make an airtight case with the cover letter covering the points for the reason for the denial of this I140 & the decision on the new I-140 would be fairly quick if the appeal is denied as it was filed witht eh appeal for the old one. The only disadvantage with a new I-140 would be that we cant file for 485 till there is an open visa, which means no EAD/AP for myself & my wife.

    Can members with knowledge of these kind of scenarios shed some of their thoughts?

    Finally I too received my FP notices, however I am scheduled to attend ASC in my attorney's location, I called customer service and now I need to wait till ASC finds an open spot to schedule FP at my location.

    What else can you expect from USCIS ??? :rolleyes:

    I am sorry to hear that USCIS has messed up your FP appointment.

    When (what date) did you get a notice from NSC saying that your I-485 is now transferred into NSC and now pending from processing?
