    Not entirely true, I switched job a couple of months ago - filed for AC21. I got an acknowledgment from USCIS for the same - stating that it will be added to my file, to be reviewed when my application is processed.
    did u transfer h1 thoough ?

    Hi Pankaj,
    Was your case rejected due to the number of years of education (10+2+3+2 = 17)?

    What if it is 3 + 3 ( 3 year Bsc Physics + 3 Year MCA) 10 + 2+3+3 = 18? I am wondering if USCIS would consider this equivalent to US masters? Came across a memo used by Nebraska Service center that says USCIS would consider 3+3 equivalent to US masters, but that memo was from 2006.

    yes my case rejected due to number of years of education.
    My case they rejected because i have 3 year Bsc and 2 year master now funny thing is that i know my friend who did similar course from same university but he did same master degree like me but in part time so he complete in 3 years and he got approval in 2009.

    Disagree, the reason you see lot of cases with (older PDs but later RDs) still awaiting approval is because when the PDs were current these cases were still not ripe (e.g: they were waiting name check clearance)....
    .

    My argument was on when your file will be looked at the first time. Of course, to get visa number numerous conditions, such as PD Currency, name-check, various documents, etc., have to be met. What I meant is that your file will be looked at the first time, only after cases physically received at the center reviewing your case (no matter what RD is shown on your receipt) before your case was recieved, have been looked at.

    Thus, even if you name check is cleared, your PD is Current, and you provided all required documents, if there are cases physically received before your case was received (no matter what RD is shown on your receipt) which are still to be looked at (at least once), your file will not be looked at.

    Note that when you call Customer Support, they recognize Receive Date what you see in your online status as "...your case was received on...", which may be quite different than RD on your receipt.

    Processing Dates published in monthly reports for each center are manually entered by their staff, and do not tell whether those dates mean "no case is pending older than this date", or "at least one case has been dealt with past this date", as the truth is something in between.

    Of course, internal processing and handling of physical files could be anything but known to the outside world. For example, it is possible that an officer was given a bundle of cases to look at, but then he/she proceeds on leave for 4 weeks, leaving them on desk to work on his/her return.

    one of my family member have whole life for $81/month for $1m at the age of 28 in NJ, in this plan we will get back everything we paid after 30 years.

    Thats an ROP plan... yes, that you can get it for $100/month.

    I am questioning your statement of "getting 1 million insurance for $100/month till the last breath"

    Pappu no need to ask People to do something. We all, includiing me want others to do the work and we just want to make annonymous remarks blaming IV. We must admit that we really like doing this. :) The original poster Endlesswait came to the site and blamed IV for not doing anything and went away without doing anything. This dude AlbertPinto is just saying many times that IV is not doing anything but is not doing anything himself. You have asked him to do somehing, let us see if he really does something.

    Like others, I will also not do anything and will be here to give my 2 cents. This is the easiest task we can all do. Isn't it?

    Also all said and done CIR still remains a controversial bill, that at the very least has to be debated at length in the house to send out the right signals. If it gets passed in the lame duck, the conservatives will go to town with their story that an amnesty has been shoved down the throats of the american middle class. I doubt either the president or the democrats want that at this stage.

    because he has to regain his popularity with the American people, and immigration is not a top priority for the American people, as all the election polls showed, and as the infamous Ombudsman on this site "reported" so often

    I and many folks in this forum have seen very few approvals for this category. How come USCIS says that this category is over subscribing the visa quota. Why they are moving un used visas to EB2 (no offense) why not for EB3?

    We need IV help in this area.


    If you have not contributed for the recpature funding drive, Please do so..let's move forward together and support IV to lobby the introduced bills first...there is no point in fighting among ourselves !!

    Dear friend

    It looks like you can show some light on my stuggle with ICICI bank to deposit money in My ICICI NRE account.

    Story is like this, I went to India this summer deposited money to several mutual funds from my ICICI NRe account. One of the investment (in franklin ) was wrong by the mistake of my agent ( because US person can not invest in some of the US based mututal funds and frankln is US based fund) So I had to struggle to get money back from Franklin, as it was not proper investment ( wer mentioned NRE US based in forms, so they should have out right rejected investment, but they alloted it and then I have to fght back to get it returned)

    Luckly due to my correct application I was able to get money back from franklin. they issued RS check, which I tried to deposit to my NRE account at ICICI bank. ICICI rejected check saying it is in RS. I tried to persue them it is REFUND FROM MUTUAL FUND (NRE INVESTMENT) from the same ICICI account but they still wants the proof that it NRE money. I have still this check bouncing back between me and ICCI bank. I also approached franklin to get letter. This time they have qouted some earlier RBI rule ( I have not read letter) and I am trying to redeposit that with check again.

    Here in this My bigger question is we all are investing lot of Money from NRE account in Mutual funds and other investment options available to US in India as NRI. but when it comes to getting money back in our NRE account ( naturally all returns/refunds from India investment will be in RUPEES CHECKS ONLY) then we have big trouble like One I am facing right now.

    SO DOES OUR INVESTMENT IS TRUELY REPRETRIABLE.
    WE CAN GET OUR ORIGINAL INVESTMENT AS WELL AS GAINS ON THAT BACK TO NRE ACCOUNT OR NOT

    IS IT THE ICICI BANK ONLY or ALL OTHER BANKS ARE GIVING TROUBLE wHEN WE TRY TO REDEPOSIT OUR MONEY ( in rupees) back to our NRE account.

    Please explain your experiences in this regard.

    If possible also provide links that talk in more details about REPRETRIABILITY OF NRE INVESTMENT

    Also let me know which is best NRE bank to work with without any such hassles in India?

    Guys,

    I just renewed my DL (9/06) at a local DMV here in NJ, I brought with me my bank statement/insurance, SSN card and EAD card. A nice lady just asked for my SSN and EAD. The whole process took 30 minutes. My DL has one year expiration. I am just waiting for my GC so I can go back and get a 5 year DL. Cheers.

    So, if there are 400k pending applications and recapture can get us 215K, has anyone done some analysis on how the 215k will be divided among countries and categories?

    Will this make EB2I current and EB3 I beyond say 2005?

    I don't think any analysis is done. That is only going to divide the community.
    Some would say preference be given to EB category benefiting EB2(I&C).
    Some would say PD should be given preference predominantly benefiting EB3(I).

    If they follow the current spill-over rules, as you are aware, EB category would be given preference.

    I have just kept GC out of the equation for anything I do in my life. Buying a house was a personal choice and I could afford one - so just went ahead and did it. If I have to leave the country for good due to some immigration related bs, my lender can suck it up :D

    You cannot keep GC out of equation when GC/non-GC decides your ability to get unemployment benefits, choice of jobs and many more aspects of your life.

    If you leave the country, you lose the equity on the house. I don't know when you bought
    the house. In the post credit bubble period, the lender will make sure you have enough equity that they are secure and you have skin in the game.

    In my humble opinion, if people who have been illegal in US for over 5 years are granted legality, then the govt should

    1) Close the backlog processing centers where our cases have been languishing for years

    2) Grant us green cards if we can show minimal proof that we did infact file for permanancy legally at some point in time.

    I mean COME ON guys..the government is giving legal status to more than 10 MILLION illegals in this country, yet when it comes to 300,000 tax paying, qualified, LEGAL, degree holding H1B workers, the same government is penny pinching and trapping us in a bureaucratic paper nightmare. What is 300,000 when compared to like 13 Million?? Its a drop in the bucket. Do not forget that our employers have paid big bucks for every H1B, and additionally paid for the creation of the backlog reduction center, where they are painstakingly poring over each and every case with a toothcomb.
