It was most likely due to the withdrawn underlying 140. Although AC21 protects you in such situations, I think it sometimes takes MTR etc. A whole lot of stress and money expended in the process.

Did you have to get it in advance or did you get it on arrival?
No visa required with GC. But, since I only had my AP, they asked me to get a Mexican visa ($36). The above rule must be new (no visas needed with non-immigrant US visas).

I am a typical EB worker and have all the insecurities of a person working on EAD/H1 in a distant land. Though gainfully employed seeing job losses all around makes me anxious. There is no back up if i lose my job as being on EAD/H1 does not give me any unemployment benefit, no breathing period though i have dutifully paid SS taxes without a break for last several years. With stock market tanking i dread seeing my 401K statement. Selling my House to move somewhere else might be very difficult, if not impossible.
Any setback on GC would hit me both financially ( money to spend on MTR, pay pricey lawyers , look for not so cheap health insurance, and biggest of all - loose the steady pay check )
as well as mentally ( to look for a new job, worry about same/similar classification, move to new place, unable to service my mortgage , put up with not so pleasant working conditions etc ).
I am away from friends and family so no psychological support as well when needed.

He will be out of status. Your 3 year extension beyond the allowed 6 years is based on that LC/I-140 from which your I-485 was filed. If the I-485 is rejected you have no right to stay beyond 6 years....
Total BS and Incorrect.
One can work on current H-1B (irrespective on basis it was approved), until the H-1B petition is revoked or canceled or expired. However, beneficiary is not eligible for new/extension of H-1B after I-485 denial.

Let us say I accumulate 40 points and return to India for good. Do I still get Social Security in India if -
1. I am a US Citizen living in India?
2. If I am a GC holder living in India?
3. I am neither a US citizen nor a GC holder living in India?
Any helpful links are appreciated. I have tried to calculate benefits using Social Security benefits calculator, but if you key in residence outside USA and non-citizen, it does not work...
With citizens of India, it is full penson benefits, what ever it is (earned based on contributions). You don't get medicare type of thing.
For citizens of countries like Canada, it is limited by windfall limits. People who worked in both US and Canada become elligible for too much retirement benefits and it is curtailed by limits.
So in nutshell, any treaty may worsen benefits of 10 or 10+ Social Security Contributers.

As per new USCIS reporting method of processing times, what this means is, they have COMPLETED processing applications received as of Oct-1-2007. This means, people who have applied for extension after Oct-1st should be getting their approvals these days.
I want to find out which dates currently they are at based on your feedback of your application date and whether you received approval or not as of today.
My case: Applied Oct-30-2007 Status: Pending

I was just thinking, the wastage of visa numbers we see, is that basically due to the per country quota. The rule that no country can have more than X% of GC's in a year, would mean that even though there are visa's available, they cannot be alloted due to that per country limit.
Anyway the smaller number of application is good news.

To give u an example, lets say they have to give x amount of visa, they just process x number of apps and at the end of the FY some people are still struck up in other processes like Name check etc. So those numbers who are struck up, get wasted.

Mine is also same case... I got my FP notice for Jan 9 2008.

Please let us know. I think some Xfr cases are now seeing FP notices, but not sure if they mean anything becuase, bay area, CA FP centers seem to be backlogged more than anywhere else.

I have used it. I-140 approved. Currently working on EAD. Got the letter from new employer mentioning title similar to both of my GC labor bassed application example: title: Title1(EB3 based - old app/Title2(EB2 based - New app). I will be using that letter to inform USCIS for my AC 21 usage. I am waiting for my lawyer to take that task into his hand.My both GC is based on different but close labor codes. Currently I have not decided to port PD to new file but once I decide the same letter will work for that as well. My letter just mentions title and salary and which department I am working and to whom I am reporting. According to lawyer there is no need to put "Job Description" at all in that letter. I originally got the letter with job description (matching both codes) but my lawyer advised me to remove "job description" and thus I had to take another letter.

As far as contacting AILA goes, could we have someone from core who knows them come forward and help us voice our concerns if we're able to gather some support for this?
This can turn into an ugly backlog pretty soon if nothing gets done about it. I read last month that they had 146k pending I-140 cases.
My point is not TSC or NSC - my point is we all sufferers should now unite and create pressure. I cant do alone , you cant do alone.
How do you want to contact AILA - why they should suddenly listen to a bunch of 10 stray immigrants like you , me ??

plz confirm regarding the totally diff name on BC. it was made a few days after birth. i guess i was renamed after astrological consultations. No name change registered. BC only has a 'first' (nickname i guess..it's not even my nickname)...lol i got switched at birth...kidding.

The coming back of CIR seems imminent - we need to step up lobbying/calling/faxing/writing. Is IV still have the lobbying firm support? do they have any specific suggestions so EB friendly amendments will be introduced/succeed.
With dates being current I think everyone will say - hey employment based system does not have backlogs why increase their numbers. This priority date movement is so complex its easy to mislead anyone.

I have applied for Advanced parole at the end of July 2007. My H1B visa is expired, but my H1B petition is still valid. Should I just take the risk of traveling and try to get H1B visa renewed to re-enter ?

I just received an RFE for my dang travel document as well. They want copies of all my passports, with arrival/departure stamps and more photographs. I travel abroad every other year so this may have kicked off the RFE. I'm sure all the lawyers are loving the RFE's. I cannot believe we have to go through so many hurdles for just a I-131 travel document. It looks like they are going to make us work for our green cards. :confused:
