    Who gets FP notice? is it attorney or us?

    We also filed on July 2nd at NSC.. got EAD and AP. buit no sign of FP yet. we were also out of country for last 3- 4 weeks. Is there chance we could have missed it?

    I would strongly urge everyone to file for canadian PR without any agency/lawyer. Just visit cic.gc.ca

    Fill in the form and send them asap. They will keep coming back if they need more docs. Don't rush for FBI report [fingerprints] as they are valid only for 6 months. They will ask for it after everything else is in order.

    Your total expense per person starting from start to finish ....about $ 2000
    It includes initial fees, medical exams, landing fees etc.

    Your total time could range from 1.5 years to 2.5 years depending on the case.

    Its the same for my wife too, TB and xray RFE.
    I will have act act fast on this.
    On a last note, do you know how much you paid for the TB and XRAY test in your city?
    Was it covered by any insurance? or any method you can suggest to let insurance cover it?
    Thanks again for your prompt inputs!

    TB, XRay and Physical was 150 $ for me. Since I had (and you should too as USCIS send a sealed envelop of the medical exam) previous medical exam they were able to get the immunization records from that.

    my PD is April 2006, so i guess i would need to wait 1 year to get the dates moving, since it would be quite a huge backlog clearing up

    My apologies if this is not the correct thread (but I think it is related).

    It has been a month since USCIS received the response to a EVL related RFE issued to me. I verified the receipt date from uscis.gov. Does anyone know how many days it takes (on an average) for them to decide upon such RFE? I am trying to make sure if it is too late and I should request an appointment through infopass.

    So you mean I should not even think of invoking AC21 EVEN after 180 days ?

    go ahead and invoke AC-21, you are not necessarily going to run into the problems that poster faced (in fact based on anecdotes on Forums the AC-21 related denials by USCIS have gone down a lot since 2005, probably because of the yates memo that came out then calrifying all this). Try to stay on H1 as long as possible though (you dont HAVE to use EAD to invoke AC-21 and change jobs).

    At the end of the day a lot depends on your luck. Some people get unlucky and end up with all this nonsense, some people end up getting caught in namecheck... they are both thankfully a small percentage of the cases, so dont let your career choices be decided by what USCIS might do. Take precautions where possible (staying on H1 etc) but do what you think is right for your career and family. The whole point of this AC-21 clause was to provide flexibility to the employee, make use of it.

    P.S: I am also planning to invoke AC-21 to switch jobs.

    Thats the confusing part

    This seems to indicate someone else will get benefit payments but not the worker himself / herself.

    This part refers to family benefits, i.e. payments to spouse based on your SS contributions.

    Question: Why Canada is not in the list of countries?

    Good Afternoon IV members,

    Best wishes to all of you who are seeking advice or are in a visa process of any sort.

    My question here if any one could kindly help me: I came to work in 2002 with a J1 visa, stayed for the 3 stipulated years under the J1 visa. I wanted to changed my visa for a H1B so I got a waiver, and then I went through the process the year that they had the lottery for H1B, I made the lottery, but sadly after paying all my fees, sending all the documents that my lawyer asked my employer for that time, I did not obtain an H1B.

    Last year I could come back with another J1, I stayed in my country for 3 years, so my new employer applied for a J1 without using my waiver, as there was not need for it. Now my question, I do want to change my status from my present J1 to an H1B, and I would like to know if I can use the previous waiver that I obtain with my first J1 in order to waive the 2 year residency restriction on my present J1 so that I could apply for the H1B with a new employer?

    Any advice is greatly appreciated.

    H1-B slavery: the American nightmare. Why would a major corporation deceive recruits only to end up with seriously unhappy employees with a serious grudge against their employer.

    Well...You are definately not a slave....
    You can walk away any time you like......
    In the end it is the individual's decision...

    Calling ourselves as slaves opens up whole new can of worms...

    There are MS Access database files for each year.Depending on which year your labor is filed, download the Access db.

    For eax, mine was Dec 2002.I downlaoded 2002,03,04.My record was found in 2004 database.

    If you open the Access db (You need to have MS Access to view these files.If you dont have it, downlaod the free trail version from microsoft.com)

    If you open the file, it is the database of all the Labors that are filed in that year.One of the attribute is the Employee name.You can also search on Attorney name.

    If I were you, i would first filter on Employee State and then search for the Employee name.

    Its simple.Try it and let me know if you need further help.

    I agree with you map_boiler. I have also seen from some other thread that some one with EB3/India/Apr 2004 PD got approval in July. If the July bulletin is void , How can they approve that ?

    You are right , It looks like they approved cased with NO PD but with ready FBI check and also requested numbers for the current PD but sec check pending.

    If a APR2004/EB3/India can get approval after Jul 2 , How can they reject EB3/INDIA/DEC2003 but filed on Jul2 ?

    Returning numbers raise whole lot of questions. It remains to be seen how they try to untangle this mess.


    I guess i dont have a PD as old as some of the other folks , but Its been 3 yrs since we applied to 485 and still waiting on some news. 3 FP's. 4 EADs and not a single update online. Am i STUCKKKKK..
