    Ron is a very decent guy, he is not my attorney but he has helped me with really good advice that helped me a lot.

    Once I posted a question during the weekend and asked him a very specific question (My attorney was out of town) and he not only gave me the right answer but also posted detail information about the actual law behind it. Beleive me I needed the answer that weekend.

    Every law firm wants clients but most of the lawyers would charge you $200 or $300 for 1/2 session, I know this becasue I have done this as well.

    Ron answers your questions on his forum with out any charges, anybody can see this if they go to his site.

    So you think he is "speculative", who isn't??? Why don't you name a lawyer who can "speculate" the visa bulletin correctly.

    I would keep your thoughts to yourself.

    Stop advertising a lawyer. I find him very speculative. He wants everyone to come to his site and you are falling for it.

    With Prime Minister Manmohan Singh�s government finally moving forward on the Indo-US nuclear deal, the Bush administration is also demonstrating its keenness to resolve other crucial bilateral issues in India�s interest. A long-standing Indian demand for a social security pact that allows Indian workers stationed in the US to bring back their contributions to the US Social Security system on their return to India, is close to being met.
    Over $1 billion of contributions to the US Social Security Fund are made annually by an estimated 80,000 �detached workers� from India working on consultancy and onsite assignments � each one has to contribute at the rate of 15% of basic salary. However, when they return to India, these contributions are forfeited as the minimum period to qualify for pension benefits in the US is 10 years (the same is true of India as well).
    After a series of meetings between Indian officials and the US Social Security Administration as well as a senior White House official in Washington last week, Indian workers� annual donations to the US social security fund � which currently has a $4.1 trillion deficit � may finally come to an end.
    �We are close to sealing the pact. Indian workers who spend three years in the US would get a refund of their contributions to the US pension system. Moreover, the pension will also be portable � once a worker completes the qualifying period of 10 years, the pension will be payable in either country,� a senior government official said.
    The US has such �social security totalisation� pacts with 22 countries, whereby workers who spend three years in the US hold on to their pension benefits as the 10-year qualifying period takes into account the time spent by workers in their original country�s pension system. India has recently signed such deals with Belgium and Germany.
    �If both US and India have bilaterals with a third country, the totalisation and portability principles will apply in those cases as well. So a worker could spend 4 years in India, 3 years in US and 3 years elsewhere, without losing retirement funds,� the official added. Bilateral talks on the issue had intensified after Singh and Bush issued the joint statement on July 18, 2005 to move towards a new strategic relationship. Last December, the US Social Security Secretary visited New Delhi, but little progress was made. Under Section 233 of US social security laws, international agreements may only be arrived at with countries with a �generally applicable� social insurance or pension system.
    Between December 2007 and now, India has made some progress on this front which it convinced the US administration about. The Unorganised Sector Workers� Social Security Bill has been introduced in Parliament as well as reviewed by a standing committee. The Rashtriya Swasthya Bima Yojana has also been kicked off.
    �It has been an intractable wall we have been chipping away at for years, but this time, we feel they are convinced that there is a sound social security sytem in India,� the official said. If India succeeds in formalizing the pact, it will be only the second Asian country after South Korea to do so. Once signed, the US President will have to report the deal to the Congress with a report on the estimated number of individuals affected and its effect on the Social Security fund�s flows.

    stupid comments considering one could say the same about IV if looking at it from the perspective of some of the posts here.

    If you have nothing nice to say, maybe saying nothing may be the nicest thing. Sometimes links like this are actually very useful - especially to people coming here for the first time (or first few times)

    You can do hero worship of your lawyer whoever it is. I will not.
    Ask him/her if he will do advocacy effort for you or sue USCIS since all his clients are struggling in the long wait and spending a lot of money on immigration consultations, fees etc.

    Ask him if he contribute to IV instead?

    Ask him to give you priority instead of your employer who gives him business every year.

    Ask him why AILA is not giving you regular updates through him. As clients of lawyers we should get regular updates and prompt responses. What are they doing about country caps removal, end of retrogression, recapture etc. I mean they are so powerful, so why can't they do it for us so that we no longer need lawyers and save a lot of money? Arn't we all spending thousands of $s on immigration attorneys ? and only few of us pay only $25 and many are free members and get such a good service from IV website. We all hate to pay a single dollar to IV and accuse IV core of asking contributions every time there is a drive but IV still helps us. They need to learn from us.

    Why none of us has the courage to do it, but we have the courage to trash talk IV and blame its core for not working hard enough for our $25.

    Lou Doubbs is not a conservative but an idiot and a crook. He is a protectionist like the unions in America.

    When it comes to skilled immigration, conservatives have been good. Sen John Coryn, Ex-sen George Allen, Sen. Sam Brownback etc. have been the sponsors of SKIL bill and like. We can depend on them to fight to get SKIL bill included into CIR when it comes up.

    Our problem has mainly been with rabid anti-immigrationists like Sen Sessions and also protectionists like some in the Democratic party.

    It not between Conservatives and liberals in general.


    Wash Times is as conservative as your Lou Doubbs... I dont trust them...

    Hello Everybody,

    Due to budget restrictions, I may be getting laid off from my company soon. I have filed for I-485 and have received EAD. I am currently on H1B. I have a citizen friend who runs his own company. He has no employees. He does pretty much all work by him self or get it done by hiring outsouced help whenever needed. He has a legitimate company - but he does not have big revenue (May be 100K/ year). Would it be okay if I join his company on EAD to get my GC going or should I look for a firm that employs lot of people and has sizable revenues. What (if any) are any risks?

    Hello,

    I am sure others might have noticed that 485 processing dates at NSC (for example) have literally crawled from the beginning of the year to now. Here are the processing dates (per USCIS status).

    Thats roughly 9/10 days worth of 485 processing from mid-Jan to mid-Jun 2008. I wonder what the processing date looks like for the mid-July status update (which should probably be out tomorrow).

    With regard to HSMP issues in UK some Indian Minister (I think PC Chidambram...) made a public comment a few days back and the political establishment in UK took notice.

    For US, people need to write to India's PM Manmohan Singh. If 50,000 letters go to him then he will talk to Bush and something can work out. NRIs anyway have a lot of say now in Delhi unlike 10 years back when they were totally disliked. Just wasting time on chat boards will lead to nothing. Even Microsoft and Intel are unable to convince politicians here. It has to come from a higher authority with whom there are mutual stakes involved. Manmohan Singh is the only guy who can help here because today there are several mutually important and high stake issues between India and US.

    I am really sad to see people questioning IV core members who have sacrificed so much for just a article in WSJ where legal immigration is not mentioned by lobbyist.I feel really bad that they have to prove themselves day in..day out.

    How about the reverse change of status ? A person currently on H1 visa decides to resign from company & wishes to go on H4 (spouse has H1B extension applied for). What is the time frame in which the H4 has to be filed for .... with respect to resignation .... before resigning or after resigning .... is so within how many days of resigning. How does this person know if he/she is in status as H4 approval might take months .... Will the spouse's H1B extension receipt notice be enough as the approval might take a while.

    I am not sure. There are two red flags I see in this argument. The first is that for your wish to come true next 4 years you need only 30K GC labor to be filed. But analyst are predicting recession to be over by this year end or 2nd qtr of 2010 after which hiring will start and also the whole GC process. The second argument is in 2009 we were in recession with 30K apps filed but we did not see any huge jump in EB2 numbers if this bulletin had put dates in 2006 range then we could have said that the spill was really large. Looks like the spill was not huge since every one knew that EB2I was always somehwere near 2004. all they did was put it all the way to cover entire 2004.

    Due to the economic downturn there aren't many companies sponsoring GCs for employees. I doubt it would be more than 20 to 30k per year from now. This leaves 100-110k visas available every year for retrogressed countries like india and china

    if there 300-400k pending GC applications in all categories then shouldn't all of us get our GC in next 3-4 years?

    Hello,

    So yesterday (Saturday) was another surprize, a pleasant one again! I got a call from the same IO who told me that he got all the documents that I had sent and has cleared my case for approval, but now my fingerprints have expired.

    He asked if I could come right away to his office and he could give me an instant fingerprinting appointment in the nearby INS office. When I told him that I'm currently out of country on business trip and won't be back in US till April, he said he will send me an appointment near April 15th.

    I thanked him for his follow-up and he said he was just doing his job. I know this might be an exception than a rule, but just wanted to acknowledge this particular IO and hope there are more like him.

    when u say "cleared for approval" does that mean u are all set to GO GREEN ?

    So after more than a month of sleepless nights, thanks to Immigration Voice looks like my I 485 application is back on track.

    A recap of my situation:
    Last month I got an email from USCIS-CRIS stating that my I 485 was withdrawn. After being in this country for close to 10 years and in the immigration queue for more than 7 years why would I withdraw the application ??? I did not withdraw my application !!!

    It took me more than a month to find out the reason behind the withdrawal..trust me it was not easy..and guess what ....It was my Attorney who had withdrawn the application in Error. Now what ... I call USCIS multiple times.. talk to many different IO's .. some of them patient and try to help.. some extremely rude.. but all of them had only one thing to say... they cannot help!!..... I get an Info Pass... no help there either.. I set up an emergency meeting with my attorney (one of the large Immigration Law Firms) .. nothing...they accept their mistake tell me that they will do all they can .. but no assurance that they will reinstate the case .. limited forward movement.... things look gloomy and bleak..no one can help me.

    Then I called Immigration Voice on the number that is listed on the site and left a voice mail. Promptly got a call back I spoke to a Core member who understood the gravity and urgency of the situation and swiflty moved forward and got in touch with their contacts in the government. The Core member also put me in a conference call with the person who was going to look into my case, I was so relieved that I could explain the situation first hand.

    I got a call today and I was told that after evaluating my case my file has been reopened and they have mailed an offical notice regarding the same and I should get it in a few days. *Fingers crossed until I get this notice in hand *
    The IV core was extremely sensitive to my situation and were very responsive and extremly helpful. I cant thank Immigration Voice enough for helping me resolve this issue in a quick manner.

    I have registered to be a recurring contributing member and I intend to be an active member of this group.


    My lessons from this crazy experience are:
    - Never trust your attorney, always ask for a copy of any letter/document they send to USCIS on your behalf
    - There is no organization besides IV out there that is looking out for the interests of the Immigrant Community.
    - We need to strengthen IV in all ways we can, we need to be active.
    - And as so many members have already said "We are IV." If we want things to be better "WE" need to do something about it.

    I urge members who are still contemplating becoming active members to evaluate their options and to become active and contributing members of IV.

    Another point I would like to add is that no other organization has the kind of reach and the credibility with USCIS as IV has as far as representing the true interests of the Immigrant Community goes. IV is a huge asset we have and we should work towards strenthening it.
