Despite all my attempts, nothing happened at NSC. The last resort, Local Congressman helped. The staff did an excellent job, resolved the issue in a matter of hours. Not only my EAD was approved right away, they also arranged a Letter indicating that my case was approved, so that I can present it to my HR.
Before I called the congressman's office, I did have very little or no hope, as I went thru many things. This is a very happy ending.

How about if I send in Ac 21 paperwork and still be on leave of absence from my present company which sponsored my GC. It only gives me peace of mind because in case the new job does not work out I can still come back...
If you will be using EAD for new job, stop worrying about vacation. EAD is a "AOS" state meaning you are legally allowed not to even work so you can very well take vacation and even decide not to work till you get the green card. If you are playing "h1 transfer" then your vacation may become tricky if you do not get salary for that vacation. It may have an advese effect down the road. If I would be you and have decided to use H1 transfer then I would not go to unpaid vacation. If you will be paid for the vacation you will be fine for that too.

Anyone reading this thread who was able to file the 485 in the July/Aug window. These questions are particularly directed at you. I know some of them are rhetorical, but I want to provoke a little thought.
1) Do you consider this(having filed 485) to be a better situation for yourself and your family?
2) Do you consider that IV advocacy and lobbying, flower power, media attention etc played a large role in this reversal?
3) If instead of what happened, they had instituted a policy where you could file 485 while retrogressed if you pay a $1000 extra filing fee per petition. Would you not have done it?
4) If you answered yes to all the above questions, Can you find it in you to do the honorable thing and contribute something, to say thank you.
We had atleast 320K 485 filings, if just 10% of these people contributed something, anything at all, money would not be an issue. Why is this not happening? There should simply have been a better response to the request for donations. Forget about the other guy, you just do your part, even if you did not do it before you benefited, do it after you did. Do it because it is right. Do it because, the more you do the better your chance to get further. Remember nothing invested, nothing gained.

I always loved this board for what it does - especially the Gurus who always spend their precious time giving input to member's queries. Well... this is not query. I just want to vent my frustration, helplessness to fellow friends in this board. In spite of graduating from a reputed univ with a Masters and very good GPA and also having 7 years of professional experience, I am bound to be a slave to my current Employer without any promotions, career growth or anything remote to that for next (God knows how many Decades) several years. ppl who are junior to me in every aspect are growing left and right and are also getting brighter opportunities. I dont care if you guys think I am jealous of them.... But does God really exist ? sorry for wasting your time with this depressing note. I guess there is a limit to how unlucky I can be !! call me a cry baby but I am one real unlucky individual !

It is just the worst feeling of hopelessness and constant worry because you don't know what's going to happen and when is it going to happen, and you can't even do anything with your life because you don't know the outcome of the whole thing. I know exactly how you feel. I finally got my GC this year but I think what I went through I will never forget. I hate it when people try to make others feel better with story examples of unfortunate people from poor countries or alcoholic parents or whatever stuff of that kind, because no one who is going through something so emotionally charged as feeling like a caged bird with no future is going to take those examples and all of a sudden go AHA and feel happy, however, as someone who was where you are and who waited for over a decade to get to the final point, I can tell you what I now know I should have done while I was waiting. I should have learned a language, I should have read more, I should have acquired more hobbies, I should have learned some extra computer skills. I finally got my card and I have to start from zero because I spent so much time just concentrating on my job and my misery and on other superficial things, and now, in order to finally move on I am home on the 1st of the year surrounded be a million "how to" books in order to be able to learn new things and get a better job that is obviously going to require more skills. The only thing I give myself credit for is starting an "after GC goals" list, because I have been doing things I always wanted to do and enjoying it, and crossing them off my list.
Also, I don't think you're really being jealous, I think you're just upset that other people with similar or less skills than you get to move on to better things, and that's really, very normal. I was there too, and tons of people on here go through the same thing. Life is unfair that way sometimes and it's all about how you make your lemonade out of lemons. So, my advice to you again is to use this waiting time to learn new things, even if you practice calligraphy, just keep busy, do something, so when you finally reach the end of the line you can say, f this, this took forever, but at least I don't feel like a damn loser.

I am confused about the status of my application. I had concurrent I140/485 filing under EB3 on July 30th at TSC(with PD of Dec 2004).
On May 9th I got a CRIS notification that my I 485 case has been transferred to Lincoln, NE -I am assuming it is the Nebraska office.
However, I am more interested in tracking the I 140 status.
1. My RD for I 140 is July 30, 2007 and ND is Sep 26, 2007. Online status still shows being processed at TSC..so which tracking dates shld I follow..is it the RD or the ND?
2. Even though it is concurrent filing, I am assuming the I 140 case is treated independently and is not tied to the I 485. (PD is very far EB3 Dec 2004, but I 140 still shows at TSC)

I agree with the analysis given by willwin. In fact, I was thinking on similar lines. If no visas are wasted and total number of pending employment based visas is around 200,000 as given by Mr. Op.. himself, I do not see any reason why dates do not move. My estimation is both EB-2 and EB-3 dates for China and India will hover in the range of 2005 ~ 2006. This estimation is based on number of applications filed during Pre-PERM and Post-PERM era with two recessions taking the toll on number of applications received by USCIS.
Only assumptions in the above analysis are
1. Figures given by Mr. Op.. is somewhat correct. (Seems to be correct based on monthly statistics released by USCIS since 2008)
2. USCIS does not intend to waste visas.(This also can be safely assumed as they are following the policy of not wasting for the last two years)
3.No country limit. (This seems correct if point 2 is correct)

Well my story isn't really as bad some of the stories described here but the last 4 years of waiting for the freaking LC to clear has pretty much screwed up my wife's career. There have been days of utter frustration, fight and bad days for us because of the "dependent" visa.
Its not like my job is great either. I am stuck in the same position for the last 5 years because of the freaking labor certification. Looks like I will be stuck for another couple of years. If I bail out now and leave for India it will be hard to find a suitable position because I have been unable to move up because of GC and at the same time my wife will have the impossible task of finding a job after 4 years of unemployment.
For this reason I am wiling to gamble at least another year or two, so that my wife can work and I can get a better job and then we can start thinking about where we really want to settle :) Gosh, never knew trying to settle in US with a GC will be so unsettling :(

That one phrase in your LC requirement could turn out to be a life saver for you. Can you further clarify the educational/experience requirements mentioned in LC. Was it Masters or equivalent with zero experience OR Bachelors with 5 yrs of progressive experience? Your educational evaluation should meet atleast one of the requirements mentioned in the LC. Either Masters or Bachelors + 5 yrs exp. I think for your educational background (non 4 yr BS degree), I feel more comfortable with getting the evaluation done to satisfy the BS + 5 yrs requirement rather than going for Masters equivalent. NSC is known to be strict w.r.t 3 yr BS degree when it comes to EB-2 cases. However, since your initial evaluation showed you as holding a masters equivalent, I am not sure if its a good idea now to try to defend your case with BS + 5 yrs equivalence. A good attorney would be able to guide you through with this. I also suggest you to consult any reputed attorney regarding this and get feedback on your company attorney's plans and not just blindly follow what your company attorney says.
