my labor has to be pending 365 days or have an 140 approved to extend. so if pp goes away for 140 then my only option to stay in status is EAD. Also I am not in IT so patni,tcs etc...is out of question.
If you had a approved 140, you'd get 3-year extensions. If it is pending, you could still get 1 year extension.
While I'm sure about this rule, you should check with the attorney.

Sorry to hear this. Regarding medical insurance, your company has to offer you COBRA..you will end up paying almost twice the premium that you have been paying so far, but it would still be better than you footing the delivery charges (10k - 25K). Continue CORBA atleast till the deliver and post-partum - for as long as possible..
Terminating you in your ninth month pregnancy is probably against the law, i think if you can prove it, you might be able to sue your employer, check your local state laws..

When adding my wife to my medical coverage provided by my employer, my wife was pregnent, I did a bit of reading up, most of the group insurance policies offered by employers does not consider pregnancy as pre-exisitng condition. That is the major benefit of group insurance policies. If your husband is working in the west, Kaiser
is the way to go!
As mentioned in the above post, employer should offer CORBA, which can be your backup.
Always remember that tough times will always pass!! just hang in there!

Looking at the Labor cert , it says "Masters degree" and NOT "Masters or equalent". that might be the caused the I140 denial .

I will be in the same boat if I don't see my 9th year H1B extension before end of next month. NJ DMV must have some interim provision for individuals like us.

all i can say is that your situation sounds like an illegal situation... if you are simply going to provide offer letter without actually having a job... but thats between you and your company and you may be perfectly legal and fine... check with a lawyer dude

I think you should go to either Eatentown( Exit 105 on GSP). Before they started accepting all immigrant applications at all DMVs they used to ask every one to go there. I think you may be able to get a temporary extension for month or two.

I am trying to understand something here..... I had consultation with murthy lawyers and they told me that there is no law written anywhere that states that the employer must revoke I-140 if the employees is laid-off or is not working with them anymore. I was laid off and my company is determined to revoke I-140 because thats what Fragomen lawyers suggest. I am having a hard time understanding why would they want to cause problems for me when I am not even leaving on my own and got affected because of layoff.
Does anyone use Fragomen and could ask their attorneys this question whether a company is required or obligated by law to revoke I-140. That way I can try to convince my company's attorney that another attorney within same law firm have different opinion

New DL renewal Procedure is a painful process which started August 1, 2006.
The process involves;
1. Visiting a DMV office and they will ask for your documents and give you a case number which you will present to MVI.
2. MVI will investigate your immigration status with USCIS and you will receive a letter after 5-7 days. If there is a problem, it will take upto 9 weeks. This means, you cannot drive until they have verified your legal status in the US.
This is a new procedure and I know a couple of friends who currently cannot drive because they cannot renew their license.

Bingo! I was about to say this -- Under COBRA, govt will pay 65% of the payment. I have been to this boat before and COBRA is extremely expensive (~1500 dollars a month for a family of 3).
Also, you need to talk to a lawyer! Desi companies....what can I say.... no company should terminate anyone in the 9th month of pregnancy.
Status wise both you and your husband are OK. Just make sure that both of you renew AP and EAD on time.

I think that is enough transparency. There will be more when they file tax returns.

chandrajp, many times it's not because of rules. It is common courtesy to go to a cafeteria if one is available. Smell of Indian food in general (it's a fact not criticism) may have a distracting effect in a work location so it should be eaten in a cafeteria (if available). Also, we need not emulate other people's lack of courtesy and do the same thing (like some people quoted Americans eating burgers in their cube). If we have the option, we should eat in the appropriate location.
In addition, with respect to discrimination, I do not condone it at all but we need to do a reality check for ourselves as well. I have never worked in India since I left the country 10 years ago but my friends working in India have told me how their managers have humiliated them by speaking in a regional language in meetings that they didn't know. So wherever there is a difference of culture, language etc., unfortunately human beings tend to behave the same i.e. discriminate against others who are different from them.
