Folks...it looks like I have been given membership to this exclusive club, by USCIS...:)
My status on USCIS Online case tracker shows,
"Current Status: Fingerprint fee rejected and notice mailed; case in suspense."
When I spoke with my attorney, he says, There are two options.
1. I can dispute and in turn get my processing delayed
2. Repay the fingerprint fees ($70) and forget about my first payment
Naturally, anyone would prefer option - 2.
Just wanted to share with you all...
Before I read the whole thing I thought why this guy is even thinking about it ... Know what I mean ...:) I read the whole thing and thought this guy is as smart as me ... hehe ...Good luck with everything

The bulletin is 2 years old (if that is considered old, given the GC standards). However, no new bulletins have followed to void it. Unless I have been advising with the wrong lawyer and wrong GC applicants (many), there is no such thing as I-485 Approval before the name check is completed. Any third party would like to comment?
Of course, they will not "approve" your 485 before your name check is cleared. You misunderstood me or I was not clear. What I meant is this: if your name check is not cleared but all other work on 485 is finished (which I think I equated to clearing the 485 in my previous post; sorry), they will tell you on phone (if you inquire) that your 485-related stuff is complete, but we are waiting for the name check. (Also, they will wait for your PD to become current).
My main point in the original post was that if it takes them 2 yrs to check your name --- the name-checking process runs concurrently with the 485 process --- then the 485 is bound to be complete by the time your name check is cleared. The processing times of 485 can be gauged from the VSC (or relevant center's) bulletins. Those proc. times do NOT indicate the processing times for the name check. If the name check happens before the 485 process is cleared, great! If not, you wait for the name check; lots (and believe me tens of thousands) of people belong to the second group. I was just thinking, the wastage of visa numbers we see, is that basically due to the per country quota. The rule that no country can have more than X% of GC's in a year, would mean that even though there are visa's available, they cannot be alloted due to that per country limit.

I dont think you need to be worried. my friend( Came to US in 2003 after working in offshore with the same company for 2 years, but his company filed his GC only in 2006) got this interview in March 2008, they reviewed all his papers(W2's, Birth Certificate,all Employment letters) and said that its ready to go when PD becomes current. His PD is 2006 March ( Perm),EB3, I 140 Approved , and now he is waiting for his dates to become current to get the GC. His case is pre-adjudicated and is ready to be released as per USCIS. His attorney didnt go for the Interview.
One of friend attend the interview in Feb. 2008 his PD is Dec2006 EB2,they asked him his birth certificates,W2,recent pay slips proof for his current employment, after the interview they told him that your case has been approved but you need to wait until your PD gets current.

Guys and Gals,
I decided to go with my credit union and called them this morning to lock the rates. I just received some disclosures and rate lock agreement, when I was reading it, there was a section where it asks "Are you a U.S citizen?", loan office assumed that I'm a citizen and checked the box.
I understand that I should tell them the truth, but wondering if that may increase my interest rates. Please share your experience or advice you may have for me.

While I do not want to sound discouraging or pessimistic, this is a very good idea and we must do things like this.
Now, it is just not enough if we make this suggestion and discuss it - we must walk the talk. Will we?
To start with, we can do a lot of stuff, get our co workers, families, friends etc.. involved, print flyers, send emails, post blogs, make videos and post them on youtube, hold local community events and increase awareness.
Our own community is still very ignorant and is indirectly working against us, lok at this post on immigration portal

Friends, my question was timing of porting priority date, to put the question in one line as below,
Earlier I-140, PD Mar 06 from company A if i file new I-140 Eb2 from company B, i am aware that i can port priority but the question is when this can be done, when I apply new I-140 or when after I apply new I-140 or after i get my second I-140 approved.

Recently I spoke a IO at NSC and she specifically told me that the local office does not see if its assigned to an officer or not. All they see is what room it is in. Ironically, the rooms names are like name of a person.
So it may not be with an IO realistically. The infopass information may not be the best answers you get.

It was estimated by Compete America that if the last CIR had passed there would have been more than 500,000 visa numbers recaptured ( don't ask me for the math, I didn't come up with this number). Assuming that the Nurses took away a chunk of it, we still would have a big chunk to statify Eb3, Eb3, ROW, India, China etc. etc. And the nurses are going to walk away with a big chunk folks - whether we like it or not - because we are fighting each other like dogs for the scraps of the spillover, while they will come up well organized and walk away with the cake.
Our disunity, lack of long-term vision, lack of action is our biggest weakness. We will not win unless we fight this together.

I was just wondering, do you have that much paitence to start all over again. It is going to be another 10 years , if you are sent back in the line.
I am in 9th year extension with priority date 09/2002.
My I-140 denied on 06/18/08n and immediately I485 also denied.:mad:
I have Visa vailid till Jan09.
1.If I change employer and able to get labor cleared before jan09 , can I apply for I140 PP and get H1B exension.
2.Is the Priority date transferrable if I change the employer?
