    Do you have a link to support upgrading databases til Oct 29?

    hope you are right my friend. EB3->2 are handful (no point really in going ballistic on them).
    Thought there were lot of BECs clearing out the older PDs and that's why they are shutting doors on us. And, of course, their databases are getting upgraded so they are stalling the process till Oct 29.

    My current H1 is expiring soon. My 3 year H1 extension is pending. I had receipt notice but NJ DMV at Wayne refused to accept that. My current License is valid only till the middle of the next month.
    Any body in the same boat? What shall I do?


    My friend was in a similar situation last yr, He took his all his documents to Trenton DMV and they have given him 90 days extension.

    Try that, Good Luck

    Other Option is convert your H1 Extension to premium and get the approval before your H1 expiration date

    Comparing with Gandhi ji's struggle makes no sense. When discriminated, he refused to cooperate. Refused to buy "monopolistic" foreign clothes, salt.
    H1-B is noway similar to that. H1B can choose not to put up with discriminating employers, rules etc and chose not to work in an economy which is exploitative.
    Once H1B stop putting up these rules, employers with think we need to do something to attract foreign talent. Till then why bother to lobby for change in EB rules.

    Note: I approve of free trade but in those days it was all one-sided monopolistic trade where Indian consumers had no choice but were forced to buy British goods.

With comprehensive immigration reforms on the anvil in the early part of 2006, the time to act is now. However, with the current political scenario and the overpowering debate about illegal immigration, this is going to be an uphill battle. We have already initiated talks with professional strategists who have in the past been able to achieve goals similar to the ones we are working for. We feel that these are the following ways a professional strategist can help:
    1. Identify feasible goals that can be achieved and are representative of the people in this forum. We should not have to piggy back on H1s or illegal immigration - we need an identity of our own
    2. Identify the champions amongst the lawmakers, alliances, organizations who are willing to shoulder some or all of the responsibility in passing provisions to solve retrogression & address labor backlogs centers.
    3. Identify opportunities to meet/interact with those mentioned in point no 2.
    4. Help us in putting our points across cohesively and in a way relevant to the political situations
    5. Keep a close monitor on the progress and the situation so as to identify the opportunities as they arrive.
    Hiring professional strategists requires several thousands of dollars. If we hope to counter some of the anti immigration propaganda, we have to accumulate funds to the tune of atleast about $100k.     I talked to USCIS information center at (202) 272-8269. They asked me to submit Form G-639 (it is available at www.uscis.gov --> under forms section). It has all the instructions to request the copies we needed.

    Everyone who changes jobs under the protection of AC21, must do so under the assumption that the sponsoring 140 will be revoked.

    It is not a matter of our convenience. If you quit the sponsoring employer and he has no intention of hiring you again after your GC, then what is the sense in him retaining your 140 for no reason? It only adds complexity to some employers as dangling 140s are counted to evaluate their ability to pay. So even if it is not law, it makes sense for employers to revoke 140s of employees who quit them.

    AC21 protects you from such a revoked 140. We have seen some cases where revoking the 140 - even after the 180 day mark - has resulted in 485 denial. This is a mistake from CIS and is easily fixed.

    Expecting the previous employer to hold on to your 140 is not very different from expecting him to keep your you previous job open for you - just in case.


    That is right. I am in same boat. My previous employer says - "if you want to come back to the company, we can start the GC process new and fresh for you, but if you are not on our payroll, we will have to withdraw the 140 because we do not want to get into ability to pay issue"

    My only concern is AC21 letters not getting into your file and USCIS issuing a NOID or a denial.

    You just had diploma and filed in EB2 to get GC fast. I think you took unnecessary risk of filing in EB2. It was sad that no one advised you at that time. If you would have filed in EB3 then CIS would not have asked much questions and approve I140 and I485. Anyhow you still have chance to fight and win but by the time you get GC you may lose lot of sleep. Probably it is worth to wait more EB3 than getting so much stress in EB2.

    I don' think they should have been rude. However they do have a point. He should NOT have shown BOTH H1b visa and AP. You can enter on one or the other.
    I have entered on AP previously and my experience was very good. Only thing is you have to undergo that "secondary inspection" process where they have to verify your pending status details.
    When you hand them both, you might feel you are doing it in full disclosure,
    however they perceive you are not clear in your intentions. When you show them your AP, their main verification is, whether this 485 case is still open and pending. With H1b they want to know if you are working for your visa petitioning employer.
    The morale of the story is, if you have availed yourself of AC21 and moved into another job, you must use AP to reenter, either that or if you moved with a H1 transfer you can use that, however, presenting your old H1b is asking for trouble. H1b is employer specific. We always need to remember that. AP is not.

    I intend to travel to my home country I have H1 (not stamped but valid till 2010) working for the same sponsor if I use AP to enter US do I lose my H1 status.I have EAD but did not use it.

    I received my EAD last month. But no AP yet. However, i received an email from my lawyer today that.....my AP got rejected. The rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....but my lawyer told me that I can expect my card soon.

    I don't know how to react. The online doesn't have any update about the I485 status yet. They received my application on July 2, 2007.

    My company has offices in both canada(toronto and vancouver) and US .. i have worked for extended periods of time in canada. I agree that career development oppourtunities are limited due to economic reasons, but I there is no way toronto or vancouver can be considered "racist". And talking of high skilled workers, who said there is absolutely no discrimination in the US ? Isnt that what programmers guild and other labor unions are all about ? how come so many people support the blue collar illegal aliens (mostly meat-packers and lettuce pickers), but nobody cares about us, tax-paying, law-abiding highly skilled people ?

    The difference is at least the canadian immigration policy doesnt institutionalize the discrimination by making us wait in limbo forever, unlike the US laws. At the end of the day, I would rather live with "limited career development" opportunity in canada and change employers at will than be surrounded by plenty of such opportunity but have my hands tied behind my back by the US laws.

    As for "discrimination", we as immigrants always will have to bear with some discrimination,subtle or overt, from the native-born white collar workers whether in the US or anywhere else in the developed world. Our home country is the only one where you can expect to go and join the workforce without discrimination.

    Dude, with all due respect, I am serious about all the precautionary measures I told. In fact it was one of my American colleague who sent out a similar list some time ago( I believe a year ago, when a similar incident happened to one lady at a parking lot), to all the team members.

    It was claimed based on some statistics, if a person who hijacks a car, more often (about 90%) the perpetrator kills the driver. Its a fact.

    Its not paranoia, its something if you keep in mind, then there is very good chance to come out alive form that dreadful predicament. God forbid, it could happen to anybody.
