Lately the members of IV have come to know that Aman Kapoor, the co-founder of IV has sold his house and spent around $64000/- towards the administrative costs of IV. This too was brought to our attention from a regular member like you and me, without which this would not have come to our knowledge at all.
So some of the members have taken an initiative to reimburse Aman and other core IV team members with the expenses they have incurred so far towards the administrative costs of IV. Note that the time they have spent and the sufferings cannot be compensated. Let us do the least by atleast compensating the money. Please do not donate directly to IV funds.
There is a funding drive in this other thread towards reimbursing the administrative costs of IV.

I Still think we have a good chance atleast all those with priority date before today.
The economy is not improving and I doubt if it will in next 4-5 years. Even though there is slight improvent the jobless claims went up

No way nurses and EB1 would count more than 5-6k per year....
Even out of the 30-40k like I said before about 50% would be from india and china (mostley Eb3) with later priority dates which puts them behind us
Eb2 Filings have drasticaally gone down because of the USCIS rule
Even after giving away all spill over visas to EB2 india and china they will have a lot of visas pending and If USCIS has made the decision that no Visa will go wasted period then we definitely have a great chance
Again my assumption is based on the FACT that USCIS has a policy that all employment Visa numebrs must be used
Lets keep it simple. In the next 4 years there will be 140k * 4 = 560K visas and I would say out of that the only ones with priority before Eb3 india and China are
Eb1 ROW +india & china
EB2 ROW
EB2 India + china (very limited new cases)
and I don't think the above categories would count more than 150k which should leave a lot of pending visas for Eb3

EB1 historically filled and this year CIS said, they may have to retro the India dates, but didn't finally. EB2 in best case got 15K visas. There are lot of EB3 to EB2 porting that will happen if the dates don't move. So EB2 it self will take 4 years to corss 2007 (I only added 25% of the porting). EB3 I God only knows..
Remember there are only 40K visas for EB2. EB3 will use their own 40K visas. 10K from this is reserved to otherworkers. So these dates won't move unless Recapture happens and per country limits are removed atleast till the backlog is cleared.

Same thing happened to mine. USCIS will pick up the packages from the USPS the next day so don't panic. Check for another status update tonight or Monday night, I'm 100% sure it'll say "delivered" then.

Yes I called the original civil surgeon and the TB test is going to cost $15 only and Xray $40.
I found the reason I got the RFE.
I had a copy of the last TB test report.
That civil surgeon FORGOT TO CHECK MARK the TB test !!!!
He checked a different section !!!
I feel bad that I missed to read it!
I could have rectified the DARN doctor then and there.
It was during the July fiasco. We were all in a hurry and tensed up.

What if you are working on EAD on pending 485? What would be the acceptable document?
I got the renewal showing no document (applied online)...the last time I showed Texas DOT any visa document was in 2001 - an H1 that expires in 2003 !!

My plan is making the following
Movie - A full length feature with characters that represent our life (includes H1 to GC process) in US with humor
Documentary - A professional documentary on our issues like H1 problems, GC backlog processing etc.
Any other thoughts from your side would help.
I am an ex NYFA student in digital film making. I would like to make the above two things by end of this year. Any of you are interested can participate. Again I don't need any money contributions. Just need your participation as actors, script writers and as other team members.

If you are in Jersey.. Act smart... All of these doctors are booked for this week..
Does anyone know of any health centers in Jersey which do vaccinations for cheap or free.. I am sure there must be some public hospitals where you can walk in and just get the vaccinations - saying they are for safety.
I have heard that vaccinations are free in New York City Public Health Center.. Can anyone confirm that?

I was not implying that legal immigrants would abuse the information if they received someone else's documents, but with that many rejected applications in the mail and lying in mailboxes, there is always a possibility of theft by others. Also documents like the medical exams are expensive to replace.

Are the processing times according to the notice date or the received date ? Mine are 4 months apart.
It is clearly the Notice Date. USCIS website mentions on the processing times page:
"If your receipt notice date is earlier then the processing date shown, we suggest you call our USCIS Customer Service Office...."
This makes sense (from their procedural point of view, though not good for clients). ND is very close to date when a case is opened the first time (although stamped RD may be several months earlier). That's the date a service center consider as their receive date, and also shows online as "...your case was received on...". Data for published dates is provided by processing centers. Therefore, they use only dates when they received/opened the case. They don't care if files were in boxes or shuffled for months between centers.
If your ND is within published processing dates, most likely your case has been opened, reviewed, and perhaps pre-adjudicated. That's all. It does not mean anything more until your PD becomes current. At that point, if they have pre-adjudicated cases, as per procedure described in link mentioned above, they clear them in order of PD.

Good Afternoon IV members,
Best wishes to all of you who are seeking advice or are in a visa process of any sort.
My question here if any one could kindly help me: I came to work in 2002 with a J1 visa, stayed for the 3 stipulated years under the J1 visa. I wanted to changed my visa for a H1B so I got a waiver, and then I went through the process the year that they had the lottery for H1B, I made the lottery, but sadly after paying all my fees, sending all the documents that my lawyer asked my employer for that time, I did not obtain an H1B.
Last year I could come back with another J1, I stayed in my country for 3 years, so my new employer applied for a J1 without using my waiver, as there was not need for it. Now my question, I do want to change my status from my present J1 to an H1B, and I would like to know if I can use the previous waiver that I obtain with my first J1 in order to waive the 2 year residency restriction on my present J1 so that I could apply for the H1B with a new employer?
Any advice is greatly appreciated.

If you sign the agreement, yes, it will be legally binding or as you put it "stand in court of law". Is the agreement written to only suit the purposes for the employer? Yes. Would I sign it? No.
You need to speak to an attorney. The language which ties to this employer until a project is completed might go against the "employment at will" law - not sure what the status is in NJ.
Once you complete a timesheet, an employer should pay you considering the timesheet is appropriate and not fraudulent. If the employer does not get paid by the client, that liability should not shift to you in terms of asking you pay back your paycheck.
I am not a lawyer (only a liaison to the legal eagles), please seek legal advise.

That should be the only goal. I am hoping that IV does not need to exist in the future, that everyone legal is getting a fair treatment, but that looks far away right now. Until then people need to fight.
I can understand and accept that US wants to promote certain groups of people for their skills, such as doctors and nurses since there is a shortage of them right now. US educated, since they have helped the US economy and school system and so on. But the core goal should still be fair treatment for all. No retrogression for legal professionals.
