    I applied for my H1B 9th year extension using I-140 substitution in 10th March 2008. My 8th year H1B was expired on 14th April 2008. Currently my 9th year H1B extension was is in pending status. Unfortunately my I-140 was denied on 18th April 2008 due to 4 years Bachelors degree.

    I used PERM EB2 labor substitution (May 2006 PD) and filed I-140 in July 2007 and denied (NSC) directly with out RFE. This is due to 4 years bachelor's degree and I have 10+2+3(Diploma) +3 (engineering-AMIE). I already applied my 485, EAD and AP. I got AP and EAD, but didn’t use it. I have 12 years of experience before prior to the EB2 Labor Pirority Date.



    Now how can I get my 9th year extension?
    Can I appeal for I-140 and get 9th year H1B extension?

    Could you please give me your valuable suggestions on this?

    What is the definition of "fairness"? Just because my application is waiting to be attended by an adjudicator and others are getting approved doesn't mean that I need to cry out foul. And if we do care for "fairness", whatever "fairness" means to us, then what are we doing, as a group, to seek fairness. I hope you agree that just by posting 3 messages per day on this forum and labeling system "unfair" "broken" etc, system is not expected to start working in a fair way. If you look at the thread to call lawmakers, there are hardly 30-35 people who actually called the lawmakers office. I am not telling you to call or do anything other than helping to make the system "fair".

    I believe USCIS is trying to comlete the receipting job from all the Service centres.

    so you wont be sruprised if folks started reporting their receipt numbers start with EAC (for Vermont).

    Let USCIS do their job of receipting everyone who filed in July-Aug 2007.

    Ultimately processing will be done at USCIS NSC and TSC for I-140 and I-485 due to their bi-specialization program.

    If you are talking about the discussion. then am referring to the items and not the discussions.Have I missed these items some where that are like the above. Then we are good to go. Can you let me know if the action items already there tries to encompass all thes issues and possible solutions.     Here is what I heard from my lawyer..

    If you've your I-797 approved till say April'2008 and while entering USA if a new I-94 is issued with an earliear date say dec 2007. Then automatically your I-797 expires on dec 2007 (basically the date on the I-94) because I-94 has higher precedence than the dare on I-797 and the date on the visa stamp in your passport. You've to apply for new I-797 and get an approval before the expiry date of your I-94 to maintain status, if you want to continue on h1-b.

    Going on EAD is an other option, if you have it....so please check with your lawyer immediately.

    You can get a 3 year extension as long as you have an approved I140.

    Are the processing times according to the notice date or the received date ? Mine are 4 months apart.

    It is clearly the Notice Date. USCIS website mentions on the processing times page:

    "If your receipt notice date is earlier then the processing date shown, we suggest you call our USCIS Customer Service Office...."

    This makes sense (from their procedural point of view, though not good for clients). ND is very close to date when a case is opened the first time (although stamped RD may be several months earlier). That's the date a service center consider as their receive date, and also shows online as "...your case was received on...". Data for published dates is provided by processing centers. Therefore, they use only dates when they received/opened the case. They don't care if files were in boxes or shuffled for months between centers.

    If your ND is within published processing dates, most likely your case has been opened, reviewed, and perhaps pre-adjudicated. That's all. It does not mean anything more until your PD becomes current. At that point, if they have pre-adjudicated cases, as per procedure described in link mentioned above, they clear them in order of PD.

    My case is as detailed below, and my questions follow:

    PD: July 2007, EB2 (India), Software field
    Labor, I-140: Approved, I-485 etc. NOT filed.
    H1 Petition and Visa valid until: Jan 2011 (after 7th year extension)
    Currently outside US, NOT working for the H1 sponsoring employer.
    My employer has NOT revoked my H1 or I-140.
    I was working for the employer in US where the GC process started. Then moved to Canada in early 2008 when the PD was highly retrogressed/unavailable. Since then, worked in Canada in related field for a different (Canadian) employer. Things have been tough here: lower pay, very high taxes, friends all in US, and especially - the weather. We would like to return to US.

    I will soon be able to apply for Canadian citizenship. I am in a dilemma now - whether to return to US on H1 NOW or to become a Canadian citizen and try my options LATER. I have the following questions:

    (Same employer, as Indian citizen, knowing that I did not work for them for over 2 yrs, and was outside USA):
    1) can I now(or anytime until Jan 2011 visa expiry) return to US to work for the same H1 sponsoring employer on the existing H1?
    2) would I be allowed the H1 extension in Jan 2011 based on approved I-140? Or is that doomed to be rejected because I was not working for the employer in between for over 2 yrs.
    3) Would the fact that I was out of US for 2 years help me get a "regular" extension?
    4) could I continue the GC after a gap of 2 yrs while I was not working for the employer?
    5) if yes, will my PD of July 2007 be maintained?

    (Different employer, as Indian citizen, knowing that I am currently out of the US):
    6) if I get an offer from a different employer in US, could the new employer do an H1 "transfer"? i.e. would I need to wait for the April 1/October for H1 application/visa and would it be counted against the yearly H1 quota - or - can the new employer do the H1 "transfer" immediately?
    7) For the H1 "transfer", would I need to produce US paystubs for the last few months (which I cannot, since I am not in US)?
    8) if the new employer applies for my GC, could I re-use my old PD of July 2007? If yes, would the profile need to be exactly the same as the previous Labor/I-140?

    If I become a Canadian Citizen:
    9) if I become a Canadian citizen, (my H1 would have expired by then) will I be able to return to work on H1 in US for the same or a different employer as a Canadian Citizen?
    10) could I reuse my PD of July 2007 when working for the same or a different employer after changing my Citizenship? Would the job profile need to be the same?

    Also:
    11) is it possible to switch the GC processing to "future employment", although the Labor/I-140 were approved with the understanding that I was to continue working for the same employer?
    12) is the H1 visa/Priority Date of approved labor/I-140 carried over when the individual changes citizenship - from Indian to Canadian?
    13) when do the dependents' citizenship come into the picture in the GC process? If I continue to be an Indian citizen but my spouse becomes a Canadian citizen, will my approved Labor/I-140 be affected in any way?

    Please help me in getting the facts so that I can make an informed decision in this dilemma. Any help appreciated.

    Thanks guyz !!

    I did spoke with Sheila Murthy Lawyers on chances of maintaining GC processing and Consular processing.

    My firm is OK with my long Leave of Absence...Only thing that threw spanner in the wheel was comment from Sheila Murthy firm's advise.

    Per them, to renew AP and EAD, I need to be phsically back in states and also stay in States for the duration of approval i.e. if it takes 3 months for renewal of AP and EAD, then I need to be in States for that duration.

    I asked them what if I can apply 5months in advance, from Outside US and someone can fedex it to me. Max I can come back for few days.
    .. Per them this will not work...

    What do you guyz say ?
