Is it okay to have an internal transfer (same company, from East Coast to West Coast) after obtaining the Green Card? Or transferring after 6 months to 1 year would be better?
If it's okay to transfer right away, does the new position need to have the same/similar title, duties, and salary?

I think internal transfer after 6 months to a different location may be better.
Officially hold on taking promotions. Practically taking additional responsibility should not be an issue. For example, let us say you got GC as a Sr. Software developer, in 6 months you may get promoted to Lead Developer. Point to be noted is hold all the current responsibility, in addition take new role like team lead and project management.

No, you are safe in this case. There is the little gray area of you leaving the petitioning employer early, but since they did not revoke teh I-140, you can say that (if it came up in the interview) you intended to go back to them and they had all intentions of hiring you again. As long as I-140 is revoked past 180 days there are no issues. File for AC-21 sometime past the 180 days mark.

Thank you very much for all the advices. I wonder if I do need to take vacation around the early of year 2008 and come back approximately October, 08 due to my H1B expiration in April, 08. I wonder if I still need to be employed full time with my current employer during the whole period that I�ll not be in US. Do I need to get pay during that period? Would part time be enough in order to keep the green card process going? Also, do I need to file any applications with USCIS prior to taking vacation in order to let USCIS know that I�ll be taking vacation and I can use that vacation time outside US to extend my H1B until around October, 08. If I have to file, when should be the best time to file it and what form should I use? I plan to leave around the early of February, 08. Accordingly, I can come back around October, 08 and file the I-797 form for H1B extension if my I-140 is approved by then. Please advise and thank you very much.

my new 140 is file in april and is approved. got my EAD and AP. But no FP.
I also dont expect to get the GC so fast. its more of a red flag and concern what they are trying to look for.

You can apply for extension. Fees are not applicable for extension of status. If it involves status transfer e.g H4 to H1, then you need to pay the fees. I extended my wife, and daughters status just by filing the paper work and got the new I-94.

Hello All,
I have a valid H1 (I-797, I-94) till 2009, but my H1 Visa on my passport has expired in 2005. My wife has a valid H4 till 2009; similarly her H4 visa on her passport got expired, we haven�t traveled outside of US from then. Now she is planning to go to India next month because of some family urgency and she is planning to take an appointment for H4 visa stamping in Chennai consulate (India). My question is, is there going to be any problem for her stamping as my Visa on my passport has been expired even though I have a valid H1 I-797 till 2009?. Is there any rule which states primary applicant has to have valid visa on his/her passport for H4 stamping.
If any one of you had a similar situation please share your experiece, it will be very helpful.

Please explain what is student status and 221g. You mean , if you are student of any intitute in US, while your I-140 is approved?
I was here on F1 first and then converted o H1. I went for a H1 stamping after about 5years. Student status refers to the status of the F1 visa. They usually track it using SEVIS. My bad luck since SEVIS was not up that day or my name was not showing up since I was a pre sevis grad enrollment. 221g is a document they hand out if they cannot issue a visa due to lack of documents or need to no further administrative processing like verify employer/status on a visa etc. You need to either appear again before the consulate or they get back to your later. My case was a nightmare and I dont plan to ever go back again to India period. Guys do your research on the web regarding 221g do travel plans accordingly!

I only have something to say, everyone is looking for its own turf, and if you really want diversity in the forum, the hard count will not attract anyone else other than Indians and Chinese. I am few months from working due to EB2- Worlwide category (current), so any change on the hard count is not on my benefit, same for anyone who is not from India or China, the EB3 is not current worlwide but the line of all the other countries is still shorter, if you really want to reach more than Indians and Chinese the goal has to be good for everyone, and the hard count is not. I also got rejection notices for my EAD renewal applications yesterday stating "Incorrect or missing fee" as the reason. I am not sure about the mode of payment, etc. used as the applications were filed by the lawyer.
