i think we probably oughta wait for some lawyer to give an explanation. i know for a fact previously you could port without an approved I-140. My lawyer supported the decision.
But if this memo actually means that you need to have an approved I-140 prior to porting then what happens to people who actually ported w/o I-140 being approved? I don't know.....I am a little nervous now.
Also, it'll be interesting to find out when will this memo become effective? I assume its May 30 as that was when the memo was written.

So those guys who attended the hearings or met with senators. what was the result? what did they accomplished? did they get the opportunity to participate with the senator or law maker in an action plan? or we just wasted that opportunity asking for autographs? please those guys post your comments.

This is the worst bill ever. 1987 amnesty bill atleast had a flawless game plan when it was passed. This one will not pass. If it passes, I am going back to India. At least in India polititions are not brainless, they are only corrupt. I choose to go back to India if this bill passes. At the end, if someone says that the crux of your conclusions are wrong, for an emotional person, it would be tough to take. A rational person would take it lightly and think before responding. In your immediate previous reply, you just cherry picked a quote from my previous reply and put that as my interpretation. Please do not put words into my mouth. My reply has been pasted below in its entirety.
You have campared the paragraph with NumbersUSA argument etc. Dear friend, my argument was exactly opposite to that paragraph. I think, you didn't get the meaning of the paragraph itself. My paragraph contained phrases like "If your argument is correct..", ". If the unused can be given to ..". etc, which makes the argument exactly opposite to what mentioned there. So, that means I believe exactly opposite to those arguments.
I acknowledge that you have every right to interpret the law in whichever way you want. My point is that, it really doesn't matter to all of the folks who applied in EB2 and waiting for GC. The thing that really matters is the way in which USCIS acts this year. They can act in whatever way they want. This year, if they say, there won't be any family visa wastage, we will get nothing. Contrary to that, if they see that by the end of the year there is a chance for 15K family vis wastage, they may allocate that to employment category.
To all EB2 folks out there: No need to really feel bad or happy about the analysis of Mr. MPADAPA.
My general advice to anyone who put forward an argument for propaganda and a campaign is: Don't massage the facts, don't twist the facts, don't over analyze, don't under analyze, Also don't say that your interpretation is the final verdict. Because you don't have a clue what is in the field manual and internal memos of the USCIS and you don't know how they procedurely allocate spill over etc on each year. As long as USCIS and DOS can use the terms "In Anticipation..", "As per our expectations..", no one will be able to hold them accountable for the visa wastage.

No surprises for me at least. There will be only 816 new EB3 visas available for any country in October. This will move the dates at the most by a month or two and this will continue for ever until a new legislation is passed, that is why DC rally is all the more important and everyone should focus on that to bring in a change.
For folks wondering how I came to the 816 visa number
Total GC available = 140000
7% country limit = 9800
split for EB3 = 3266
spread for each qtr = 816
Good Luck to all and don't have high expectations because you will be disappointed when the bulletin comes out.

Hi,
I followed up two more cases with the same status as mine,
All the 3 SR's opened in TSC on 10/14/2009 or 10/15/2009 and answered by the same representative.
Today one of them took an info pass and talked to IO. they said the information could be wrong as they don't see any status like that. and one more thing their case is pre approved.
