    Who r u to ask him to get lost??? Just becoz u have so many greens dozn't mean that u can rule the roost. Therez something called as freedom of speech and hez just using it. Its a free forum and u cant dictate terms here while u r a member here urself. Accept the truth and live with it. Whyz that some desis get so offended when someone rightly points out the dirty behavior of desi employers? He has a point and u need to respect that. And yes this is immigration related and causes awareness among the legal immigrant community. If that dozn't get into ur thick skull then God knows what doz. Maybe visa bulletin monitoring and RFEs and PDs???

    Yes, the motive of the original poster could be questioned due to the nature of his first post. But do we really have a set rules for the first post. I have seen some new members getting reds coz they ask for help in their first post and get bombarded for not contributing or helping others.

    This post does not and cannot imply that any significant percentage of indians are into visa scams to make money. Whatever the original posters intention, this is a relevant post since it is immigration related. Most indians and similarly most EB GC applicants are legal, law abiding folks. Lets not get offended or take this personally. We have to mature and show that just coz some section of 'our' people do a misdeed does not reflect that all of those people are of the same color or morals.

    Not an amended H1. It is an H1B extension for 3 years after I140.

    The question is if you have this approval in your hand (whose start date is after your current visa validity) and you return to the country within your visa validity, will the official have I-94 valid till the end of the new approval or till the date your current visa is valid?

    According to "Last Action" Rule of USCIS, there is a possibility that your H1B extention approval becomes invalid because the POE gave validity till your visa end.

    Seems all so screwed up. But red-tape rules are never white and black.

    There are 2 approaches for this .
    1. If you have a valid Visa(plan to get Valid Visa) for U.S . you can go abroad and then come back with I-94. -- This is Risky since it Border Patrol
    which comes into picture and may or may not be positive.

    2. You can file for amended H1.(It is still called amended H1. Amendment is to the I-94 dates). This is processed by INS . You still need to keep your fingers crossed but INS has been postive in almost all cases.

    Green-Card Applicants

    The government's surprise offer, then abrupt reversal, of an opportunity for thousands of skilled foreign workers to obtain permanent residency in the U.S. highlights the problems of the overtaxed immigration system and the frenzy that results from a chance to apply for a green card.

    The scramble has put tens of thousands of workers and their families in limbo after many of them and their employers spent thousands of dollars in hopes of securing permanent residency. It may result in a class-action lawsuit against the government by frustrated applicants.

    The problem began on June 12 when the government seemed to open the door for thousands of foreign workers and their families to end the long wait to apply for a green card. That is when the State Department published a Visa Bulletin, which is a monthly notice closely watched by immigration attorneys and their clients because it determines who is eligible to file a green-card application the next month. The June bulletin announced that practically all skilled foreign workers who had been previously deemed eligible for an employer-sponsored visa could now take the final step of applying for a green card.

    By law, the U.S. can issue about 140,000 employment-based green cards each year. Last year, the government fell short by about 10,000, despite the long waiting list; leftover visas cannot be rolled over to the next year. The June announcement aimed to prevent the visa slot from going to waste, according to a State Department spokeswoman.

    The announcement was greeted with a mix of jubilation and panic by thousands of engineers, lab scientists and other high-skilled foreigners who had waited years for their place in line. Working ahead of a July 2 date for filing the application, intending immigrants rushed to gather documents, complete paperwork and obtain medical exams. Many of their dependents boarded planes for the U.S. to meet a requirement that all family members be present at the time of filing.

    "The bulletin created a land rush among legal immigrants desperate to finalize their green-card applications," said Steve Miller, a Seattle-based immigration attorney.

    Then, on July 2, the State Department issued an "update" that reversed the previous bulletin. It stated, effective immediately, there would be no further authorizations for employment-based cases. The U.S. Citizenship and Immigration Services, which processes the applications, said it would instead simply process existing applications to meet this year's quota. "We already had sufficient applications pending without new applicants...," a spokesman said.

    Mike Aytes, head of domestic operations for the USCIS, said all 147,141 employment-based green cards have now been issued for the year.

    So you got the receipts without the checks getting enchased? Ddid any one who were sent to CSC did not get their checks enchased but recieved receipts?

    The large drop in competitiveness (is that a word?) in the U.S. is largely attributed to the immigrant population posting to message boards during work hours!

    That's one way correct as most of High skills immigrants struck to same jobs from last 3 to 5 years with same responsibilities due to back logs and retrogression :)

    I was not bragging. I was just thinking out aloud, so to speak. Economic ups and downs like this this are a normal part of economic cycles in a capitalist economy. My observation is that IT industry is not as badly affected as other sectors. I have not seen people sitting without jobs for extended periods. I mean, some people do loose jobs but they get something else within a couple of weeks. That is pretty much normal functioning of markets.

    This is not your normal recession... Whats happening right now is once in a lifetime event... This is the kind of stuff you will be telling your grandkids about! This is payback time of the excesses of the past 25 years of loose monetary and fiscal policy under Greenspan... Your observation about IT industry not being as badly affected is true only till the month of October... Till then things were in sort of slow motion esp in IT sector... Not anymore!

    Not bad for an economics hobbyist! To quote from Jeff Goldblums 'The Fly'', "Be afraid, be very afraid...". 2009, 2010 are going to be BAD! The other thing to watch out for is the crime rate... Americans to a large extent have not known what real poverty is... The social implications of this fall out are going to be awfull... Don't take things for granted... If you thought that cushy job of writing apps for Facebook is safe, boy you are wrong... The depressionary train has already left the station and all we can do now is sit tight and watch!
