Well it doesn't really matter. And I am visiting India now and I can see that this country and China will definitely kick ass of Western civilization .. as it is already doing. The people here are hungry for more and in spite of seemingly unsurmountable problems it will succeed and once again India will be the "Sone Ke Chiriya".

8 CFR Sec. 245.2(a)(4)(ii)(C) . It says:
(C) The travel outside of the United States by an applicant for adjustment of status who is not under exclusion, deportation, or removal proceeding and who is in lawful H-1 or L-1 status shall not be deemed an abandonment of the application if, upon returning to this country, the alien remains eligible for H or L status, is coming to resume employment with the same employer for whom he or she had previously been authorized to work as an H-1 or L-1 nonimmigrant, and, is in possession of a valid H or L visa (if required) and the original I-797 receipt notice for the application for adjustment of status.
Looks like we can ask for a receipt notice in case we are travelling out of the country. Atleast ask!

They won't be any better off here.Instead of being kicked out fair and square, they will be made to decay on H1 visas for 15-20 years. Talk of choosing a rock over a hard place. Besides, the British MPs seem to at least understand what skilled immigration means - here they will have the pleasure of being grouped with meat-packers and grape-pickers who matter-of-factly walked across the border.
I think its also a lesson for those tired of the US immigration system and considering moving to other countries - lets face it, immigrants are not exactly welcome anywhere. Either stick it out, or return to home country.

If receipt date is the issue then I won't have been approved either and nor would hundreds of my friends and colleagues who have got approved having receipt dates after me. Also our receipt date is July 23rd 2007 as is in the receipt notice from TSC and TSC is currently processing Mid -August. So TSC is not even looking at her case and just sending you a standard reply. This is the same reply that I received on opening a service request at TSC, I had hopes that they would treat inquiry from Congressman's office with more due diligence.
All I need to know is what is holding her approval and if anything we can do to fix. I have got that" to wait 90 day' reply last year also. Let's see what they have to tell about the FP/Biometrics.
Problem is I can't even leave the country without the green card now that I am approved but god knows when I will get that...All my colleagues at work have got their physical cards for their entire family in mail and that's what hurting me about the inconsistency of the way they treat applications.

Before Nebraska service center retrogressed their processing dates I was able to speak with an IO. I asked her a few questions relevant to this.
There maybe a public USCIS rule / procedures that would confirm what she told me.
Q) When is the name check typically initiated
A> Soon after receipt
Q> Is my name check cleared.
A> wait a moment..... yes
I've also explained why Nebraska processing dates moved back...
1) Transfers from Texas
2) VB moving forward coupled with no pre-adjudication. Therefore they have to go back to older receipt dates.
3) 180 day name check rule taking effect -- clean up old cases.
4) Public processing date was internally known to be too far ahead of reality (and therefore causing service requests).
Now could USCIS hide behind name check now?
Probably not for more than 180 days, because you could file a WOM and win.

I have called him for issues a number of times not related to AC21 and he answers all phone calls. In fact, I called him atleast 4 times before I actually handed him my case. RK on the other hand charges per second. I paid him 600$ for a 20 minute phone call and he did not tell me anything i did not already know....Rip off!!

A lot of times.. companies use this bugaboo of job desc etc.. Those that want to promote you badly enough will find a way.. First of all.. What your job title is v/s what labor is filed under is not directly related.. Secondly you can have matrix responsibilities that span across 2 bands etc.. So lot of times it's an excuse to not have to let you down hard way.. always easier to blame on that "damn immigration queue"

Ron is a very decent guy, he is not my attorney but he has helped me with really good advice that helped me a lot.
Once I posted a question during the weekend and asked him a very specific question (My attorney was out of town) and he not only gave me the right answer but also posted detail information about the actual law behind it. Beleive me I needed the answer that weekend.
Every law firm wants clients but most of the lawyers would charge you $200 or $300 for 1/2 session, I know this becasue I have done this as well.
Ron answers your questions on his forum with out any charges, anybody can see this if they go to his site.

You are correct but I think I am not sure if one can change employer (H1B Transfer) during that 3 Year extended H1B period after 485 denial.

Does she need her H4 approved to have her prospective employer file the I 129? (or) Can she just provide the notice of action she received for her H4 extension filing along with her I 129 to show that she is maintaining status?

This is what the 129 instructions specify. I think that you will have to wait until the new I94 with the new dates is issued. Hopefully she will get it before April 1.
Change of Status.

Send school the copy of EAD and I-485 for her and that should be it. After that, they can report to whoever they want (ofcourse they won't because there is nothing to report since your wife can continue with the school on EAD without registering for cradit hours)
I need urgent advice from you. As you know my wife is on F1 visa and completed most of her credit hours needed by school. She has get only 1 credit hr to complete the course. However, that�s below 9 hr full time student status. She has been asked to register for additional 8 hrs..and pay tuition fee accordingly ( > 8K). Which I think is unreasonable. They told her that if she doesn�t register by tomorrow they have to report it to INS. She told them that she has EAD..there answer doesn�t matter in order to remain in school and F1 visa she has to register.
My questions is:
1) Can she continue working on her Thesis on her EAD and AP ?
2) What will happen to her f1 if she use EAD
In response to these questions my Lawyer said
1.) yes, she can continue to be a student as an adjustment applicant � she can work using the EAD and travel using the AP.
2) she is basically no longer an F-1 because she has demonstrated immigrant intent by filing the adjustment. Which is fine � she has valid legal status as an adjustment applicant and can work with the EAD and travel with the AP.

I somhow feel that Name Check problem has not been taken care of within its entirety. I agree with one thing that NC will be "improved" but has not been and will never be streamlined the way actually it should be.
