    Hi Ultimo,

    Thanks for your quick reply. When i goto USCIS wbesite, and enter the receipt #, it still shows me the date they sent the FP notice. Am i looking at thr wrong place? please let me know.

    Got LUD that cases are now at NSC.

    Waiting for Original Receipts...will let you guys know what the RD is on those Receipts.....

    It looks like this is intrnal process USCIS is following and nothing to worry at this time.

    Anyone can throw light into this one. Can we track APs now for NSC.
    NSC is receipting late and also their AP documents are mailed very late. Please let us know when we receive our AP document after getting the receipts? for eg. 10 days, 20 days etc..
    It will help lot of us who want to make some travel plans.. [some like us are eagerly waiting for past 4 yrs!!!]

    whatz wrong with someone who gets GC in 6 months, is'nt it our sole goal to change system to have GC in few months,

    c'mon guys are you jealous, what makes you think just because you did MS here that you are more qualified than a person who has done Bcom from india, he is manager atleast he knows how to grow in a orginzation and get a GC in 6 months, so learn from him,

    get over it this is how the system works if you want to change atleast think positve and call your lawmakers

    I signed the G-28 for 485, EAD & AP. Attorney received the receipt notices for all and he just emailed the case no(s) and A #.

    When I ask him to mail me the receipt notices, he says its not their general practice to send them to clients and they are really not useful when I start getting the FP notice etc...This is really weird!

    Folks - Is it possible to get a copy of the receipt notices by calling USCIS?

    They will not get I-94 for more than 6 months. You need to do following things to claim them as dependet(s) -

    1. Extend their stay beyond I-94 i.e. 6 months.
    2. Get ITIN number for them. (I am not sure how you get it on B1/B2)

    This is the primary reason, immigration does not give more than 6 months I-94 on B1/B2 and avoid extending their stay....even if those are genuine reason(s).

    I took the pain of driving to NY all the way from Boston to get my passport renewed. I woke up at 3:00AM and stated off at 4:00AM so that I could reach the consulate by 8:00AM. I was told by my friends that I would get it in the evening itself. Unfortunately, I was faced with severe disappointment that they are no longer returning the passports on the same day. The worst part about the Indian consulate in NY is that they didn't update their Website. When I called them several times, non one answers the phone and speaks with courtesy.

    After arriving at the consulate, we were made to wait in the cold for atleast an hour until 9:15AM (They open the doors at 9:30AM). They have no mercy for people. Also, the approach they took to call out people was terrible. It was like a fish market. I asked them if would get my passport back on the same day. I didn't get a straight answer until my number was called. I went there and atleast that lady talked to me with respect with a smiling on her face. Atlast I was told that they are not returning the passport on the same day. They asked me to pay 20 extra dollars so that they'd send the passport by Express mail (USPS). She also told me that I can track the passport.

    I then drove back to Boston, the same afternoon. After exactly a week, I got the new passport booklet along with my old passport. I am fortunate enough to have all of the details printed accurately.

    My strong advise to everyone is to send their passports by mail.

    appealing/motion to reopen doesn't allow you to stay in USA.

    If employer revokes 140 then no basis for getting h-1b extensions.
    Agreed........but if you will have to go to appeals if your case is legit to be reopened/reconsidered and be approved...........for any other reason if at all its not goona be approved........you cant get any visa for USA.........hence this low probablity case will be for those who are in good standing in terms of immigration else - go back to the home country..........

    If employer revokes 140 you have to show USCIS that the new job which you took is indeed same/similar and you qualify for an approved 140. I can get you more information on this but you might just want to check Ron Gotchers website for detailed information.........there are so many different situations where nuthing would happen or you just get in trouble if 140 is revoked so we cant really generalize this....

    Would request you to elaborate a bit.

    Note that I am not using either my EAD or my AP. All I am using is H1-B and my Canadian Passport to enter and leave US. Most people on the Canadian US border to that.

    Also, I commute to US everyday to work, which is less than an interval of 12 hours.

    Your input is greatly appreciate. Thank you.

    Using H1-B or AP does not make a difference. Filing I-485 implies that you have a residence here in the US.

    Having said that, typically, trips outside US that lasts less than 24 hours are not counted. That way, daily trips could be OK. However, may I ask, where do you spend your weekend?

    It comes down to this question. Are you residing in US? The burden of proof is on beneficiary (I-485 applicant).

    I would suggest that you should consider getting second opinion from a reputed attorney.

    I live in Seattle as well.

    You are right. They do not tell you likely because employers enjoy the idea that people visa dependent many times turn out to be "more productive" for the company. This is just a nuance, but I can speak from my own experience that I used to work longer hours and demand less when I was on H1B. It is a fact.

    Only time will tell. There is no lawsuit angle to be explored against this as far as I know.

    It is interesting what other members reported about people being in denial, even when you clarify about the difficulties about the greencard process. I had my own brother coming here and his employer talked big about greencard, etc and he started making plans to bring his wife. I told him everything we have been through and he didn't pay attention to it. In the end it turned out that his profession was not even eligible for H visas.

    This is absolutely the truth. I think that's why some people likened H1B to "slavery"... The only difference is probably you have choice to not come under H1B, which may even disguise H1B's true nature further. :o

    Maybe IV can also help spread the words about the whole H1B and GC thing to people who are thinking about coming here... not exactly as rosy as some people thought. Hopefully when people know more, they will make more informed decisions. :p

    This seems to indicate someone else will get benefit payments but not the worker himself / herself.

You may want to dot the is and cross the ts but that is not how the Law makers, Senators US or Indians think about these issues. They are at 30K feet level looking at the Forest while we waste time in just going around our own trees.

    Agreed there are a lot of similar articles generally coming out in Indiatimes too with regard to work visa issues in the US and UK. sometimes there are factual inaccuracies, but the point is very good. Maybe we can even reach out to these reporters to work on presenting media in the US

    Man, you are so crazy about opening so many threads for the same topic. You cannot force people to send letters. And by this time those who wants to send letters had already sent to WH and IV. Give us some break. I come to IV site to get some information on immigration issues and what I get are 'n' numbers of threads for same issue. ---- ADMIN FIX.......

    Can you please suggest your POA? Like, you say u want to do things other than sending the letters. I am ready to support anything that helps the community.

    We have 3 more weeks for this campaign and we must do our best to get as many letters as possible.

    A lot of people lack motivation because they just canniot pull the trigger and once in a while we must give some push.

    You can appeal quoting your friend got approved. I have seen in the past, people got their approvals in appeal.

    I am not sure if this can be a good defense for ability to pay issues. Employer's revenue/profits drive the number of employees that can be sponsored for GC. It is not everyone or no one scenario.

    Yes, you'll have to get it registered.

    It is not big deal. Just ask your parents to get in touch with a document writer (guys who'll be sitting in front of Registrar offices) and they'll do it for you. Your mom and dad may need to go and sign the docs in front of the registrar.

    both mom and dad or one of them is OK?
    Does the registrat allow such affidavits to be signed in his/her presence. What role do they have? Do they attest that the affidavit was prepared in his/her presence?
    An notarized affidavit on Rs 100/- deed paper (or whatever you call that) is not OK?
