    It will be like attending for a H4 visa and prepare documents required for H4.

    Did you had the paystubs or the immigration officer did not ask for it?
    No, She don't have pay stubs and office just asked her husbands pay stubs ( for whom she is a dependent) and she didn't mention about her H1 and not attached H1 release in the visa documentation. She just attended for H4 visa with only documents that required for H4.

    What did you mentioned at line # 30 and # 38 of DS-156?
    I don't know but I can check my friend tomorrow.

    How long was your wife out of status? Please respond. I am unable to get the paystubs from the employer. He is not picking up the phone.
    I can check with my friend, but I remember she was out of status for more than 1 year.

    I recommend every one writing their own words rather than doing the copy/paste. If I were to recieve 10 emails with exactly the same content, it might make me feel like some ONE just sent 10 diff emails. IMHO, Its a good idea to write the gist of the story in your own words. Save it and use it for all the people in the media.

    This whole spelling bee thing is the stupidest thing I have ever heard of. By any standards, it is pure and simple torture to subject the kids to memorizing thousands of words and their stupid spellings. And what use is that? Have they never heard of something called SPELL-CHECK in Microsoft Word and other email services ?

    Or are they afraid that their kid will go to a job interview and someone might ask them to spell the word that no one on the planet ever uses and is only present in the Oxford Dictionary.

    Those who subject their kids to such a regimented, rigorous, scripted childhood are preparing a next generation of work-force that would only know how to follow the orders and accept directions.

    85 % of the fortune 500 CEOs are not MBAs. And the other 15% that have an MBA, only 3 of the 15 have done MBA from an IVY LEAGUE school.

    What that tells you is that too much education and scholarly childhood increases your job security, in that sense that you will never be unemployed, but it decreases the chances that you will be on the top or you will be a billionaire.

    The biggest prize goes NOT TO people who can follow directions and know everything, but who can GIVE directions and get things done.

    That a decent logic. Why do we have olympics and celebrate the winner of 100m dash? Don't we have cars/trains/planes that can go faster than 100m in 9.2 sec. Then why race to find out who runs faster than others. Its the same reason for Spelling Bee, I guess.

    I didn't think my answers were making fun or teasing anyone - sorry if you felt that way, I didn't mean them to be interpreted like that.

    The main problem is that no one really knows for sure whether these steps are taken in sequence. There is little to no transparency. There are procedures, but we can not guarantee that they are followed.

    To answer your second part. No, I don't believe there are any standard updates that indicate this, but I could be wrong. I think that there is an update if you clear it, but not if you are stuck in it. Make sense?     To answer nlssubbu with the query about the "pre-approval" - I don't think it is a 1 time thing. Its a fairly standard USCIS practice. I have a link somewhere to the IO AOS processing manual. If I can find it I'll post it here.

    Do I think they have enough resources to process them all? Absolutely not, but I doubt there will be a rush considering PDs won't be current for a while (esp eb3)

    Franklin got her gc. She is still such a motivated member. IV is fortunate to have her. I didn't intend to defend her, she is more than capable to do that on her own. Just wanted to add this information because that makes a sea change in raising the level of conversation on this thread.

    The contrast is amazing, people who are stuck in the system are not as involved, while members like Franklin and Aman, who have came out of the "limbo" still want to help others.

    I agree with both the ideas.
    In fact the idea of the banner with 'Waiting for X years' is fantastic ..
    That would be an amazing sight where everyone holds placards that say since when they have been waiting.
    If it's even 400 people .. we have 400 people saying look we've been waiting since 5,7 or 9 years.

    It's also important to get in heavyweights like either local folks like Google HR head or any public face. Google has always supported the Immigration issues .. since they have problems because they couldn't hire folks when the h1 lottery happenned.

    My original "Reciept notice" of 485 came from "California service Center" then few weeks i got another notice of action notice type = "Transfer Notice" that said your application has been transfered to "Nebraska service center".
    For EAD renewal should i send copy of just Receipt Notice or both?

    Also should i send the EAD renewal app to "Texas Service Center" as per instructions because i live in MA ?


    As per section 7 of the instructions "with a copy of the receipt notice or other
    evidence that your Form I-485, Application for
    Permanent Residence or Adjust Status, is pending"

    So you should send a receipt notice and that should be enough.
    But for the heck of it, it does not matter if u send that transfer notice.
    USCIS will not create any issue for you, just because u sent TOO much documentation. Here we are talking only about 1 extra piece of paper.

    For legal fanatics: Technically the statement clearly states that they are OKAY with only the receipt notice. In fact that statment also tells me that you could show anything as evidence of a 485 filing. So even a xfer notice should also be fine. I simply recommend, send the recpt notice. Thats all.

    So now its all upto you.

    Yes. Read the instructions and send your applicaiton as per stated. So if it says that MA people are supposed to send to texas, send it to texas.

    I sent to 3 members from Fl and 3 members from VA. I was residing in Fl and I had to move to VA due to job relocation.

    I think we need to wait for 90 days from the date they generated the recipt, then go to USCIS.

    Did any one go there after 90 days of receipt date and still get no response from them?

    Not quite, as I understand it, if your PD is not current, your AOS will continue processing and will eventually get to a "approved, pending visa number" state. You can pretty much be in this state for some time, and then when PD does become current (as happened from May through July this year with the significant shift in PDs in the bulletins) there will be a massive approval rate of all those pending applications.

    USCIS doesn't stop the application process just because your PD is no longer current

    This is how USCIS got through 60k unused visas in a staggeringly short time. There were a LOT of applications that were ready to go, they were just waiting for those numbers. USCIS didn't all of a suddenly quadruple their efficiency in processing :)

    "pending visa number" situation never possible now becuase there are sufficient I485 with old pds. PD is base after that every thing is luck.

    I agree.
    I lived in Canada for a year. I also worked in my own country before coming to the US. At least in my experience and from talking to dozens of friends in Canada, my home country offers more potential for revenue than Canada. You will see it when you move there.

    I will never forget when I landed in Canada in Toronto back in 1998, I met a girl at the airport and many at the Hostelling International who told me lots of stories on why I should go to the US instead. That particular girl was living in the US illegally.

    I am sorry to tell you that leaving the US and going to Canada may not be a solid plan B.
    Why don't you start a similar forum for "going back to

    India" ? I hate to burst your "bubble of hope" but Canadian population and job market is limited and the opportunities for professionals like us are limited. Why not consider going back to India and taking up some of the lucrative opportunities in middle management in the IT industry.

    The Indian economy is booming and the salaries are excellent. You just need to make some adjustments with quality of life (pollution, traffic). Atleast its better than going to Canada, living in limbo while looking for suitable jobs for a long-time, sometimes even doing odd jobs just to make ends meet. I hate our Indian mentality that "every place in the world is better than our own country". Give me a break guys.

    My plan of action is very clear: Go back to India and live there happily. If there are other opportunities in US then come back.

    Obviously i was wanting to know what the law states...and not a democratic answer. I dont always expect forums to quote the law correctly - use your judgement!

    Thanks anyway for that answer. My situation is different beacuse with the I-140 PP going away for now...and my H1B expiring Feb 2008...I am left with approved I-140,Labor and retrogressed dates to be eligible for 3yr extension.

    Now that if 140 is pending ...then I am left with EAD as the only option to continue manitaing my status.

    Correct my intrepretation of law if wrong..

    You can extend your H-1B. Why is EAD your only option?

    As you probably know, Employment Based immigration is currently showing years of retrogression; more than 350,000 labor applications are stuck in the backlog centers and there is no information on when we can see even a ray of hope. Applicants have to wait for their green cards for as many as 4-7 years, depending on the country where they were born. With retrogression, applicants are unable to complete their final phase of green card even if they have cleared all the previous hurdles. We, a group of volunteers at www.immigrationvoice.org (http://www.immigrationvoice.org) . We have set up a non profit organization to work towards resolution of these problems.
    In the past we have seen that due to a lack of professional representation, employment based immigration issues have been ignored by the lawmakers. The latest example has been dropping of section 8001 & 8002 from the Budget Reconciliation Bill passed by the congress in December 2005. With comprehensive immigration reforms on the anvil in the early part of 2006, the time to act is now. However, with the current political scenario and the overpowering debate about illegal immigration, this is going to be an uphill battle. We have already initiated talks with professional strategists who have in the past been able to achieve goals similar to the ones we are working for. We feel that these are the following ways a professional strategist can help:
    1. Identify feasible goals that can be achieved and are representative of the people in this forum. We should not have to piggy back on H1s or illegal immigration - we need an identity of our own
    2. Identify the champions amongst the lawmakers, alliances, organizations who are willing to shoulder some or all of the responsibility in passing provisions to solve retrogression & address labor backlogs centers.
    3. Identify opportunities to meet/interact with those mentioned in point no 2.
    4. Help us in putting our points across cohesively and in a way relevant to the political situations
    5. Keep a close monitor on the progress and the situation so as to identify the opportunities as they arrive.
    Hiring professional strategists requires several thousands of dollars. If we hope to counter some of the anti immigration propaganda, we have to accumulate funds to the tune of atleast about $100k. Keeping this and the short deadline in mind, we would urge you to contribute at http://www.immigrationvoice.org . To lead by example, the volunteers have themselves come forward with contributions - in one night we had a collection of around $5000 from 20 contributors. This is a tiny fraction of what we as an organization need.

    PS : I work with one of best semiconductor companies in world and earn decent salary .
    All GULTIs , start giving me red and i don't give a** for that.

    I understand the pain of dependents. My son is also will be aging out.

    Ability to work comes from EAD which would come from filing of 485. July 2007 filing was pushed mainly by IV and only then other organizations have pushed for it. I hope you are aware of this. 2 year EAD is IV's achievement.

    All this happenned due to IV members and dedicated IV core. The president of this site IV is not a GULTI, but an Indian who donated about 60,000.00 US dollars. Yes, US $ 60K. He is also just like you and me. Never thought of divisions among immigrants: Neither Indian, Chinese, Philippines nor any origin. We have members from all over the world. The majority unfortunately is from India due to severe retrogression.

    Had president of IV not donated 60,000.00, majority of us would still be struggling for spouse to work.

    Please read IV's goals. Then you can comment whatever you want. Without funds, nothing can be moved. We have to lobby. That is the only option we have. IV core is also like you and me with normal jobs. They can not fly to DC every week or month for lobbying.

    Please think before posting some thing.

    I am not part of core, but have symtahies on them for doing a THANKLESS job for every one's good.

    It would make more sense to compare and brainstorm if you can post the skillset you have in mind and the rate you wish for?

    I agree that being on EAD or having a GC puts a person in a better situation compared to H1B but the bottom line is the skillset in context, demand for that skillset and expertise that one has in that skillset.

    it depends on the skill set and your experience. I accept the fact being on EAD or GC will give advantages. But I dont think GC only make the wonders. you might get 10-20% extra.
