I agree with you completely; I will never travel through frankfurt or any german airport again or any german airline. I think they see indians are sticklers for procedure/afraid lets milk them for some visa money. All we will be doing is get off one airline and switch to other one. Probably that takes like 2 hours within the terminal and for that you have to fill in a paper work, money and spend more time then that gab. This is just out right harrassment. Let them rot in hell :mad:.
Transit visa is the biggest fraud ever on the face of us. As a principle I NEVER traveled on Transit visa after it came in to existence.
It's absolutely ridiculous to charge $$ for a visa where all you are going to do is take a dump in their airport.. :mad::mad::mad:

Well if the system were fair, it wouldn't say x pending ROW, it would be like x pending eb3 and y pending eb2. Yes, there are a lot of applications from India, it is a large country! But why should it be relevant in EB based processing?
Did you choose the country you would be born in, or is somehow one's skillset dependent on national origin?
Like it or not, USA want diversity;), they not want to be a second Indian, Asian, Mexican, African, European etc country.
And one way to try to manage this is by country limits.

I closed my PPF account twice and never paid a single paisa. The second one I closed when I was in US and got the forms here through my old employer and Signed and send those form back to that employer , they filed it, Don'y know if they attached "NOC" but I got all of my money (close to INR80K) in 2 or 3 weeks at my home address in India.
I guess no one needs to pay money for to PPF in any state all you need tyo do is follow the proper instructions, It's as good as in any bank.

About 2 weeks back Murthy posted an article in it's bulletin "new AC-21 regulations expected soon" http://www.murthy.com/mb_pdf/050208_P.html which i believe was a result of some discussions USCIS had with AILA?
Now is this new AC-21 memo released today the one being referred to in the above mentioned Murthy bulletin? OR i should still hold my breath for more AC-21 changes coming from USCIS, so they can jeopardize status of people by changing their interpretation of laws every now and then? Anyone?

This I hope will convince more people to join and align themselves with IV's activities than going in their seperate ways.
Most of us will have ideas, but agreed with a consensus we should let IV Core decide on a set of activities and hopefully more members embrace it.
We can never control what anti's think or how immigrants are viewed etc. We ignore others and we fight for what we think is a just measure.
Look within ourselves than looking at others.
I hope more people embrace IV(monetarily, physically, morally) for us to be able to bring volume into our side of the arguments.

You can sue this guy successfully there is no doubt, but you should have guts to do.

Along same lines, I would like to ask, Mark or whoever in anti-immigration camp,
there are only 1M (may be little less) skilled workers looking for immigration and you have problem with that because all of them are not THE BRIGHTEST one, okay... well first understand, for THE BRIGHTEST we have EB1 which is working great. Now in America there is a lot of work which needs experienced and highly skilled worker and we have EB2 for that, apart from that we still have a lot of work which requires hitech skilled worker and for that we have Eb3. So by the definition system has already identified the need and have representation for those.
And secondly you have problem with those who came legally and are highly skilled and have followed all the rules since day 1, counts less that 1 million, you are not willing to give them GC on other hand there are 12M (actually 20 M) who can't even write their names in English and everybody is ready to give them GC even the president of US is ready.
Doesn't that give signal that US is pro illegal and anti-legal immigration.... think about it

hi, personally i am looking for a chance to move to eb2. Being in eb3-I is as good as u will never get ur GC,or by the time you get ur GC, u would have lost your time and patience to live in this country anymore. follow your instincts..

I do not get it.
As far as I know, a CP applicant can always switch over to AOS if already inside the US. It is harder for an AOS applicant to switch to CP.
You will have to make a choice. Do you want the benefits of CP or AOS? The way things are presently, you cannot have both. So pick one.
But the PD has to be current to switch over.

Well said - I couldnt have said it any better !!! I thought every desi in the US knew this already but apparently NOT!!!
But not because they are 'Indian' but because they are run by sarkari babus. If anyone wants proof Govt. can't run things even remotely as efficiently as private corporations, this is that case study.
Have to give American consulates in India the credit that they have outsourced some job to external private companies.
At Indian consulate the story is quite different. There are many who share Pooja's feeling on this subject as being used to dealing with efficient private businesses in US, as soon as you enter the consulate, the sarkari inefficiency hits you like a ton of bricks. Every small screwup looks like a giant under our microscope and each further screwup just frustrates us exponentially.
As per my last visit to SF consulate, bracing for the worst, I got a surprise to find that it was a breeze, mostly because the lady at the counter was more compassionate and accommodating then the prior ones. But the failure is glaringly at the top level where they fail to define and refine the process, proof-read the information on website (list of document is vague and contains repetitions).
To summarize I think good workers can deliver some time, but the team will ultimately be a failure without good management at the top, and we all know the top management is sarkari babus who could care less as they were appointed from the sifarish of the Govt in New Delhi and not on their own merit.

I don't know how many of you have actually visited DC offices and spoken to Congressional Office staff in person (not just sending E-mails or letters). I have been there, and done that. And I intend to continue to do that for myself, my family and the community..
Let me tell you this, if there is anything related to immigration - whether Visa recapture or increase in numbers - it will be with CIR. There was a slim chance for piecemeal legislation in the 110th Congress. There is almost none in the current Democrat-dominated Congress. This is the political reality we have to live with.
The question I was asked by the Congressional staff repeatedly was - 'If so many thousands are impacted, why are we seeing just 4-5 coming to DC asking for help? Why aren't we hearing about from our constituents? Why is it always 'the outsiders' approaching us? Why aren't they visiting us? Why aren't they writing letters to us?'. So many questions with no answers!
Fact of the matter is our community cannot get what it wants unless we willing to pull our butts off the couch and do the dirty groundwork. Just the 50 or so of us dedicated IV leaders cannot work miracles.
We don't have any magic spells or potions in our pockets. We need your help to succeed.

Sorry to hear the screw up. I had some what similar issue with H1B extension when attorney didn't timely file my application. USCIS approved H1B with no I-94 attached basically asking to leave country and get stamping in India.
We then contacted Murthy firm who filed 'nunc-pro-tunk' petition saying it was a mistake by employer/attorney and I shouldn't be penalized. USCIS then issued new approval with I-94.
I am not sure if this works for 485 but a competent attorney should be able to give a conclusive answer. Since you have the document you should try this and also change the attorney at the same time. You can also get a statement from old attorney about his mistake.

Dear friends, why do you seek to start bashing your country at the first opportunity you get. THere are people in the Indian Govt who are negotiating on your behalf to make sur you get your money back.
THen on the question of paying bribes to get money out of PPF - something is better than nothing. Why complain. If it is so bad, go back and fight to fix the system, otherwise stop maoning. India is the only country that will welcome you if you are kicked out of here. I remember i used to pay 50 INR per ticket for a railway seat, now i go online and book a ticket. Things change they take time and patience.
Only those people who have NEVER bribed anyone to get stuff done illegally, or out of turn should speak. And i know there is no one, since you are in US and came on a passport and we all know how passports are obtained.
You left india, want to stay away, so leave it alone. When you are kicked out of everywhere, the doors will still be open, just keep some cash for the gatekeeper.
Lets discuss whether this swap will be possible or not, or what the loopholes are.

Never bribed to get my passport. Got it in Calcutta (now Kolkata), which has its negatives of course, but you don't have to bribe anyone to get a passport in Cal. The guy who came to do the police verification did not even ask for tea. But I agree with you. Most everyone in India has to pay bribes to get things done. I don't know if he is gonna mess it up if I file on my own. But Senthil has valid point that he should support if there is an RFE.
Do not care about the money now. Give 5k and file thro company. If you need any help from company for RFE or any other issue after filing gc then company will help for you. Because you are working for hourly paying 2 or 3k more than normal should be ok. Some of lawyers are charging more compared to normal
