Hello All,
I have applied for PIO card for my son (who is US citizen) a month ago. We need to travel to India in end of Jan 2011 (have 1 more month). I am not sure when i would get my PIO card. Not sure if I would need to apply for ENTRY VISA to India for my son. I concern is I would have to also send out his original passport along with VISA application. I am worried if it might get lost. Q's -
1 Does any one have idea how long it took to get the entry visa?
2. Has anyone applied for entry visa and has any nightmares like loosing passport etc?

In my case I got a hard LUD followed by a soft LUD on 9/24/2008 and the message was the same. I was very confused if my case was transferred to NBC as I was going out of the country and did not want to miss the interview if anything came up.
After numerous attempts like calling NSC, making an inquiry through the congress rep and taking an Infopass appointment I was still not sure what was going on. Had already been through the NSC->CSC->NSC xfer and this new transfer again, god knows where!!
This thread kind of calmed me a bit as it clearly showed that I am not the only person who is seeing this message.
So, in effect this thread definitely helped me and am sure helped some other folks as well.
This is a discussion board and I don't think you can classify anything as being dumb or foolish. If you are a master at knowing rules and interpreting them better than others GOOD FOR YOU!
it probably means.. they are opening each and every mail they have recived and checking if the docs are in order or not..if they are.. they file it...else they send an RFE...

also I read few months back that out of some 70K SWITCH ppl in usa, they filed GC for less than 100 employees. Do you think only 100 out of some 70K H1B wanted GC??? Another proof that they do not want their employees to move ahead.
Where did you get this stat? It is BS. My company itself processed more than 1000 GCs last two years. To manage the perm load, we had to hire extra paralegal staff apart from distributing PERM applications to more than 3 law firms.
And do you know that many folks who got GC from our company did not resign within 2 years of getting GC. They are highly motivated and achievers.
Amongst SWITCH there are some companies which do not sponsor GC as a policy. I am not denying that. But that doesnt mean that they are wrong.

USCIS has long been plagued by an application backlog, slow processing by poorly trained personnel and an inability to track applications for people. According to LC, my labor got approved on Aug 9th, but we received actual paper on Sep 9th .. So lost the chance to FILE 485
DOL took more than a month TO send papers ..
There is no point in blaming IV . They are the BEST ..
It is US Govt agencies who are lazy and ineptitude.

Secondly, the current mess we are in was caused by the "sub prime" mortgage loans. If you know what "sub prime" means, then you probably know the areas where these houses were purchased. Have you seen the neighborhoods or the areas where these houses are foreclosed? A majority of us won't even drive through there, leave alone buying houses there. So obviously, us buying homes is not going to solve this economic mess. If you still insist, then you perhaps need to take a class on economics 101.

My I-140 was denied incorrectly , as a result my I-485 was denied.
The USCIS is claiming that the I-140 Petition was filed without a certified PERM application. This is absolutely incorrect. The original certified PERM application was filed with the I-140 Petition. I have a photocopy of the original PERM application.
My lawyer filed MTR for both I140 and I485 6weeks ago.I received receipt notices for both I290B.
I was working on my H1B till last week, but was laid off last week and I am searching for job.No one is offering job on H1B.I send a letter to coressman explaining my situation.
Can I use my EAD?-----My Lawyer says my EAD is invalid.
You may start looking for a job and as it is already 6 weeks past MTR filing, you may get a decision soon.

I am trying to understand the cause for this huge delay to issue either EAD or AP. Could it be due to a large number of I-485 filers in July 2007 that the agency is unable to handle the volume of requests (either for a new one or renewal)?
Has USCIS come up with any explanation as to why there is lot of delay to issue EAD renewals or new EADs? Could it be the US economy that is causing the drag on the agency?

Though I have signed G28, I have received both AP and EAD. Attorney did not even know that I received my AP and EAD.
I think EADs are sent to the applicant and AP to the attorney...had the same in my case...plus seen lots of folks here say the same thing...

I don't know why some people here are taking this work based immigration here as an all out war. As it is, working and staying in the US or any other country for that matter by foreigners is a priviledge, not a right. No one forced us to come here, we came here on our own free will.
Regarding the description of discrimination of job based on country, that's rather ridiculous. There is no discrimination when one has the right to work and live in the country, that doesn't mean that anyone from any country can just come here and work with or without authorization and say it's discrimination. How about the many Indian companies who hire only Indians? Aren't they practising discrimination and fraud? They don't even bother to try to find qualified people in the country, rather they just issue H1Bs right way to Indian nationals only by just declaring a bogus "can't find qualified people in the country"
If we want good things to happen to us, we should be fair and not misuse and violate the laws of the country. We all have a choice, we can either stay here and be honest and follow the laws and rules of the country, or if we don't like the way things are here we can just go back home.

Initially I too got the same doubt that it could be a prank from my friend. But the name of the person who called me matches with the name of the person who visited my employer's office around 2 months back. After I got a call from ICE officer, I notified the same to my employer and explained about the call.
Really donno what to do.... Even though the ICE officer took prior appointment for visiting me, should I still contact attorney?
Never heard of this before...are you by any chance employee of any of the companies named in H1B visa fraud last week?
