He called it garbage can out of bitterness and perhaps a little sarcasm. Obviously this is very important to him, otherwise he wouldn't have vented to perfect strangers on the internet. Have you never really wanted something and lashed out at it out of frustration?

At this point, I am hoping USCIS will at least allow me to change jobs (remember - I am on 7th year H1b - approved I-140, did not apply for I-485 due to retro). some members here said this is possible and some other members said I cannot do this. so I am confused if I can do this or not. If at all USCIS lets me do this, it would be great if I can find a new employer who can do EB-2. I am praying to God to help me while I try this route. I am not asking too much here... am I ?

Sorry to hear your story dude. You just met a jerk of a law enforcement official - they are in the minority. Most CBP officers are better than this. Several years ago i too met a jerk like this in an airport in the southeast. I was entering on H1-B, he kept saying that my employer (a reputed american company) was disloyal etc... as he was processing our paperwork. First he grilled my wife, then he started with me, i just responded to him with a disgusted facial expression.. answered his questions rather curtly when asked, did not respond to his rants. His rants were not framed as a question - so i don't have to answer it. All this lasted a total of 5 to 6 minutes as he was checking and stamping our passports.
BTW, not seeing your family for several years is a "humanitarian" cause. Technically the AP is supposed to be used as a travel permit for difficult situations, but most good Americans know that not seeing family for years is a good enough reason. There are jerks everywhere and type A's, thankfully they are not in the majority.

He kept on grilling me, I asked him to call his supervisor and also offered him to call my lawyer and then he backed off. I noted his name and his ID number etc.

While the extension process was going on, I with the help from my company lawyer filed a complaint to CBP against the officer and later the officer was transferred (As per my lawyer) to some other desk duty.

I am not saying that it is working on the USCIS. We dont know yet coz the flowers start reaching there tommorow. If it is working on USCIS, we would know by the end of the week. Not now.

Hi,
I am also in the same boat and waiting for the approval as I have recently took a new job with EAD. Yesterday I called USCIS to check what the options are if I don't get my EAD in 90 days. The customer service representative told me to take an info appointment further to get the Interim EAD. I have explained him that local offices are not giving Interim EADs and surprisingly he told me the following thing.
"You can continue the work with I765 receipt notice provided your employer is OK to continue and told me to provide the receipt notice to the employer as a proof of your application is in pending. As I am surely aware of the fact that in order to continue the work we must have an approved physical EAD. I was totally surprised and asked him "Are you sure?? can we continue the work with the receipt??", he replied "Yes and only if your employer agrees for that!"
I have no clue???? What to do, friends please share your thoughts on this.

If I could hire IV by paying some money and then forget about it, i would do that. However, as far as I know, IV core is composed of regular folks who are also on visas and therefore can only work during their spare time/vaccation time. I know every one of us is impatient with this EB process, but the reality is our movment is not big/strong enough. Most of us once we get hold of the Green card (is it really green color??) completely forget that we were once part of an everlasting que with so many desperate people.
This is the main difference between EB community and the ilegals. Ilegals are united by a lot of factors and even their legal relatives dont think twice before struggling/fighting for them. How many of our dear Indian/chinese friends (who are citizens of this nation) will stand up for us??? Even though many came here and strugled to obtain the EB green card, now we are alien to them!!!
Consider the ilegal people:-

When you use AC21, you mention a new employer, and that is the employer you "intent" to be employed for an infinite period of time, after getting your GC.

My first PERM (through company A) was denied, as I told before, just because the PERM software automatically denies application with requirements that exceed "normal" SVP level. (Moreover, it accuses you in claiming that the requirements are normal, even if you didn't claim that!) I am not preparing a second appeal. I am preparing a second PERM filing through another company.
I couldn't really find any information about the appeal process on the LC once it is denied. the ironic thing is that my first LC was approved then after I got promoted to a senior position and applied for a second LC, the 2nd LC was denied because they think there is no difference between the 1st and 2nd position. does the DOL have an automatic system that processes the LC and that why it coudn't see the difference between the 2 positions??
where can i find more info about the appeal process?? any links to go to??

AFAIK, AP is considered only for emergency travel. That said, I think the officer was being over reactive.
As we all know, immigration laws are arcane. AP for emergency travel was ok when people used to get GC within 6 months of 485 filing. Now, when it can take anywhere from 1 to 3 years to get GC after 485 filing, does it make sense to have AP for only emergency?! Crap...

Sorry to hear about such cases. We all have to realize one thing here. The employers need us equally bad as we need them (more often than not, not talking about Indian consultancies here). If ever one encounters such racial discrimination and open abuse at the work place, the best recourse is to file a complaint with the higher ups in the HR, start searching for another employer and ditch the current racist employer at the right moment with an appropriate email sent to everyone detailing why the person is leaving at such an important phase of the product development. Yeah, this might sound un-ethical, but sometimes situations do demand such drastic measures to send the right message. That's when all these racist employers would realize the importance of the person that just left the company. Then they can try to fill in the position with their preferred race qualified person and see how difficult that gets!!
Better still, please talk to your friends and family in other parts of the US and find the areas in the US that are cosmopolitan and try to move to those places. Yeah that is very difficult in the short-term, but in the long-run, you would have peace of mind and a good quality of life after making such a move. Fortunately, i am in the Bay area and i have rarely encountered such racial prejudices out here. Just my two cents.

I did not get any justice, the HR was also having the same opinion, was talking about Indians in the company on h1b and all issues associated the and she said she has 14 years of experience dealing with this and knows how to fix this problem. I was kicked out of the company. No look back at all. I pleaded, told her I will take back my complaint and will not complain but no use. They terminated my employment and could never never fill that position again, but the company did not survive for long though.
I moved to desi consulting after that and things started going a lot better with a understanding employer and I am doing better now.
Fellas - watch out, especially those working in BPO etc.. where they have to deal with abusive clients...
Recently, I stopped taking all these racial comments in a serious way, 2 days back my co worker made comments on how my "curry smells" when eat at my desk. My wife wakes up early in the morning and cooks the food with so much love and affection and I eat that, whereas he eats burgers and fries from cafeteria - look at who is commenting??????

Your good fight on the retrogression issue kind of kept us going without giving up. In just a few days what some of you have done with www.immigrationvoice.org is amazing and it truly deserves a lot better than the faint response they have got so far from all of us in this legal black hole. Honestly, I do not care if we are not able to raise 100K dollars for the lobbying efforts for the next immigration bill on February. I don not care if this money is finally lost. It will be money well spent if we all realize that we have to do something instead of waiting years and years and years� Any money is worth the effort regarding our goals, even if our present intention does not succeed. Is worth it!!. Lets move on, hoping for the best� It is worth to try this next immigration bill. Any money spent on this is worth it� Can not you guys see it? More and more years on this black hole!! More years paying our lawyers for H1B renewal, more years for renewal of our driving licenses, more years for our wives to wait, more years for our employers exploiting us� This next immigration bill could be our last chance in many years to get our unfair and sad situation known and probably solved. We would at least raise enough concern about the absurd situation of the legal immigrants� It could be a new Quixote tale, I do not care� A good part of my next paycheck will go to immigrationvoice� Whatever� Keep America growing� America is not just them�. It is all of us� It has always been� It is what America is made of�
