I can completely understand the liberation from people who take undue advantage of our status. For now, I can only dream about my liberation:)
Best of Luck with your future endeavors. Please stop by to answer any questions on this forum
Cheers!
Got the approval notice today :) "Welcome to the United States of America" - ironically i have been in this country for a decade now! finally the "welcome" :)
It has been a very long journey!!! and a very frustrating one for the last few years... but the feeling that I now get is really liberating... first thing I did was thanked God for ending the seemingly endless wait that me and my wife (she didn't care as much) were in.
I'm already thinking of the things I want to do after this new found liberation... it includes showing the middle finger to those who have taken undue advantage of my status  :D and i'm not taking it anymore... I'll be a new person starting Monday!
Just so there is no confusion... my PD was Feb 2003 EB3 but my wife's PD was EB2 April 2004... we got our freedom through her application. If anyone needs more info on how/what/when - i can share that (it had its up's and downs - mainly downs, but all's well that ends well)!
Lastly as a token of my real support to the cause of IV I will be donating a small amount. I have donated in the past... I have participated in conversations in the past... I was not so active on other fronts but I truly believe in this organizations effort to help the community. And God willing each one of you will get this freedom soon! God Bless!

How 'bout when you're swimming?
its plastic, not paper. [so I am told, I dont know, I am still waiting]. Nothing happens if you dip it in water.
Just buy swimming shorts (or a bikini depending on your gender or preferences) with a pocket.
P.S: this post is a joke, so easy with the flames.

Indian work visas for US citizens equal H1Bs L1s (http://www.samachar.com/Indian-work-visas-for-US-citizens-equal-H1Bs-L1s-le2mJKhhjcc.html)
"That took the tally of Americans working in India last year to more than 42,000. ....
India, he noted, should look at comparable fee structures for issuing work visas for US nationals – currently, the fees are very low and put Indian companies at a disadvantage. “The enhanced fees should be used to fund higher education by giving scholarships,” he said. Last August, the US Senate approved a hike in application fees for H-1B and L1 visas. The money raised would fund security improvements along the porous US-Mexico border. "

What will be my status after i file my I485?
My current I-94 will expire on 16th Sep 2007 (on the day my current visa stamp in my passport expires and my current H1 B is set to expire Mid April 2008).
I am planning to make a trip to Cannda or someplace to get a new I-94 as soon as i get my new passport (i had sent it for renewal on june 2nd). But i am a little worried about my status if i am unable to make the trip.
So my question is what will be my status after 16th sep 2007 (once i file for I485 (first week of July2007) and my I-94 expires on 16th Sep 2007)?
Appreciate any responses ...
Your status has nothing to do with that. If you say that your H1B is good till April 2008, then you are in status till then

Thanks for the responses.
YEah i did get my passport renewed rigght after i came back from Canada.
However i totally forgot about my I-94.
So you think the only way to get the i-94 extended is to go out of country.
Even i heard about getting I-94 renewed from major international airports. Does anybody has any further information related to this?
Please advise. GOT THIS FROM Internet

Grow up buddy, don't be a cry babby.
We all know why U and me visit the site, Information. And in the process if you find any thing not so important to you, just ignore and move on...did this thread of asking to send letters made other threads invisible?
Just to piss u off, i am requesting again to all the folks to send letters.
Well, you have not pissed me at all. I did what IV had asked in one month back. I had sent my 2 letters (me and my wife) 17 days back and collected another 12 letters from friends and send them too. I had contributed what ever IV had asked until now, what ever it may be.
I am sorry, but just a note can baffle you guys and you put all the -ve comments to the post, then sorry to say you guys cannot take any constructive opinion from others. And I think I did no wrong in asking Chanduv to stop posting innumerable threads just for one cause.
GOD Bless you all.

If I were you, I would not have gone with the repeat of X-ray test unless it was absolutely necessary. X-ray are very harmful to the human cells and tissues. It was a ( Probably honest) mistake by the doctor who was going to give the correct report...and you forced him to take the x-ray again!! hmmmmm....I have nothing more to say.
I did not force.
The RFE clearly stated that "Civil Surgeon Should also attached a XRAY report".
It did not say this, which I wish it did, that "if tb test shows that there are signs of tb, then the civil surgeon should administer a xray and attach the xray report".
The language in the RFE caused my lawyer to say that, to have no issues, its always best to follow the RFE language code exactly, even if did not make sense. One should always give more data in the RFE response than needed.
Let me tell you one thing, the RFE language/sentence completely contradicts the rules written on the new i693 form or the document which has been created for civil surgeons on how to do medical tests for immigration. In those documents it clearly says that take an xray IF required, ie, if the tab patch grows beyond certain millimeter etc...But since the RFE clearly asked for it, I had no choice but to force the civil surgeon.
One writes the rules and others misinterpret it because the language is ambiguous. Its better to be safe than sorry. USCIS has hired new people to do adjudication. None of them are experienced. I dont want them to generate another RFE or deny.

Actions speak louder than words... Lou Dobbs says Microsoft has waged war against the American middleclass by taking the company to Canada. But that hasn't stopped the company from starting a development center in Canada, nor has the company cared to answer Lou Dobbs in a press release or anything. What I am saying is, we should not care about what Lou Dobbs thinks or says on his show. As long as we being here helps grow the American economy, nobody cares about what Lou Dobbs thinks!!!
Maybe you and I don't care what Lou Dobbs thinks since we already know what the truth is. How about that average family who are oblivious to our situation ? They just watch network television and dare not question the facts because it is coming from CNN and Lou Dobbs.
To the average American H1-B visas almost mean outsourcing American jobs. The reason for this is the misinformation perpetrated by the mainstream media. We stand to lose a lot if we don't counter it. It is necessary to be LOUD and CLEAR and tell them that they are wrong.
Our silence will just reek of acceptance. All the information dispersed by these self-anointed saviors of the American middle-class, will become the truth and we will become the culprits - the so called outsourcers of American jobs. To some extent we already have acquired that reputation.

"One additional reason for making sure that you have a valid EAD at all times is so that you can claim unemployment benefits in the event you lose your job. H nonimmigrants do not qualify for unemployment insurance. If you have an EAD, however, and can be referred out for job interviews, you do qualify for UI, even if you don't yet have your green card."
The above is quite interesting. I saw people who were laid off and had question about applying for UI if they are on EAD and this answer explains it really well.

We should put our previous agenda of recapturing of unsed visas, increasing visa numbers for EB, excluding family members from being counted in the quota and lifting per country limits in the back burner.
At the moment we should demand that USCIS release the real data of pending I485 application for FB and EB categories instead of the lame DOS visa bulletin they release every month. This data should include the number of application received every month for each of the category for the last 10 years because we have people from 1998 still waiting for their GC. I repeat "WE HAVE TO DEMAND". Once we get USCIS to disclose this information we can make our own personal plans.
Without the correct data we are just shooting in the dark. The basis of our ageda itself is not on solid foundation without proper data.
DEMAND FROM USCIS FOR THE PENDING I485 application stats and we will find an answer to all out problems

- A person is on his 5th Year of H1 and his I-485 gets rejected - he can go back to H1 (Since he has 1 year left).
- A person has exhausted his 6 years (May be in his 7th year). Now his I-485 gets rejected - he cannot go back to H1 (Since he has exhausted his 6 years on H1).
Not sure if my understanding is right here
That is correct, scenario 1, atleast to me, seems like a smarter choice, and that is what I have chosen to do.
You can go back on the H-1B if your 485 were to get denied and your appeals (assuming you made any) were to fail, although I am not sure if you need to leave the country and re-enter or if you can adjust status to H-1B without leaving the country.

Buddy, what were you doing for 40 days after your got terminated? If you knew it was coming you should have made efforts to transfer H1 or right after. If you transfer H1, then obviously INS will look for pay stubs etc from the last sponsoring co. Since you mentioned you never actually worked for them (if I understand this right) then you are in trouble. You can use EAD but you lose your H1 status. If you want to get back to H1 then you are back in the lottery mess to qualify for one. Obviously you need to decide what is important to you at this point. Marriage or your job/GC. Good luck.
You can always marry a US Citizen and solve both the problems !!!!
How about that
